Islam ekonomisi ve finansal sistemine iliskin cagdas ifade ve yaklasimlarda mumkun oldukca klasik... more Islam ekonomisi ve finansal sistemine iliskin cagdas ifade ve yaklasimlarda mumkun oldukca klasik fikih literaturunde kullanilan teknik dil ve ifadelerin kullanilmasinda belirgin bir hassasiyetin oldugu gorulmektedir. Hatta icerik olarak da fikhi birikime sadik kalmaya ozen gosterilmektedir. Buna ragmen klasik donemde olmayan cesitli yontem ve teknikleri ifade icin farkli kavramlarin kullanildigi gorulmektedir. Calismamizin konusunu olusturan “damân el-ciddiye” kavrami bunlardan biridir. Bu calismada klasik fikih literaturunde yer almayan bu kavramin hem icerik hem de ser’i niteligi incelenecektir.

Ilk anlami, felsefi acidan hukuk ve etik arasindaki iliskiyle ilgilidir. Ikinci anlami ise, hukukcu olarak adlandirilan hukuk camiasina mensup kisilerin izlemeleri gereken etik kurallar ve degerlerle ilgilidir. Bu calismamizda hukuk ve etik arasindaki iliskiye yer vermeyerek ikinci anlamina odaklandik. Ayrica hukukcular, yani hukukla iliskili meslek grubu derken de bundan, yasa koyucular ve uygulayicilar olarak iki grup anlasilmistir. Bu calismamizda hukukun uygulayicilari olan hâkimlerin meslege ozgu erdemleri uzerinde durduk. Ayrica tarihi surec icerisinde yayinlanmis olan belgelerde vurgulanan yargi etigi ile ilgili ilkeleri, gunumuzde uluslararasi sozlesmelerce kabul edilmis ilkelerle karsilastirmali olarak sunduk

Bu kavramin icerigi hukuk, iktisat ve siyaset felsefesi zemininde cokca tartisilmistir. Her sistem bu kavrami kendince tanimladiklari icin bu kavramin icerigi, kullanildiklari alanlarda farklilasmaktadir. Islam iktisadina dair yazilmis eserlerde “adalet” ve “hakkaniyet” kavramlari sikca kullanildiklari halde bu kavramlarin cok da tanimli oldugunu soylemek mumkun degildir. Biz bu calismamizda “adalet” kavraminin Islam hukuk ve iktisat felsefesi acisindan dini temeli ve icerigini analiz etmeye calisacagiz.

What makes professor Çağıl different is not pulling law into metaphysics because, natural law theory, in itself, has a metaphysical dimension. The way makes his thoughts different is his being in a mystical approach to law, even to natural law. Abstract:

In this study, we emphasize on the criticisms towards Mecelle. There
is no way to accept these criticisms as objective because of two
reasons: First, as Christoph K. Neumann states that, all the refusal
attitude towards the Ottoman Empire precluded Ahmet Cevdet Pasha and
Mecelle from having deserved value. Second, ideological approaches had
make Mecelle look like an unsuccessful law text. The reason behing
this devaulation is that accepting Mecelle as a successful codex and a
civil code which is able to fulfill the requirements of the era means
that it is possible to make a civil law that forms the basis of the
society depending on the Islamic law. Because of that,
giving Mecelle to its due is extremely important for both the Islamic
law and history of law.

Abstract: In this study, we did not concern the relation between law and ethics but we particularly focused on the second sense. Jurists have used the concept legal ethics in two senses. First sense, it is concerned with the relation between law and ethics. As for the second sense, it is concerned with the moral rules and values whom the jurists, the people belong to the juristic community, should watch. In this study, we did not concern the relation between law and ethics but we particularly focused on the second sense. Besides, the word jurists refer to two groups of people; the law-makers and the legislation officers. In this study, judges as the legislation officers’ virtues particular to their profession are emphasized. Furthermore, a comparison between the historical documents mentioning the principals of juridical ethics and the principals accepted by contemporary international agreements is presented.
