The present thesis aims to do a research about the history of Brazilian's civil procedure law, ob... more The present thesis aims to do a research about the history of Brazilian's civil procedure law, objecting the idea that there is an effective disruption between Portuguese law and national law; it aims to demonstrate, based on historical analysis and investigation of the legislative and doctrinal sources, that Brazilian law remained deeply affected by Portuguese influence even after the Independence, not only inheriting norms, but copying them and inserting them into the national legal order. The study seeks, at the beginning of the Brazilian Republic, the rupture between Brazilian and Portuguese Law, from the analysis of state's legislative competence for civil procedural matters, when national legislators were able to create a legal norm genuinely Brazilian, focusing on the 1911's Civil Procedure Code of the State of Maranhão, one of the outstandings legal diplomas regarding the subject back then.
