On the occasion of my participation at the LXXIII Session de la Société Internationale Fernand de... more On the occasion of my participation at the LXXIII Session de la Société Internationale Fernand de Visscher pour l’Histoire des Droits de l’Antiquité (Edinburg 2019), I analyze the legal category of res communes omnium: if it existed in Roman law, which goods were included therein, and which were the characteristics by which they could be distinguished from public goods. From there I take a tour along different moments in legal history in which this category has been used for the most diverse purposes: a. Martin versus Waddell. Rco and «Public trust doctrine» (19th to 13th centuries); b. Baldus de Ubaldis. Rco and independence of Venice (14th century); c. Vitoria, Vázquez de Menchaca e Grotius. Rco and freedom of the seas (16th and 17th centuries); d. Atmosphere and radio space (20th century); e. Extra-atmospheric space (21st century).
