Abstract Alternative Dispute Resolution i... more Abstract
Alternative Dispute Resolution is gradually increasing day by day in Bangladesh. People who are searching for justice are habitually harassed in the court zone. As a result, ADR approaches to make them free from stalking. The study concentrates on the practice and implementation of Alternative Dispute Resolution in civil justice and the idea to promote Alternative Dispute Resolution (ADR) in civil justice system in Bangladesh. There have seen some objective and subjective factors have led our civil judiciary to a situation where its demerits are ruling over the merits, which disable the judiciary system backlogs and delays. The research does not focus on whether ADR is better than the old traditional court-based system rather the study shows how ADR can be executed more effectively in the legal system of Bangladesh and to inform about Alternative Dispute Resolution among the people who badly need justice but those people are unaware about the alternative resolution. The study focuses on fundamental laws relating court-based ADR in Bangladesh particularly in civil matters. Generally, the modes of ADR mediation, negotiation and conciliation and the NGOs are the major stages which can be implemented in civil justice system as a tool of ADR to remove the barriers in accessing justice. Moreover, Alternative Dispute Resolution has some drawbacks also which we have to implement in such a way that it cannot cause any harm in the legal system in Bangladesh. In the research paper has labelled about the Alternative Dispute Resolution (ADR) with the practice of ADR in Bangladesh with the informal and formal procedural systems, what are the challenges an individual or the justice seekers are facing in accessing justice in the court. The research paper will conclude by analyzing the current status of Judicial system which will be a comparative study in Bangladesh. The field of ADR is not binding rather the practice of ADR is flexible and unique.
