This paper explores the Hobbesian conception of the state as a representation – a baroque artific... more This paper explores the Hobbesian conception of the state as a representation – a baroque artifice, in which individuals, both the rulers and the ruled, are invited to self-represent themselves anew, wearing the according masks. The "contract" is a metaphor that expresses the representational character of the Hobbesian state. This reading allows us to clarify the continuity between Hobbes's political thought and the post-revolutionary system of national sovereignty, as reconstructed by Carré de Malberg. In the latter, as in Hobbes, citizens do not "authorize" the state but represent it, representing themselves as embodying a nation personified by the state.

A categoria dos regimes políticos consubstancia um lugar central – porventura, olugar central – d... more A categoria dos regimes políticos consubstancia um lugar central – porventura, olugar central – da evolução da Política enquanto teoria ou ciência. Nessa medida, o seu significado não se deixa encerrar numa fórmula, apenas se podendo capturar com referência aos diferentes estratos dessa evolução. A definição de "regime político" dependeu, na verdade, do modo como, em cada um deles, se concebeu o fenómeno político. Na impossibilidade de registar cabalmente todos os passos dessa evolução, optamos aqui por nos deter nalguns momentos decisivos. Começaremos por verificar que, na linha de Aristóteles, a Política concebeu-se como ciência dos regimes políticos, tendo-se destes uma determinada aceção conexa com a conceção do homem como "animal político". This chapter explores the dimension of constitutional law composed of constitutive concepts, such... more This chapter explores the dimension of constitutional law composed of constitutive concepts, such as national sovereignty, the people and the concept of Constitution itself. That dimension can be considered as a political-theological dimension in the sense that constitutive concepts are analogous to theological concepts. Both have a negative and anticipatory significance, bearing in mind their understanding in the light of negative theology. In this light, political theology is not to be understood in the terms proposed by Carl Schmitt.

David Luban identifies a tension between Arendt's conception of ethnic identification in a co... more David Luban identifies a tension between Arendt's conception of ethnic identification in a context of persecution and her conception of humanity. That tension pertains to the reality - or realities - that Arendt addresses: the moral reality of her Bildung that appears throughout her work, and is centered on the “dignity of man,” on the one hand, and the divisive, “political” reality that she was forced to face when “attacked as a Jew,” on the other. By implicitly accepting that in a context of persecution one cannot escape the framing relevance of the “political” - an idea that is also present in her imaginary condemnation speech of Eichmann - Arendt betrays a fundamental theme of her work: “forgiveness” and the inherent possibility of a “new beginning.”

This paper explores the hypothesis of judicial passivity as a virtue of courts charged with the t... more This paper explores the hypothesis of judicial passivity as a virtue of courts charged with the task of judicial review of legislation, an hypothesis increasingly relevant given the spread of a legislative model of dealing with emergencies. The definitional structure of the constitutional state is the framework within which that hypothesis is tested. If that structure is understood in Kelsenian terms, judicial passivity will be a breaching element of the same. Inversely, if it is understood in Madisonian terms it will be a coherent element, revealing the inherently paradoxical nature of the constitutional state. Either way, the endorsement of judicial passivity by reviewers of legislation necessarily involves their appeal to the method of political right.
