The study aims to identify several elements that influence the cooperation between Romania and Uk... more The study aims to identify several elements that influence the cooperation between Romania and Ukraine, also paths or fields for cooperation, as the local and regional stakeholders perceive. The field research had as subjects the potential applicants for cross-border projects in the eligible area of Romania-Ukraine Joint Operational Programme 2014-2020. The main research questions were related to the factors that encourage and block the cross-border cooperation, partnership aspects (partners, weaknesses or strengths, envisaged fields of cooperation), strategic ideas for the cross-border area development, universities involvement in the area. Comparing data from field researches applied at different times and groups we realized that in some aspects different groups give a different importance to the factors that encourage or block the cooperation, also, in the last research the relevance that the cross-border programmes have in the area to promote cooperation and partnership.

The crossborder areas have no constitutional competences, therefore most of the times they are no... more The crossborder areas have no constitutional competences, therefore most of the times they are not part of the decision making process in the agreements in cross-border relationships. Although the states are the ones to decide the policies and the agreements based on their own legal rules, considering the shape of the new European Union, they should more and more accept the conditionality of a regional overstate structure linked only to some geographical parts of the countries. The present paper proposes a theoretical and intuitive frame for assessing the cross-border areas based on the factors that are influencing it, starting from a listing of them, secondly grouping them in separating and uniting, then finding the significant differences. The matrix of factors can be used for conflict resolution or for development of cross-border areas as long as it shows the points that will be a potential obstacle or a source for cooperation.

The used methodology included an adapted A’WOT analysis - an initial SWOT analysis and a prioritization of the items through an expert questionnaire. In the present paper we analyze the experts’ opinions and the areas where intervention is needed for the optimum strategies for the 2014-2020 financial frame. Mediation is an used procedure among the commercial dispute resolution in the United States and m... more Mediation is an used procedure among the commercial dispute resolution in the United States and many other common law jurisdictions. On the other side, the state of development of the alternative dispute resolution and mediation in continental Europe is not even and has not such a wide experience as the United States. The European Union rules provide a framework for Member States to set their own legal paths and institutions in order to promote and efficiently use this way of solving conflicts. Encouraging the use of mediation facilitates the resolution of disputes and helps to avoid the worry, time and cost associated with court-based litigation, in this way citizens are enabled to secure their legal rights in an efficient way.

Further we identified in the specific literature relevant study cases that provide lessons learned, tools and models that can contribute to the development of the cross-border areas. The last part of the paper is focusing on an inquiry about how this lessons, learned, tools and models may be adapted in case of cross-border areas along the Romanian border with the EU Eastern Neighbourhood.

The crossborder cooperation can boost the economic development for each participant country in th... more The crossborder cooperation can boost the economic development for each participant country in the area, mostly depending on the depth of the relation between the neighbouring countries. The basis for it consists in the common interest for improvement of life standard, in ensuring a sustainable and harmonious framework and in the clearance of frontier barriers, restrictions or other factors. In view of improving of the social-economical position of the regional communities and removing of the negative effects of the border, the local communities are more and more involved in the regional collaboration. The present paper aims to define a baseline for a strategy concerning a potential multi-urban development pole, as specific case Suceava-Cernivtsi. It starts by establishing the actual general framework from economic, behavioural, geopolitical and administrative point of view in terms of the potential that can rise from a crossborder area. Further it gathers few field research conclusions from two field studies, one made on Romania-Ukraine-Republic of Moldova crossborder area and second one on a smaller geographic part, in the Romania-Ukraine crossborder area. Both, the general grounds rising from scientific literature and field research results, are contributing to a part of the SWOT analysis for Suceava-Cernivtsi crossborder area, in terms of opportunities and threats. Also, for this area we fix some reference points relevant for a strategy we will work on a wider research in order to capitalize the potential, as a future step. The paper is relevant as theoretical background for the field research that will follow and it implies a multidisciplinary approach on each of the mentioned domains in order to identify opportunities and threats.

Further there are identified in the specific literature important challenges and key points that are marking the cross-border partnerships. The last part of the paper is focusing on some examples of cross-border cooperation, making distinction between two main situations: the border between Member States and the borders between EU and neighboring countries.

The research is focusing on four main aspects: the actual European economic framework with target on the legal European frame concerning the SMEs, the economic background of the target area, existing cross border cooperation grant schemes for the target area designed for different beneficiaries and the specificity of the financial instruments dedicated to SME’s. The analyze of the mentioned aspects shows the the most important features that should be included in a grant sub-scheme proposal and the necessary steps for action.

This paper intends to go through the main issues about the role of the Phare Crossborder funds in... more This paper intends to go through the main issues about the role of the Phare Crossborder funds in the development of the economy in the border area. The specific approach is linked to the Neighbourhood Programme Romania-Ukraine. The paper starts with the European view about the external borders aims, describes the framework of the Neighbourhood Programme focused on the aspects with relevance on economical improvement of the border areas and presents few financial marks. There are reviewed the most important lessons learned during the implementation of the programme and there are listed some of the results that marked an economical change and could have long term economical impact. The paper concludes the main ingredients needed for a future cooperation in terms of crossborder economical projects between two different countries, at the external border of the European Union.

Proximitatea și conștientizarea beneficiilor cooperării stimulează extinderea și structurarea intereselor de dezvoltare și in plan transfrontalier. O abordare eficientă pornește de la potențialul existent pe fiecare parte a frontierei și potențialul de cooperare transfrontalieră in vederea dezvoltării economice a regiunii. The objective of this paper is to set up the main features of a possible grant sub-scheme designe... more The objective of this paper is to set up the main features of a possible grant sub-scheme designed for the small and medium enterprises (SMEs) located in the crossborder area Romania-Ukraine-Republic of Moldova. The research is focusing on four main aspects: the actual European economic framework with target on the legal European frame concerning the SMEs, the economic background of the target area, existing cross border cooperation grant schemes for the target area designed for different beneficiaries and the specificity of the financial instruments dedicated to SME’s. The analyze of the mentioned aspects shows the the most important features that should be included in a grant sub-scheme proposal and the necessary steps for action.

This paper intends to go through the main issues about the role of the Phare Crossborder funds in... more This paper intends to go through the main issues about the role of the Phare Crossborder funds in the development of the economy in the border area. The specific approach is linked to the Neighbourhood Programme Romania-Ukraine. The paper starts with the European view about the external borders aims, describes the framework of the Neighbourhood Programme focused on the aspects with relevance on economical improvement of the border areas and presents few financial marks. There are reviewed the most important lessons learned during the implementation of the programme and there are listed some of the results that marked an economical change and could have long term economical impact. The paper concludes the main ingredients needed for a future cooperation in terms of crossborder economical projects between two different countries, at the external border of the European Union.

We initiated a literature review, using mainly as sources, relevant articles, books and other official papers from the resilience field of research in relation with the previous researches we made in the field of cross-border regions.
