Criterion of Legitimacy of the Political Authority, 2024

The paper proposes a solution to the problem of the legitimacy of the political authority and pro... more The paper proposes a solution to the problem of the legitimacy of the political authority and provides an adequate response towards the arguments of the political and philosophical anarchism. I argue that by defining an adequate criterion for legitimacy, the state can be legitimate, therefore, any objections by anarchists become invalid. The research states that political anarchism is not a problem to the state, and philosophical anarchism is given a compromised solution to its objection. The proposed criterion of legitimacy obliges all people to take part in the political authority and treats all citizens with equality and justice. It is based on the protection of human rights and the notion of democracy according to which all people are free to adopt any belief system they prefer and, at the same time, it includes all different systems in the sphere of political authority. This solution, if successful, would be particularly attractive, as it provides a criterion which helps to define whether a particular authority is less or more distant to the legitimacy the criterion entails

The proposed definition of legitimacy encourages all people to take part in the political authority and treats all citizens with equality and justice. It is based on the protection of human rights and on the notion of mutual respect of any different view about every aspect of social life in the political community. The solution would be particularly attractive, as it provides a definition of legitimacy which helps to guide a particular authority towards its goal to be legitimate.

Η νομιμοποίηση, οποιασδήποτε μορφής εξουσίας, αποτελεί τη βασική προϋπόθεση, για την άσκηση της ε... more Η νομιμοποίηση, οποιασδήποτε μορφής εξουσίας, αποτελεί τη βασική προϋπόθεση, για την άσκηση της εξουσίας και τη δικαιολόγηση της απαίτησης για υπακοή και συμμόρφωση, προς τις επιταγές και τις αρχές της. Η πολιτική εξουσία, σύμφωνα με το σημαντικότερο γερμανό κοινωνιολόγο, Μαξ Βέμπερ, είναι δυνατό να ταξινομηθεί σε τρία διαφορετικά συστήματα, από τα οποία διαφορετική μορφή νομιμοποίησης, δικαιολογεί την ύπαρξή τους. Η παραδοσιακή εξουσία, στηρίζει τη νομιμοποίησή της σε παραδόσεις και έθιμα, τα οποία θεωρούνται αδιαμφισβήτητα. Η χαρισματική εξουσία, βασίζεται στη δύναμη της προσωπικότητας ενός ατόμου, στο χάρισμά του και η ορθολογική ή νόμιμη εξουσία, πηγάζει από έναν σαφές σύστημα απρόσωπων νομικών κανόνων. Η άσκηση της πολιτικής εξουσίας, στα σύγχρονα φιλελεύθερα κράτη δικαίου, στηρίζεται στο τρίτο σύστημα εξουσίας και υπέρτατος νόμος του κράτους, από το οποίο πηγάζει η εξουσία του πρωθυπουργού ή του προέδρου, θεωρείται το Σύνταγμα. Η νομιμοποίηση της πολιτικής εξουσίας, μέσω της εφαρμογής ενός συστήματος απρόσωπων νομικών κανόνων, δίνει το δικαίωμα στις κυβερνήσεις, να απαιτούν την υπακοή των πολιτών και τη συμμόρφωση τους. Η εξουσία του επικεφαλής της κρατικής εξουσίας, ενισχύεται από την εφαρμογή των νομικών κανόνων και ταυτόχρονα περιορίζεται, από τυχόν αυθαιρεσίες, εις βάρος του πολιτικού σώματος. The social contract answers the question of the origin of the society. The history of the theory originates in the ancient Greece political philosophy and extends to the recent years. However, the foundation of the theory resulted in the Renaissance period through the treatises of classical contractarians Hobbes, Locke and Rousseau. The manuscript describes the main arguments regarding the theory of social contract and suggests the main similarities and differences among them. Finally, the manuscript, according to the main description of the theories, suggests the main categorization of their results in legitimizing the political authority. In the final section, the article proposes the contribution of the theory of the social contract to the modern era and summarizes the positive aspects of its arguments to the legitimization of the political authority of mod...

The legitimization of the political authority is a virtue of political decisions and a prerequisi... more The legitimization of the political authority is a virtue of political decisions and a prerequisite for the justification of the demand from citizens for obedience and compliance. Legitimacy is a complex subject to examine as it is associated with many controversial issues of the contemporary political philosophy. Some of these issues involve questions such as, what is the context of the notion of legitimacy and how can it be distinguished from other notions of the political authority such as political obligation, political power, legalization and justification of the political power, justification of the state and others. One of the most central issues is the position of philosophical and political anarchism that is against political authority.
