Environmental problem emerging in the postindustrial world have characteristics that distinguish ... more Environmental problem emerging in the postindustrial world have characteristics that distinguish them from problems perceived during the industrial era. These distinguishing characteristics have driven the environmental movement towards recognition of the importance of social science, social justice, and behavioral change in seeking lasting solution to these environmental problems. This article explores the core values of this new paradigm of sustainability in both is substantive and procedural aspects. The article is divided into six parts: Part I examines ways in which values and ethics affect the perception and definition of environmental problems and the approaches to environmental problem solving; Part II examines environmental problems and behavioral change though the lens of risk assessment, risk perception, and risk management; Part III explores the relationship between equity, social justice movements, and sustainability; Part IV examines procedural values inherent in the sustainability movement; Part V discusses the barriers to achieving sustainability and the role of law in overcoming those barriers; finally, Part VI describes the new ecological paradigm based upon the values of sustainability and equity.

Contemporary American artists have continually organized and lobbied for both increased compensat... more Contemporary American artists have continually organized and lobbied for both increased compensation for their works of art and for increased control over their aesthetic future use. This Article examines the problem of accommodating multiple proprietary interests I a single work without diminishing public access to the ideas contained in the tangible medium of expression. Section I examines the competing interests embodied in the copyright clause and the first amendment of the Constitution, paying attention to their impact on the visual arts. Section II examines possible methods for accommodating the values of the first amendment and the principles of copyright law within the contexts of the fair use doctrine and compulsory licensing. Section III will explore the joint and collective work doctrines. Finally, the Article discusses possibilities for expanding the proprietary entitlements of artists without infringing upon either public access to protected works or the copyright owner’s entitlements.

Morris Collin argues that artifacts that function as a repository of cultural and traditional information should generally remain within the cultural context of their origin. This article looks at legal issues, including the 1983 House of Lords decision concerning a Maori head, A-G of New Zealand v Ortiz. Finally, the article makes practical suggestions regarding alternative means to the present market forces mechanisms, for sharing and disseminating cultural property.
