Die Verordnung (EU) Nr. 648/2012 (Marktinfrastrukturverordnung), Langname Verordnung (EU) Nr. 648/2012 des Europäischen Parlaments und des Rates vom 4. Juli 2012 über OTC-Derivate, zentrale Gegenparteien und Transaktionsregister, ist eine EU-Verordnung zur Regulierung des außerbörslichen Derivatehandels. Über die Abkürzung EMIR für die inoffizielle englische Bezeichnung European Market Infrastructure Regulation hat auch die Kurzbezeichnung EMIR-Verordnung weite Verbreitung gefunden. Die Verordnung regelt den außerbörslichen Handel mit Derivaten. Kern der Regulierung ist die Verpflichtung der Marktteilnehmer zum Clearing ihrer außerbörslichen Standard-Derivatgeschäfte über einen Zentralen Kontrahenten sowie die Meldung dieser Geschäfte an ein Transaktionsregister. It provides steer on reporting of derivative contracts, implementation of risk management standards and common rules for central counterparties and trade repositories. The regulation was initially adopted in 2012 and an amended version, the EMIR Refit regulation, was later on adopted in 2019. Ce texte a pour objectif de réduire les risques liés aux produits dérivés de gré à gré (ou Over The Counter - OTC en anglais) en favorisant la transparence et la standardisation de ce type d'instruments financiers. EMIR entraîne également la création d'une nouvelle catégorie d'infrastructures de marché, les référentiels centraux (Trade Repositories), et réglemente fortement les activités des chambres de compensation, également appelées contrepartie centrale (Central Counterparties, ou CCP). Ces différents types d'acteurs sont placés sous la supervision de l’AEMF, le régulateur européen des marchés financiers.
