However, this situation manifested in different ways within the types of fiqh writing. Customs and traditions are not directly addressed as evidence in the works of methodology, in which the methods of determining the verdict are discussed. However, it is known that customs and traditions are frequently used in the works of furu. In addition, the fact that these concepts are used sometimes interchangeably and sometimes independently without any discrimination makes it difficult to distinguish their roles in legal provisions and causes the meanings they express in the fiqh literature to be examined without being sufficiently clarified. Also, the fact that these concepts are used without any discrimination makes it difficult to distinguish their roles in legal provisions. In addition, this situation causes the meanings expressed in the fiqh literature to be examined without being sufficiently clarified. The place of customs and traditions in the works of furûq and qawaid, which were copyrighted between the 5th and 10th centuries and accepted as special writing types in the fiqh literature, is examined in this thesis. In the introduction part of the research, which consists of an introduction and two parts, the importance, purpose, limit, method and sources of the research are mentioned, and then a brief analysis of the concepts of furûq and qawaid is made. In the first part, the place of custom and traditions in the literature of fiqh has been examined in general and a theoretical ground has been tried to be established. In the second part, the customs and traditions in the works of furûk and kawaid, which are based on certain criteria, are examined in terms of meaning, method and content.
