Intelligence: National and Homeland Security by Clifford L. Karchmer

The content of each volume stems from a forum of agency representatives and experts from national, State, and local agencies responsible for dealing with terrorism. This paper emphasizes the importance of the intelligence function and offers recommendations for the establishment of a successful intelligence function for local law enforcement agencies designed to prevent terrorist attacks. Intelligence is defined as "an actionable inference or a set of related inferences derived from some form of inductive or deductive logic." By combining information, analysis, and interpretation, intelligence helps to document a threat, ascertain its probability of occurring, and define an effective response, all in a timely manner. This paper emphasizes the importance of obtaining intelligence on crimes that can be related to the planning of terrorist attacks, such as fraudulent identifications, trafficking in illegal merchandise, and drug sales as means for funding and executing terrorist attacks. This paper presents a model of Federal, State, and local information sharing and outlines standards for data quality and usability. A section on "intelligence-led policing" describes the Global Justice Information Sharing Initiative, presents a case study from the United Kingdom on intelligence-led policing, and promotes the need for trained and accredited analysts of criminal intelligence. A discussion of the development of a successful intelligence function includes a presentation of the model of the Terrorism Early Warning Group, an interagency effort begun in Los Angeles in 1996. The paper concludes with a summary of recommendations for building an effective and efficient multilateral system of intelligence production and sharing. 15 references and appended guide to incorporating the intelligence function into community policing and a list of intelligence training and counterterrorism funding resources

Money laundering describes two distinct types of process. In its most limited sense, laundering d... more Money laundering describes two distinct types of process. In its most limited sense, laundering describes the conversion of cash by exchanging a volume of illegally earned currency for some type of negotiable instrument or other asset that can be used in legitimate commerce without revealing the illegal source of the funds used to purchase it. In its second and more widely accepted usage, money laundering involves a sequence of steps that begins where the currency conversion process leaves off. In this process, laundering is a method for acquiring an asset, so that the owner may both account for and enjoy wealth while remaining protected from probes into the origins of the wealth. Improved currency reporting by banks could help to counter laundering. Particular problems that should be addressed in this area are the lack of emphasis on validating the identity of the party making the currency exchange and the bank's having discretion as to when to exempt customers who exchange currency frequently from filing the required reports. Innovative law enforcement techniques to counter laundering include Federal investigators posing as drug traffickers and trying to enlist bank personnel, financial advisers, and others in violations of Treasury reporting requirements. Regarding law enforcement efforts, there is a need for all Federal agents who investigate narcotics, organized crime, tax, and currency violations to develop skills in investigating laundering. It should be recognized, however, that laundering results from the law enforcement focus on organized crime activities and is to be preferred to the reinvestment of criminal monies in additional criminal enterprises. Laundering is thus a form of negotiated order and implicit regulation. Five notes are listed.

Conventional wisdom in homicide investigations holds
that speed is of the essence. The notion is that any case
that is not solved or that lacks significant leads and witness
participation within the first 72 hours has little likelihood of
being solved, regardless of the expertise and resources deployed.
Over time, unsolved cases become “cold.” Cases most likely to
be classified as cold include gang- and drug-related deaths;
cases involving immigrants, transients, and homeless or
unidentified people; unclassified deaths; and unsolved police
shootings. Cold cases are among the most difficult and
frustrating cases detectives face. These cases are, in effect, cases
that other investigators, for whatever reason, could not solve.

At the time, we anticipated that local police would be helping to enforce quarantine and isolation orders. With limited resources and a need to avoid arresting large numbers of citizens, we settled on the alternative of a voluntary compliance program. Midway through the drafting of this guide, a preliminary government report indicated that federal officials preferred to avoid mandatory quarantine and isolation, instead opting for a variety of voluntary steps and an approach that relied on local institutions and citizen cooperation-a strategy known as "community mitigation."

Abstract: Part I, "Building Programs That Work," presents overall strategy and individual steps that the police chief or other local justice official can use to lead the implementation of those components that will work best in the local community. Part II, "The Eight Foundation Elements of a Successful DUI (Driving Under the Influence) Strategy," presents the building blocks of the comprehensive Juvenile DUI Enforcement Program. Each block or element combines with others to create a multidisciplinary program that unites the local justice system with social services and the private sector. Included are short descriptions of innovative programs designed to prevent juveniles from driving under the influence of alcohol or other drugs. Part III, "Support Tools for Building Programs That Work," contains policies, procedures, press releases, and other information the executive can use to facilitate the process of implementing the eight foundation elements. Part IV, "Leadership Roles for Officials," presents three action-oriented papers that address police, prosecutors, and judges, each written by a current or former official from these disciplines. The papers describe why leadership by each of these three professionals is essential to the implementation of the eight foundation elements in the community. The papers also describe approaches that have worked well for the authors and their colleagues.

Traffic enforcement has long been a mainstay of the police profession. The Oklahoma City bombing was solved as a direct result of a routine traffic stop. However, recently financial resources are being directed away from traffic enforcement. In fall 1995, the Police Executive Research Forum of Washington, D.C., organized for the National Highway Traffic Safety Administration (NHTSA) a national seminar to discuss the factors that would affect the delivery of police traffic services in the 21st century. This report details the proceedings of the seminar. It is meant to help agency administrators, public safety advocates, and others with an interest in traffic enforcement develop strategies to maintain and improve traffic services as we move into the 21st century.

Many laws have been enacted and regulations adopted over the last 15 years to combat juvenile DUI. One of the most significant measures was the National Minimum Drinking Age Act of 1984, which obligates the Secretary of Transportation to withhold a portion of Federal highway trust funds from States with laws that allow the purchase or public possession of alcohol by those under age 21. Inconsistencies in key laws and lack of enforcement of the laws, however, account for the recent increases in alcohol-related accidents that have involved juveniles. Twenty-three States do not prohibit minors from attempting to purchase alcohol, and 21 States do not have laws that specifically prohibit alcohol consumption by minors. Nineteen States have no laws against minors presenting false identification. Perhaps the core of the problem is the lax enforcement of the laws already in place. Although the fatality rates for underage drivers are among the highest for all age groups, the DUI arrest rates for the 16- to 20-year-old age group are the lowest of all drivers arrested. Lowering the blood alcohol content (BAC) for minors is an obvious solution. As of September 1994, 29 States and the District of Columbia had lowered their legal BACs for drivers under 18 or 21 years old to levels of zero to .02 percent. Laws calling for a lower BAC for minors can be augmented by another effective sanction, administrative license revocation (ALR), which allows a police officer to confiscate the license of a driver who has an illegal BAC or refuses to take a blood alcohol test. ALR can also be used in tandem with a provisional licensing program for minors. Nighttime driving curfews are another effective measure for controlling youth DUI and the number of traffic accidents for those under 18 years old. To achieve long-lasting, significant results, a variety or, ideally, all of the measures mentioned in this report should become integral parts of a juvenile impaired driving program. 1 table and 98 footnotes

The introductory chapter defines fraud as "when a person or business intentionally deceives another with promises of goods, services, or financial benefits that do not exist, were never intended to be provided, or were misrepresented." It also outlines some common types of fraud and notes when a fraud crime comes under Federal jurisdiction. A section of the handbook discusses the emotional impact of fraud victimization, including a sense of self-blame; anger at the offender; embarrassment among family, friends, and colleagues; and anger at various public agencies for not providing protection from fraud. The stress of participation in the criminal justice system is also noted. An overview of Federal services available to fraud victims encompasses referrals to medical, financial, or social services; security information and referrals; assistance with employers and creditors; and various assistance related to criminal justice case processing. Other topics discussed are the nature of the Federal criminal justice system, the rights of a Federal crime victim, the addressing of credit problems due to the victimization, and protecting oneself against fraud. The report concludes with suggestions for documenting financial losses.
