La innovación es clave para la competitividad y el crecimiento económico de los países, tanto en los niveles micro como macro. The main objective of this article is to give an overview for an international audience of the re... more The main objective of this article is to give an overview for an international audience of the results of two acts which were passed the same year, 2007 the French Enforceable right to housing (Droit au logement opposable, later referred as DALO) Act, and the Catalan Right to Housing Act (Llei catalana del dret a l ́habitatge, CRHA). Both acts are good examples of legal innovations regarding land use and housing at the beginning of the 21st Century. The first one established an enforceable right to housing in France for the first time in French history. The second one is the first act regarding the right to housing in Catalan history; it connected land use and housing, establishing inclusionary zoning techniques and promoting social mix.

La mera posibilidad de esta actividad puede despertar (pre) juicios negativos. El estudio plantea directamente la cuestión, para responderla de forma positiva. Se da en la práctica y carece aún de una regulación y de un control judicial adecuados, que el trabajo propone mejorar.

I agree with this statement but must add a nuance: good administration means good administrative procedures and good reasons to back the final decision, as we will see shortly. 8. Recommendation of the Comm. of Ministers No. R (80) 2 Concerning the Exercise of Discretionary Powers by Administrative Authorities, 316th Mtg. (1980) (adopted by the Committee of Ministers on March 11, 1980 at the 316th meeting of the Ministers' deputies) [hereinafter Recommendation of the Comm. ofMinisters]. JULI PONCE The core of discretion, that is, the choice between alternatives, is something odd in traditional administrative law, which does not deal with it, except for delimiting boundaries for discretion that cannot be crossed. The choice itself is considered a matter of politics, not a legal issue. In the traditional paradigm, administrative law provides, above all, a defense for individuals, a shield against arbitrary decisions. From that point of view, where statute ends, tyranny begins-and the only effective protection against tyranny is judicial review. Therefore, traditional administrative law is not especially interested in good administrative decisions but in the judicial review of illegal decisions, to protect citizens against public arbitrariness. This is a negative approach in the sense that it is an approach against arbitrariness that does not favor good administration, and it is possible to link this point of view with Harlow and Rawling's metaphor of red-light theorists. 9 This approach has been common in Spain for a long time, as well as in other European countries, as detailed by Cassese's explanation of the principle of legality as a "fetish."'" But a new viewpoint is growing all around Europe. This new approach is concerned with the quality of decisions, a relatively new paradigm for us, but well established in the United States. The discretionary choice itself is relevant for administrative law, because it is concerned with good decisions and with good administration. It is important that public administration makes both legal and correct decisions, with proper reasoning to back them. This is important because people demand that such good decisions be made and they want to participate in decisions that affect them most, such as where a highway should be constructed or where a nuclear plant should be built. As Braibant has graphically pointed out, "Even when public authorities are allowed to do what they want, they cannot do whatever."" That is, the proper use of discretionary powers matters to public law. And the proper use of discretionary power is defined by the idea of good administration. This concept cannot be a pass par tout, but has to have its own meaning as a legal technique.

Administrative law plays an important role in preventing corruption by regulating institutions to encourage good governance and good administration, improve transparency, promote ethical values among public officials, prevent conflicts of interest and avoid their transformation into corruption. In this book, renowned experts from several countries analyse the regulation of transparency, public ethics, conflict of interest prevention, lobby activity, political financing, good government, good administration and accountability in present times. From a general point of view, it is also examined the role of regulation and mechanisms to improve its quality to prevent corruption. The law of catastrophic wildfire prevention and response in the Mediterranean member states of th... more The law of catastrophic wildfire prevention and response in the Mediterranean member states of the European Union stands in stark contrast to that of common law nation states such as Australia and the United States. This is due primarily to the higher levels of reciprocal moral and legal obligations between governments and citizens established in various sources of European law. Focusing on the relationship between the EU, Spain, and the Autonomous Community of Catalonia within Spain, this chapter describes these three legal frameworks as they are nested within each other, followed by some case law examples of these laws in action. We compare and contrast the philosophical assumptions underlying the utilitarian cost-benefit approach to regulatory justification used in the United States with the precautionary principle model emblematic of the European Union, the member state of Spain, and its Autonomous Community of Catalonia. Regardless of approach, protection of the public health, safety, and welfare will only be as robust and effective as the government agencies that have that responsibility, and the degree of cooperation with those agencies of the citizens they serve. Focusing on the relationship between the EU, Spain, and the Autonomous Community of Catalonia within Spain, this chapter describes these three legal frameworks as they are nested within each other, followed by some case law examples of these laws in action. We compare and contrast the philosophical assumptions underlying the utilitarian cost-benefit approach to regulatory justification used in the United States with the precautionary principle model emblematic of the European Union, the member state of Spain, and its Autonomous Community of Catalonia. Regardless of approach, protection of the public health, safety, and welfare will only be as robust and effective as the government agencies that have that responsibility, and the degree of cooperation with those agencies of the citizens they serve. El derecho a la vivienda regulado constitucional y legalmente en España incorpora obligaciones de... more El derecho a la vivienda regulado constitucional y legalmente en España incorpora obligaciones de aplicación directa a todos los poderes públicos y está siendo protegido por los tribunales de justicia, en la línea de lo que expone la jurisprudencia internacional. En cambio, el Tribunal Constitucional y el legislador no han desarrollado hasta ahora ni una doctrina ni una legislación que permita la efectividad máxima del derecho, si bien en el caso legislativo recientes desarrollos normativos en algunas comunidades autónomas están implantando obligaciones de resultado exigibles judicialmente como ya han hecho otros países europeos. Sin embargo, las mismas chocan con el dogma arraigado de la libertad absoluta del legislador presupuestario, que este análisis discute.

Se destacan las cuestiones más destacadas de dicha jurisprudencia y se pone en conexión con la nueva generación de leyes de transparencia, acceso a la información y buen gobierno. Por el momento, jurisprudencia y legislación han seguido caminos paralelos pero separados en relación con el derecho a una buena administración y los principios de buen gobierno.
