The most hated of permissible things to Allāh the Exalted is divorce." This Prophetic tradition i... more The most hated of permissible things to Allāh the Exalted is divorce." This Prophetic tradition is narrated by Abū Dāwūd and Ibn Mājah. Yet divorce is now on the rise in Aceh where Islamic Sharī'ah is supposedly being implemented; there were 6,823 divorce cases in the province during the first ten months of 2022, with most proposed by young couples. This study examines divorce in mature families aged fifty and above, who have been married for many years in the perspective of Islamic law. We analyze their marriage and the nature of their life leading to divorce, the reasons for falling out of love, and the impact of separation on their well-being and on their loved ones. We review the Islamic sources and academic literature about marriage and divorce, the government, and media reports for statistics, and we interview three couples along with several of their children in order to obtain insights into their experience. We uncover the complexity surrounding marriage and divorce, as well as religious, social, and personal reasons guiding their action or non-action. The study recommends that governments and religious institutions implement premarital courses as a condition of marriage so that divorce rates can be reduced. Such policies must be accompanied by meaningful and well-funded national government programs to save the institution of marriage and be able to maintain family cohesion in Indonesia.

This study surveys the role of women in the development of shari`ah from the introduction of Isla... more This study surveys the role of women in the development of shari`ah from the introduction of Islam to Aceh in the 12th centurydown to the modern erawith the formal adoption of Islamic law by an Indonesian parliamentary Bill on Aceh’s Special Status in 1999. After briefly exploring this history, we examine contemporary debates on the current implementation of Islamic law by means of five women of differing backgrounds in this Indonesian province. We review historical documents and existing literature as well as qanuns of Aceh (local regulations) which stipulate shari`ah requirements. We also interview the five women, including one whose husband and another who herself were subjected to shari`ah punishment. The results are complex reflecting the intricacy of contemporary understandings of the shari`ah and the issues surrounding rights of women in Islamic law. The Promise of Reconciliation?
The Peace Agreement signed on August 15, 2005 between the Free Aceh Movement (GAM) and the Govern... more The Peace Agreement signed on August 15, 2005 between the Free Aceh Movement (GAM) and the Government of Indonesia (GoI), ending nearly 30 years of bloody conflict, was an achievement in the history of conflict resolution. Most studies have focused on the role of acting parties and foreign mediators leading up to the “ribbon cutting” or “signature placing” to symbolize the agreement. This study examines the role of the Ulama (Muslim religious scholars) in their continuing efforts at reconciliation even in the most difficult moment at the peak of the conflict. We provide the context of the Acehnese conflict and review the critical role of the Ulama in seeking a peaceful solution. We narrate the course of the up-and-down peace efforts in Aceh through the eyes of the Ulama, representing one of the most influential groups in Acehnese society yet themselves reflecting different interests and persuasions. Their efforts represent an elaboration of deeply embodied Islamic principles of peace and reconciliation manifested in their daily work and professional routines

Di satu sisi ia mengindikasikan betapa keadilan itu mahal dan sulit, dan di sisi lain ungkapan itu menyiratkan pentingnya prinsip keadilan dari setiap hukum dan regulasi, yaitu prinsip yang memperlakukan setiap orang sama dan fair (berkeadilan). We explore the concept of peace from a broader sense than merely the absence of war, through the ... more We explore the concept of peace from a broader sense than merely the absence of war, through the eyes of Acehnese women who continue to strive for better political representation and social justice utilizing Islam as their foundational point. The study analyses Islamic principles of peace, cultural beliefs and practices, as well as the political environment, which engulfed Aceh. Historical accounts and academic research form a theoretical base for our analysis, while interviews with influential women, Ulama leaders, political figures as well as community activists provide integral content for our survey. This inquiry concludes that in spite of widespread political conservatism being promoted by the GAM political party of Partai Aceh and parochial religious fanaticism being advocated by certain transnational groupings, women themselves provide hope for gender equality and empowerment. This chapter explores Muslim women in positions of leadership and authority in Acehnese dayah (a ... more This chapter explores Muslim women in positions of leadership and authority in Acehnese dayah (a traditional Islamic boarding school for the study of the Qur'an, Hadith and other classical Islamic texts, also known as pesantren). It is a biographic-ethnographic analysis that examines the lives and experiences of two contemporary female dayah founders and their rise to leadership as they studied in male-led dayah. In doing so, the chapter reveals the dynamic relations between female and male leaders and the important role of leaders' wives and daughters in dayah. The chapter includes an overview of the development of the dayah institution from its historical inception to its con- temporary significance in providing religious education for the masses, an examination of the role of women under male-dayah leadership based on the narratives of the two female leaders, and current activities of these women as teachers and leaders in their respective dayah and communities to reveal ...

Yet, the active role of Acehnese women reflects entrenched Acehnese cultural norms, as well as deeply embedded teachings of equality in Islam. Culturally Acehnese women have always been very assertive. Describing their involvement in the wars against the Dutch occupation, H. C. Zentgraaff commented in his work on Aceh: 'Acehnese women are extremely courageous { ... ]. When they have to fight, this task is carried out with full energy, fearless of death, and {they} are often superior to men." The Dutch Orientalist and colonial official Snouck Hourgronje in his classic study De Atjehers (The Acehnese) included an interesting image of women and men vendors in the marketplace - a condition that continues to this day. The eleventh Rector (2005-2009) of the State Institute of Islamic Studies (IAIN Ar-Raniry) was a student of traditional madrasah, beginning in his village of Bugak Krung Matee in Peusangan, North Aceh, reaching the university level when he completed his doctorandus (a pre-master’s degree academic title adopted from the Dutch system) at Ar-Raniry’s Faculty of Syari‘ah in the field of Peradilan Islam or Qaḍā’ in 1979. Yet, he also became exposed to modernity and modern education as the debates between Indonesia’s Muslim nationalists and their secular counterparts dominated Indonesian thinking during the 1940s through the 60s. His love for literature also developed during this period.
