Well not necessarily? I think it's just the case that the legal path isn't clear.

Mark/Dalibor, is something you could ask Oracle legal to give their opinion on?

"No" or "I can't answer that" or "it's best to ask your own lawyers" is a perfectly fine answer in my books :-). Especially if it's the last one - there are other OpenJDK members with the legal resources to look into this properly. Every little area of ambiguity we can clear up one way or the other I think will be good for the OpenJDK in the long run.

I believe a variant of that question was already answered in http://mail.openjdk.java.net/pipermail/discuss/2011-October/002081.html making the other question moot. Ok, so no way to include this on OpenJDK ;(
