The international legal framework for the protection and safeguarding of intangible cultural heri... more The international legal framework for the protection and safeguarding of intangible cultural heritage (ICH) is broad. There is a range of conventions and agreements which reflect and establish legal obligations and standards for states parties, communities and people to implement, negotiate and interpret their cultural and intellectual rights. This has arisen in response to the conflicts, competing claims and ongoing negotiations on cultural identity, ethics and the 'ownership' and restitution of cultural heritage. Current approaches include applying intellectual property rights and cultural heritage conventions. This paper focuses on the relationship between environmental protection and the safeguarding of ICH. It examines the effect of international environmental protections on the safeguarding of ICH and argues that the environmental law concept of sustainable development is a useful basis to augment and link the existing fragmented international framework of protection of ICH.

The findings recommend reform of the existing legal and policy framework to support the critical role of indigenous peoples and local communities in the practice and transmission of intangible cultural heritage.
