Tamara Ćapeta-redovni profesor europskog javnog prava, Pravni fakultet Sveučilišta u Zagrebu; dr. sc. Jasenko Marin-izvanredni profesor pomorskog i općeprometnog prava, Pravni fakultet Sveučilišta u Zagrebu; dr. sc. Božena Bulum-znanstveni suradnik Jadranskog zavoda Hrvatske akademije znanosti i umjetnosti; dr. sc. Ana Kumpan-docent Pravnog fakulteta Univerziteta Union, Beograd; mr. sc. Nikola Popović-član Vijeća Hrvatske agencije za poštu i elektroničke komunikacije, vanjski član Upravnog vijeća Agencije za regulaciju tržišta željezničkih usluga; Iva Savić-znanstveni novak, Pravni fakultet Sveučilišta u Zagrebu). Riječ je o prvoj hrvatskoj publikaciji koja na sveobuhvatan, jasan i sustavan način daje prikaz razvoja opsežne pravne stečevine Europske unije (acquis communautaire) u području prometa, od početaka europskih integracija do danas. Relevantna pravna stečevina Europske unije prikazana je i obrađena zaključno sa stanjem u ljeto 2010. godine. U ovom djelu sadržan je sažet prikaz preko 300 propisa prometnog prava Europske unije, više od 100 sudskih presuda Europskog suda i nacionalnih sudova, te 70-ak strateških dokumenata Europske unije. Zanimljivo je napomenuti da je, prema našim saznanjima i dosadašnjim istraživanjima, kao takva ova knjiga jedinstvena čak i u međunarodnim razmjerima. Naime, i strana je literatura vrlo oskudna po pitanju sustavnog i sveobuhvatnog obrađivanja europskog prometnog prava te bismo ovu knjigu eventualno mogli usporediti tek s dvije do tri publikacije u dostupnoj nam svjetskoj literaturi. Djelo je rezultat višegodišnjeg rada i znanstvenog istraživanja sedmero autora u području prometnog prava i politika Europske unije, ali i tržišnog natjecanja, zaštite okoliša i prava putnika u pojedinim prometnim granama. Konkretno, knjiga je objavljena kao jedan od ključnih rezultata znanstvenog projekta Pravnog fakulteta Sveučilišta u Zagrebu pod naslovom "Hrvatsko transportno pravo i izazovi jedinstvenog tržišta Europske unije", fi nanciranog od Ministarstva znanosti, obrazovanja i športa RH od 2007. do 2011. Europska je unija u posljednjih nekoliko godina u cilju jačanja prometnog sustava, kojemu se pridaje prioritetno značenje u stvaranju jedinstvenog europskog tržišta, pokrenula inicijativu za stvaranje tzv. The Croatian Maritime Code contains legal definitions of the terms ship ; yacht ; and boat. The m... more The Croatian Maritime Code contains legal definitions of the terms ship ; yacht ; and boat. The main distinctions amongst the said terms are drawn in relation to the use and technical features of the respective types of vessels or craft. Whether a craft is legally a ship, a yacht or a boat will affect the application of the provisions of the Maritime Code and the court competence ratione materiae. In Croatia, commercial courts are competent to hear the cases governed by maritime law ; all cases arising in relation to ships and yachts ; as well as those arising in relation to navigation. The prevailing case law in Croatia is that marina operators' berthing contracts for yachts fall under the competence of commercial courts. However, the question in practice arises when a berthing contract is for a boat, since cases relating to boats generally fall under the competence of general civil courts, unless maritime law applies or the case is related to navigation. An “Inchmaree Clause” is a special contractual clause contained in the standard hull and machiner... more An “Inchmaree Clause” is a special contractual clause contained in the standard hull and machinery
insurance clauses of the London insurance market. It includes risks that are not directly related to
the perils of the sea. Thus, for example, damages or losses occurring because of a broken shaft,
bursting of boilers, a latent defect in the hull, equipment, or machinery, as well as those resulting
from a navigation error, negligence of the master, officer, crew, or pilot etc., are included under the
insurance coverage by virtue of such a clause. This type of standard marine insurance clause was
named after a ship called “Inchmaree” involved in an English court case – Thames & Mersey Marine
Insurance Co Ltd v Hamilton, Fraser & Co. (“The Inchmaree”) of 1887, in which the court ruled that
damage to a ship's pump due to the accidental jamming of a vent was not due to any of the marine
risks or other eiusdem generis risks covered by the standard hull and machinery insurance policy and
was therefore not indemnifiable thereunder. Thus, it became obvious that there are numerous risks
that the insured ships are exposed to during navigation, which are not covered by a standard hull
and machinery insurance policy. The London insurance market reacted to such a development of law
and incorporated a new, so-called “Inchmaree Clause” into the standard Institute hull insurance
clauses. The content of the clause has changed over time with the introduction of new risks under
insurance coverage. The aim of this paper is to analyse the background and purpose of the
“Inchmaree” clauses contained in the broadly used standard insurance clauses and to study their
salient features. Given that the clause was originally created in the English legal framework, the study
entails an analysis of the relevant English case law, statutory law, and legal doctrine. The paper also
discusses the legal issues related to the possible application of those or similar clauses in the context
of marine insurance contracts governed by Croatian law. A short comparison is made to the
corresponding solutions found in the Nordic Marine Insurance Plan.

Seaworthiness is generally extremely important for any marine insurance contract. In particular, ... more Seaworthiness is generally extremely important for any marine insurance contract. In particular, hull and machinery insurance, as well as shipowner liability insurance, are generally provided on the assumption that the ship is seaworthy unless the insurer knowingly and voluntarily accepts to insure under special conditions a ship that does not meet all seaworthiness requirements. This basic principle is present in various forms in national laws that regulate marine insurance contracts. Unseaworthiness leads to certain adverse legal consequences under marine insurance contracts. From the insurer’s standpoint, the aim of the legal concept of seaworthiness is to control the quality and alteration of the insured risk and eliminate substandard ships from the insurance portfolio and from the shipping trade in general. The objective of this paper is to clarify the meaning of the legal concept of seaworthiness in general terms, particularly in the context of marine insurance, and to discuss various elements of seaworthiness. In doing so, the author explores the traditional seaworthiness doctrine faced with the challenges of technological developments and automatization in maritime transport. The idea is to present primary findings of research in progress that shall constitute a basis for a deep and thorough study entailing a comparative law analysis of the legal consequences of unseaworthiness under various national legal systems of civil law and common law tradition.

Analiza se ponajprije odnosi na pitanja koja se javljaju u praktičnoj primjeni pravila o slobodi pružanja usluga osiguranja predviđenih propisima Europske unije koja se u hrvatski pravni sustav prenose Zakonom o osiguranju. Cilj je rada ukazati na izazove koje za industriju osiguranja u Republici Hrvatskoj donosi liberalizacija tržišta osiguranja zajamčena pravnom stečevinom Europske unije te pružiti određene preporuke koje bi hrvatskim osigurateljima i ostalim pružateljima usluga osiguranja mogle biti korisne kod donošenja poslovne odluke o mogućem prekograničnom obavljanju poslova osiguranja.

Nakon, detaljne analize i tumačenja relevantnih pojmova, komparativnom metodom proučavaju se i uspoređuju instituti vađenja potonulih stvari, uklanjanja podrtina, spašavanja i nalaza stvari u moru. Posebno se izdvajaju i detaljno analiziraju elementi kongruentnosti, sličnosti i razlika ovih instituta s posebnim naglaskom na one elemente koji su ključni za odjelitost svakog od njih. The Croatian Maritime Code contains legal definitions of the terms ship ; yacht ; and boat. The m... more The Croatian Maritime Code contains legal definitions of the terms ship ; yacht ; and boat. The main distinctions amongst the said terms are drawn in relation to the use and technical features of the respective types of vessels or craft. Whether a craft is legally a ship, a yacht or a boat will affect the application of the provisions of the Maritime Code and the court competence ratione materiae. In Croatia, commercial courts are competent to hear the cases governed by maritime law ; all cases arising in relation to ships and yachts ; as well as those arising in relation to navigation. The prevailing case law in Croatia is that marina operators' berthing contracts for yachts fall under the competence of commercial courts. However, the question in practice arises when a berthing contract is for a boat, since cases relating to boats generally fall under the competence of general civil courts, unless maritime law applies or the case is related to navigation. removal, as the two complementary
institutes of maritime law, which in
practice it is sometimes difficult to
differentiate. The marine insurers
are almost always directly involved
in the decision making process
regarding the contracting, undertaking
and the execution of the operations
of salvage and wreck removal,
as they are the ultimate holders of
the financial risk of such operations.

An “Inchmaree Clause” is a special contractual clause contained in the standard hull and machiner... more An “Inchmaree Clause” is a special contractual clause contained in the standard hull and machinery
insurance clauses of the London insurance market. It includes risks that are not directly related to
the perils of the sea. Thus, for example, damages or losses occurring because of a broken shaft,
bursting of boilers, a latent defect in the hull, equipment, or machinery, as well as those resulting
from a navigation error, negligence of the master, officer, crew, or pilot etc., are included under the
insurance coverage by virtue of such a clause. This type of standard marine insurance clause was
named after a ship called “Inchmaree” involved in an English court case – Thames & Mersey Marine
Insurance Co Ltd v Hamilton, Fraser & Co. (“The Inchmaree”) of 1887, in which the court ruled that
damage to a ship's pump due to the accidental jamming of a vent was not due to any of the marine
risks or other eiusdem generis risks covered by the standard hull and machinery insurance policy and
was therefore not indemnifiable thereunder. Thus, it became obvious that there are numerous risks
that the insured ships are exposed to during navigation, which are not covered by a standard hull
and machinery insurance policy. The London insurance market reacted to such a development of law
and incorporated a new, so-called “Inchmaree Clause” into the standard Institute hull insurance
clauses. The content of the clause has changed over time with the introduction of new risks under
insurance coverage. The aim of this paper is to analyse the background and purpose of the
“Inchmaree” clauses contained in the broadly used standard insurance clauses and to study their
salient features. Given that the clause was originally created in the English legal framework, the study
entails an analysis of the relevant English case law, statutory law, and legal doctrine. The paper also
discusses the legal issues related to the possible application of those or similar clauses in the context
of marine insurance contracts governed by Croatian law. A short comparison is made to the
corresponding solutions found in the Nordic Marine Insurance Plan.

Seaworthiness is generally extremely important for any marine insurance contract. In particular, ... more Seaworthiness is generally extremely important for any marine insurance contract. In particular, hull and machinery insurance, as well as shipowner liability insurance, are generally provided on the assumption that the ship is seaworthy unless the insurer knowingly and voluntarily accepts to insure under special conditions a ship that does not meet all seaworthiness requirements. This basic principle is present in various forms in national laws that regulate marine insurance contracts. Unseaworthiness leads to certain adverse legal consequences under marine insurance contracts. From the insurer’s standpoint, the aim of the legal concept of seaworthiness is to control the quality and alteration of the insured risk and eliminate substandard ships from the insurance portfolio and from the shipping trade in general. The objective of this paper is to clarify the meaning of the legal concept of seaworthiness in general terms, particularly in the context of marine insurance, and to discuss various elements of seaworthiness. In doing so, the author explores the traditional seaworthiness doctrine faced with the challenges of technological developments and automatization in maritime transport. The idea is to present primary findings of research in progress that shall constitute a basis for a deep and thorough study entailing a comparative law analysis of the legal consequences of unseaworthiness under various national legal systems of civil law and common law tradition.

Analiza se ponajprije odnosi na pitanja koja se javljaju u praktičnoj primjeni pravila o slobodi pružanja usluga osiguranja predviđenih propisima Europske unije koja se u hrvatski pravni sustav prenose Zakonom o osiguranju. Cilj je rada ukazati na izazove koje za industriju osiguranja u Republici Hrvatskoj donosi liberalizacija tržišta osiguranja zajamčena pravnom stečevinom Europske unije te pružiti određene preporuke koje bi hrvatskim osigurateljima i ostalim pružateljima usluga osiguranja mogle biti korisne kod donošenja poslovne odluke o mogućem prekograničnom obavljanju poslova osiguranja.

The author analyses various legal aspects of the meaning of safe port and safe berth and the contractual liability of the charterer for the nomination of safe port and safe berth under English and American law of charterparties. The author discusses relevant English and American case law in comparative perspective, pointing at the recent tendency of departure of American case law from the practice of English courts towards the application of the standard of due diligence, required from the charterer as opposed to the traditionally accepted concept of safe port warranty and strict liability of the charterer. Nakon, detaljne analize i tumačenja relevantnih pojmova, komparativnom metodom proučavaju se i uspoređuju instituti vađenja potonulih stvari, uklanjanja podrtina, spašavanja i nalaza stvari u moru. Posebno se izdvajaju i detaljno analiziraju elementi kongruentnosti, sličnosti i razlika ovih instituta s posebnim naglaskom na one elemente koji su ključni za odjelitost svakog od njih. Razrađuju se i problemi prisutni u pravnom uređenju uklanjanja podrtina u domaćem pozitivnom pravu.
