The purpose of the study, as stated, was to identify and arrange educational needs of migrant chi... more The purpose of the study, as stated, was to identify and arrange educational needs of migrant children and make recommendations for programs with the objective of improving and equalizing educational opportunities for children of migrant families in the State of Washington. The assessment was based on lay people and educators incorporating the thoughts of people of all ages to generate the guidelines for the Center for the Study of Migrant and Indian Education staff in the development of future programs. In addition to the discussion related to the problems of the migrant child, recommendations are made for provision of compensatory programs, training programs for bilingual paraprofessionals, "alternative" educational programs, mobile facilities, performance contracting, and use of the educational voucher. A partial listing of migrant centers and service organizations in the United States is appended. (EL)

The purpose of this article was to describe the Nicaraguan Venture as an experiential learning op... more The purpose of this article was to describe the Nicaraguan Venture as an experiential learning opportunity for graduate and undergraduate nursing students at the University of Mobile. The recently dedicated Latin American Campus in San Marcos, Nicaragua, was the site chosen for this 10-day experience that provided learning opportunities in both hospital and community nursing for 13 students and 2 faculty. Experience was a powerful teacher for participants who learned to provide culturally competent care in this unique environment. Language was the most important limitation addressed. Flexibility in student opportunities, local community support, and student interpreters from the Latin American campus added to the success of the venture, which will be continued annually.

This research examines the operational and financial shortcomings of South African State-Owned Co... more This research examines the operational and financial shortcomings of South African State-Owned Companies (‘SOCs') which is shown to primarily stem from a lack of enforceable accountability. The resolution of this accountability issue begins with the identification of SOCs. An analysis is undertaken of the predominant statutes with which SOCs are required to comply: the Public Finance Management Act and the Companies Act. An examination of these statutes, together with relevant case law and secondary sources, reveals contradictory, convoluted and confusing provisions relating to the definition and categorization of various State-Owned Enterprises (‘SOEs') and SOCs. A complete overhaul of these statutory definitions and categorisations is required through the enactment of an overarching legislation to govern all aspects relating to all SOEs, under which SOCs will be subsumed, as was previously proposed by the Presidential Review Committee on State-Owned Entities in 2012. This study investigated tne effects of students' intelligence, locus of control, and creativity o... more This study investigated tne effects of students' intelligence, locus of control, and creativity on teachers' perceptions of students. Sixty-three fourth graders and two teacners from a local school participated. :he Verbal Scale of the WISC-R, the Circles Test from the Torrance Tests of Creative fhinking, and the Nowicki-Strickland I-E Locus of Control Scale ior Children were administered to the subjects. The teachers were requested to complete the Teacher Perception of Student Role Performance Scale (TPSRP) on each child. This instrument yielded scores on three factors of student role--Competence, Sociability, and Social Conformity. rultiple regressions were performed to determine the effects of the variables on teacher perceptions for the total sample, High Intelligence (HI), Low Intelligence (LI), and Average Intelligence (Al) groups. Intelligence was the single best predictor for the total sample. Intelligence and fluency contributed to the HI group's ratings on the three factors of the IPSRP whereas intelligence and elaboration were contributors for the LI group. In addition, the 'HI children were perceived as the least conforming (low SC scores) by their teachers and the LI children as the most conforming (higher SC scores) to the traditional, highly structured classroom environment.

Corporate heresy 1 or legislative oversight: is there room for the common law remedy of disgorgem... more Corporate heresy 1 or legislative oversight: is there room for the common law remedy of disgorgement under section 77 (2)(a) of the Companies Act2 or has the remedy been relegated to the past? This controversial enquiry frames the groundwork for discussion upon which this dissertation is based. Section 77(2)(a) reads as follows: "(2) A director of a company may be held liable - (a) in accordance with the principles of the common law relating to breach of a fiduciary duty, for any loss, damages or costs sustained by the company as a consequence of any breach by the director of a duty contemplated in section 75, 76 (2) or 76 (3)(a) or (b). ,o This dissertation seeks to shed light on the apparent legislative omission of the common law remedy of disgorgement from the ambit of section 77(2)(a). The effects and consequences of such a significant omission has come under the microscope given South Africa's recently reformed corporate law jurisprudence. The impact of such an omission on the interpretation and application of directors' duties and liabilities will be specifically examined and analysed. The topic of this dissertation remains especially relevant to any discussion involving directors' duties and liabilities in the context of the new Companies Act ("the Act"). The Act has drastically reshaped the South African corporate law landscape and as such, each provision of the Act requires careful consideration in its interpretation and application. Implementation of the Act, in 2011, brought about partial codification of directors' duties and liabilities. Partial codification has resulted in mandatory, unalterable and prescriptive provisions relating to directors' duties and liabilities which are applicable to all companies registered in the Republic.• Since its inception, critics have intimated that certain provisions of the Act hinder, as opposed to facilitate, the objective of clarifying directors' duties and liabilities.5 Fear of statutory liability gives further credence to the importance of clear, concise and uniform interpretation and application of the statutory duties. The statutory duties and liabilities do not replace their common law equivalents. Interpretation, application and development of the statutory duties and liabilities must align with those embedded in the common law.6 Alignment becomes increasingly difficult, however, when inconsistencies and contradictions between these two primary sources of law run rampant. The assessment of educational needs attempts to: (1) identify problems and needs related to the e... more The assessment of educational needs attempts to: (1) identify problems and needs related to the education of American Indians; (2) establish priorities for meeting these needs and solving problems; (3) provide program descriptions to assist individuals and organizations to plan and implement programs to meet priorities; and (4) identify potential financial sponsors for the implementation cf the programs. Informants associated with a variety of groups are interviewed tc obtain pertinent data. The sample includes parents, students, educators, administrators, community organizations, service agencies, Johnson O'Malley boards, tribal_councils, Bureau cf Indian Affairs representatives, and teacher aides. Identified problems pertain to education, health, community relations, employment, znd leadership. The programs described are intended as guides for the development and implementation of an early childhood education program. Problems, educational needs, and programs-are listed respectively. Other problems such as distance from school andtransportation difficulties are factors restricting students from participation in after school activities. Recommendations follow.
