The Federal Constitution of 1988 defined the Master Plan as a 'basic instrument' of urban... more The Federal Constitution of 1988 defined the Master Plan as a 'basic instrument' of urban development policy and subsequent legislation, which regulated the Urban Policy chapter (Estatuto da Cidade, Federal Law No. 10,257 / 2001), reinforced a set of participatory requirements in the availability and implementation of the corresponding policies. Based on this new institutional arrangement, this research paper analyzes a participatory structure in the process of reviewing the Master Plan for the municipality of Vitória, capital of Espírito Santo, in the period 2014-2018. The investigation took as an analytical parameter the participatory methodology proposed by the Ministry of Cities, whose distinguishing feature was the dissemination of democratic management instruments. The present study deals with an evaluation of the urbanistic legislation of the São Paulo municip... more The present study deals with an evaluation of the urbanistic legislation of the São Paulo municipalities of São Carlos (251,983 inhabitants), Ribeirão Preto (703,293 inhabitants) and Campinas (1,204,073 inhabitants) in order to: 1. Identify the existence of any incentive policy for urban sustainability and 2. Understand whether the different territorial and population scales of these municipalities influence the implementation of sustainability policies. A bibliographic survey of academic research was carried out to learn about the existing discussions on the subject and possibilities of building policies to encourage sustainable buildings were analyzed by consulting the Master Plans and their complementary legislation, such as: use of urban control parameters and / or the application of the Legal and Political or Tax and Financial institutes of the City Statute, such as the Onerous Grant of the Right to Build, Green Property Tax, among others. It is based on the articles 182 and 183 of the 1988 Brazilian Federal Constitution and Law 10,257/2001 (City Statute), which consolidated the Master Plans as a basic instrument of the developmental policy and urban expansion of municipalities and made popular participation mandatory during its design and implementation. Aim: To understand how the participatory experiences were during the Master Plans revision process in different Brazilian municipalities in consequence the obligatoriness established by Law 10.257/2001. Methodology: The methodologic procedure was a systematic review of academic researches (theses and dissertations) on Brazilian Digital Library of Theses and Dissertations – BDTD, data collected from participatory proceeding, systematization, and analysis of the results.
