Ideja Ujedinjene Evrope, u smislu jedinstvenog političkog, ekonomskog, kulturnog, a tek kasnije i... more Ideja Ujedinjene Evrope, u smislu jedinstvenog političkog, ekonomskog, kulturnog, a tek kasnije i pravnog entiteta, sreće se još od vremena Rimske imperije. Kasnije je poprimala različite oblike: od ideja o „hrišćanskoj konfederaciji“ (katoličkoj i/ili protestantskoj) i trajnog napadačko-odbrambenog saveza za postizanje mira, do planova za stvaranje razrađenih institucionalnih okvira. Uprkos mnogim idejama o (pre)uređenju Evrope, suštinski napredak nije postignut sve do sredine 20. veka. Stvaranjem ekonomskih, političkih i pravnih struktura, činilo se da je ta ideja ne samo zaživela, već da je postala poput civilizacijske datosti, to jest ono bez čega se funkcionisanje današnjeg sveta ni na jednom planu ne bi moglo zamisliti. Međutim, ako pogledamo istorijat, aktuelan način funkcionisanja, te perspektive za (pre)oblikovanje Ujedinjene Evrope, teško je ne posumnjati u održivost njenog postojanja, i same ideje i njene aktuelne i budućih manifestacija.

Medieval hospitals, and more broadly, health care in general, were in the beginnings accessible o... more Medieval hospitals, and more broadly, health care in general, were in the beginnings accessible only to a small part of the population. They were created primarily for the needs of monks in large monastic centers, such as Hilandar and Studenica. Their organisation was regulated by the provisions of the typics, written under Roman influence, and adapted according to the circumstances of medieval Serbia. The mission of these institutions was primarily the healing of the sick, and over time, specialisation in the treatment of diseases and care for people with disabilities became more prominent. Data on their organisation, as well as on the status of hospital staff and patients comes from various legal, but also literary, archaeological and other sources. The level of medical knowledge of „hospital employees”, the appearance of doctors later on and special hospital administration greatly helped the development of hospital care, whose benefits would begin to be felt by the secular popula...

Dušan’s Code continues the earlier regulation of legal relations following the local legal tradit... more Dušan’s Code continues the earlier regulation of legal relations following the local legal tradition, paying a lot of attention to the legalization of social stratification: determining the legal position of different categories of the population in different ways. In addition to their social status, their sex also had a great influence on their position: through the regulation of the general position of the „poor spinner” and the procedural one of the „poor woman”, as well as through other provisions on the legal position of women. At the opposite end of the social spectrum are female members of the ruling class – the noblewomen. They are found especially in the matter of inheritance law, less so in criminal and other branches of law. In addition to the analysis of the rules that apply to them, the paper will also address the specifics of the application of other, „neutral” rules to the status of women in Dušan’s empire, as well as those concerning the „Lady Empress”, to which cert...

Pitanje odnosa države i crkve u evropskom pravu predstavlja večitu aktuelnost, još od vremena kad... more Pitanje odnosa države i crkve u evropskom pravu predstavlja večitu aktuelnost, još od vremena kada po prvi put ova dva najvažnija oblika ljudskog udruživanja počinju da pretenduju na uređenje istih sfera društvenog delovanja. Suština tih odnosa jeste jedno od centralnih pitanja forum externum-a crkvenog prava, te je kao takvo predmet mnogobrojnih teorijskih polemika. Nakon višedecenijske suštinske pravne praznine, tek pre dvadesetak godina ponovo u prvi plan izbija potreba da državno-crkveno pravo bude uređeno jednom sveobuhvatnom kodifikacijom. Kao rezultat tih napora nastaje srpski Zakon o crkvama i verskim zajednicama iz 2006. godine. Prilikom izrade tog zakonskog teksta tražen je najcelishodniji način popunjavanja pomenute pravne praznine: da li posegnuti za potpuno originalnim rešenjima, koja sa sobom nose rizik svakog novog pravnog instituta; uzeti pravnu transplantaciju iz srodnih pravnih sistema; ili se pak okrenuti prekinutom razvoju ove grane prava u Kraljevini SHS/ Kralje...
