The principle of ’An-Taradhin minkum, as one of the principles in muamalah contracts, should be u... more The principle of ’An-Taradhin minkum, as one of the principles in muamalah contracts, should be upheld in every purchase and sale transaction. This study discusses the concept of An-Taradhin minkum from the perspective of the Qur’an and Hadith. This was a literature study which referred to the Quran and Hadith, journals, as well as any relevant literatures. This study aimed at determining the concept of ’An-Taradhin minkum from the perspective of the Qur’an and Hadith. By using a descriptive qualitative method, the results showed that the concept of ’An-Taradhin minkum in the perspective of the Qur’an puts an emphasis that it is a basic principle according to Allah commands that should be upheld in every purchase and sale transaction. This principle can be in the form of words (Ijab Qobul / contract) or actions that show mutual consent. This Article discusses tolerance and freedom of religion and social life between minorities and t... more This Article discusses tolerance and freedom of religion and social life between minorities and the majority of religious communities in Bali Indonesia and Djerba Tunisia. In Bali, Muslims are the minority population, while Hindus are the majority. Djerba Tunisia opposite of Bali, Muslims are the majority population while Jews are the minority. Something interesting from these two places is freedom of religion, tolerance, and a social life that going well. The existence of tolerance and freedom of religion indicates that the people in these two places uphold the values of human rights, freedom of belief and tend to keep the local culture that has existed so far. This is field research with a qualitative-descriptive method. The population of this study is the public, religious leaders, and the government of the Province of Bali and the people of the Province of Djerba. Semi-structured interviews and documentation do data collection. The results show; First, Indonesia and Tunisia have similarities in moderate religious ideology, the political history of post-tyrannical freedom, and the war against radicalism. Second, the existence of areas inhabited by minorities is tolerant, free and in harmony with the majority. Third, freedom, religious tolerance and social life in Bali and Djerba are based on a spirit of respect for all religions.

This study intends to describe polygamous laws in Muslim countries such as Tunisia, Saudi Arabia,... more This study intends to describe polygamous laws in Muslim countries such as Tunisia, Saudi Arabia, and Indonesia. In general, the provisions (legislation) relating to family law in modern Muslim countries are linked to polygamous rules, something that can be classified into three. Firstly, countries that completely prohibit the practice of polygamy such as Turkey and Tunisia. Secondly, countries that allow polygamy with relatively strict (complicated) conditions such as Pakistan, Egypt, Morocco, Indonesia and Malaysia. Thirdly, countries that more loosely handle polygamy, such as Saudi Arabia, Iran and Qatar. This research, used samples from three countries representing three approaches to law in response to polygamy: Tunisi, Indonesia, and Saudi Arabia. The results of this study were as follows; first, the Tunisian Family Law prohibits polygamy, the Indonesian Family Law allows polygamy under strict conditions, and the Saudi Family Law allows polygamy without strict restrictions. Secondly, majority of the citizens follow the laws applying in their country on polygamy. As a result, Tunisians are not polygamous and very few Indonesians practice it in while in Saudi Arabia, it is a common practice.

Minangkabau, one of the major tribes in Indonesia that embraces Islam, has unique and distinctive customs, one of which is the distribution of inheritance in its matrilineal family system. Islam adheres to a bilateral-parental system. The researchers conducted an in-depth study on the harmonious relationship between Minangkabau custom and Islam, with a focus on the distribution of inheritance. The study uses the normative approach with a qualitative analysis. The findings indicate that in the beginning, Minangkabau customs and Islamic teachings had a striking paradoxical relationship. However, a harmonious path was found in which the distribution of inheritance in the matrilineal family system could be preserved without violating Islamic inheritance law. Siri marriage is a method of marriage that is done religiously, has a guardian, and meets the pillars and conditions of marriage, but does not register the marriage at the Office of Religious Affairs (KUA). It makes the ministry of home affairs Zudan Arif Fakrullah statement on October 07, 2021, that if a married couple carries out the practice of marriage, sirri can get a family card (KK). The issue of legal marriage or not is often a polemic that results in unclear marital status, resulting in a negative impact for the parties involved, both wives, husbands, and children.
