This study attempts to analyze the consistency between the Romanian administrative law and the EU... more This study attempts to analyze the consistency between the Romanian administrative law and the EU law concerning the plea of illegality as regulated by the Law no. 554/2004 on the administrative contentious procedure. The authors concluded that this law is fully harmonized with the Treaty on the Functioning of the European Union and, therefore, the parties involved in the litigation proceedings may invoke as means of defense both the plea of illegality, regarding the individual administrative acts, and the plea of unenforceability, concerning the regulatory administrative acts.

The player who first creates a monochromatic subgraph isomorphic to a forbidden graph F loses. A symmetric strategy of the second player ensures that, independently of the first player's strategy, the blue and the red subgraph are isomorphic after every round of the game. We address the class of those graphs G that admit a symmetric strategy for all F and discuss relevant graph-theoretic and complexity issues. We also show examples when, though a symmetric strategy on G generally does not exist, it is still available for a particular F .
The author examines the principle of legality in the activity of public administration and the wa... more The author examines the principle of legality in the activity of public administration and the way in which the compliance with or the violation of this principle affects the efficiency of the activities of public authorities, the safety of legal relations of administrative law, as well as the trust of the citizens in their capacity of recipients of the administrative acts. In reference to providing the legality of the administrative acts, the author shows that the public authorities, in the process of elaborating administrative acts, must observe not only the internal law dispositions with higher legal force, but also the main or derived communitarian acts, as well as the general law principles, some of them codified in internal and European legal acts, and others imposed by the established practice of the Luxembourg Court and the Strasbourg Court.
