The COVID-19 pandemic has illuminated the widespread lack of access to adequate water and sanitat... more The COVID-19 pandemic has illuminated the widespread lack of access to adequate water and sanitation in South African informal settlements and rural areas. While the full complexities of the relationship between inequality, COVID-19 and water in South Africa are still unfolding, the importance of access to water emerged early on in the pandemic, and catalysed an emergency response from the Department of Water and Sanitation (DWS). This article analyses the impact of the DWS' COVID-19 response in three ways. Firstly, the available data on the provision of tanks and tankers is examined to highlight the importance of a reliable monitoring system. Secondly, the dangers of prioritising short-term action at the expense of long-term sustainability are discussed with reference to the twin challenges of further reduced municipal revenue and redirected funds. Communities in South Africa employ a diverse range of strategies to actively claim their right to... more Communities in South Africa employ a diverse range of strategies to actively claim their right to water. This paper examines two rights claiming strategies – protest and litigation – through the lens of two case studies. The first case study examines the struggles of the residents of Makhanda, a small town in the predominantly rural Eastern Cape Province, who formed a coalition to advocate for the dissolution of the municipal council for failing to fulfil its constitutional mandate to provide basic services. The second case examines the struggles of the residents of Marikana, an informal settlement in the City of Cape Town, where residents are forced to live in unlit, unhygienic and undignified conditions as a result of inadequate services provision. Although access to water is a justiciable right in South Africa, there is a curious paucity of legal rights mobilisation, with only one court case reaching the Constitutional Court. Findings and key recommendations This report sets the scene by summarising relevant legislation, ... more Findings and key recommendations This report sets the scene by summarising relevant legislation, and making strong linkages between the water services aspects of this work and HIV/AIDS. Indeed, the report makes several strong recommendations about strengthening these linkages operationally. An important recent development for the project is the planned roll-out of The National Health and Hygiene Education Strategy Related to Water and Sanitation (NSTT, 2004). The study articulates very well with that, so the opportunity of feeding into the roll-out of the Strategy has been taken, and welcomed by the Departments of Health and of Water Affairs and Forestry. Certain terminology used in the National Strategy has been adopted in this report in order to tighten the linkages and articulation. The work done for this study gives us the confidence to support the National Strategy, but with several relatively minor amendments. These in no way undermine the value and status of the Strategy and a recommendation is made that the Strategy should be adopted. An important principle that the study established is the value of keeping our institutional and financial arrangements simple, or rather to avoid complexity wherever possible. The principle that is followed is, therefore, to use existing resources and relationships, and to enhance and strengthen existing arrangements rather than to create new ones.

In terms of the Constitution of the Republic of South Africa, (Act 108 of 1996) and the Water Ser... more In terms of the Constitution of the Republic of South Africa, (Act 108 of 1996) and the Water Services Act, (Act 108 of 1997), municipalities have the executive authority over the provision of water services (defined as water supply and sanitation services) within their areas of jurisdiction. The Water Services Act sets out the institutional framework which outlines the roles and responsibilities of local government as a Water Services Authority. One of these responsibilities is to ensure effective and efficient Water Services Provider (WSP) institutional arrangements.

The objectives of collecting and disaggregating cost data over the full life-cycle of WASH services are to be able to analyse costs per infrastructure and by service level, and to better understand the cost drivers and through this understanding to enable more cost effective and equitable service delivery. WASHCost is focused on exploring and sharing an understanding of the true costs of sustainable services (see www.washcost.info).
