The practice of submitting Third Party Interventions (TPIs)also known as Amicus Curiae briefs-is ... more The practice of submitting Third Party Interventions (TPIs)also known as Amicus Curiae briefs-is well established in Commonwealth jurisdictions, and it has become common practice within regional mechanisms such as the Inter-American and European Courts of Human Rights, and the African Court on Human and Peoples' rights. Similarly, most of the eight UN Treaty Bodies (UNTBs) mandated to review individual communications (ICs) have also received TPIs. Although the amount of TPIs submitted to the UNTBs is nowhere commensurate to those submitted to regional courts, it is growing. A new resource published by the International Service for Human Rights (ISHR) with support from international law firm DLA Piper provides guidance to potential authors.

The upcoming review of the UN’s human rights treaty bodies in 2020 provides an opportunity to inc... more The upcoming review of the UN’s human rights treaty bodies in 2020 provides an opportunity to increase the impact that these mechanisms have on States’ implementation of their human rights commitments. Yet the review is poised to take place at a time of great challenge to the international human rights system. The UN’s human rights treaties are, quite simply, the legal and normative foundation of the international human rights system. Over the past fifty-plus years, nine such treaties and ten treaty bodies have been developed and adopted at the UN. While few Member States have ratified them all, several of the treaties have nearly universal membership.

The OPCAT Special Fund: A New Resource for Torture Prevention?

The establishment of a fund to support the implementation of the Optional Protocol to the Convent... more The establishment of a fund to support the implementation of the Optional Protocol to the Convention against Torture (OPCAT) by the UN in 2011 represents a major opportunity for all actors working on torture prevention. The treaty itself does not provide much detail as to how the Fund should operate or what initiatives should be supported through contributions. It only mentions that the Fund should support the implementation of recommendations from the UN Subcommittee on Prevention of Torture (SPT) as well as ‘educational programmes’ of national institutions for the prevention of torture (so-called national preventive mechanisms, or NPMs). Like its sister fund, the UN Fund for Victims of Torture, the OPCAT Special Fund could contribute to bringing human rights closer to the ground and provide direct support to a burgeoning and vibrant movement of torture prevention actors around the world. However, the Fund has so far only been open to a small number of institutions in less than 15 countries globally, and for projects focused exclusively on the implementation of some recommendations formulated by the SPT. The Fund has also suffered from a lack of contributions. This policy and practice note seeks to establish an overview of the initial operations of the Fund and to identify some opportunities in its development, both internally and externally.

Des plans et stratégies innovants ont été conçus pour combler le fossé des rapports avec les organes internationaux des droits de l'homme, et certaines mesures ont été prises pour donner suite à leurs recommandations. L' étude constate également que le NMRF tunisien a un fort potentiel pour stimuler la mise en oeuvre nationale des recommandations sur les droits de l'homme émanant d' organismes internationaux et régionaux. The UN Committee against torture (CAT) adopted in 2015 an innovative system to follow up, assess ... more The UN Committee against torture (CAT) adopted in 2015 an innovative system to follow up, assess
and grade the implementation of its recommendations to States. The new follow-up procedure largely
draws on the precedent established by the UN Human Rights Committee, although it is also more
comprehensive. It offers a range of new opportunities for human rights defenders and practitioners both
to increase the visibility on the implementation of CAT recommendations, as well as encouraging States
parties to do more to comply with those recommendations. The CAT and the Human Rights Committee
now stand at the forefront of an emerging trend of improved assessment of the implementation of UN
human rights bodies’ recommendations. Despite the formidable potential which the evaluation and
grading system provides, much remains to be done to make the most of them. They need to be better
promoted and disseminated to a broad range of actors. They should also be harmonised and made more
accessible. Other treaty bodies and fellow UN human rights bodies such as Special Procedures or the
Universal Periodic Review should draw on the positive precedents established by the Human Rights
Committee and the CAT. As other treaty bodies are considering the adoption of follow up and
assessment systems, notably in preparation for the 2020 review, other UN human rights bodies could
draw inspiration from the system established by treaty bodies to better follow and track implementation
