Competences in the construction sector of the Slovak Republic (SR) under the current legislation ... more Competences in the construction sector of the Slovak Republic (SR) under the current legislation are exercised at the local level of the state both by institutions of local self-government (municipalities) and state administration (district offices). The building authorities with the authority to decide on building permits are currently the municipalities to which the state has delegated building competences by Act No. 50/1976 Coll. on spatial planning and building regulations, as amended. However, the new construction legislation, effective from 1.4.2024, leads to a retroactive transfer of construction competences from municipalities to the state, to the newly created regional construction authorities. The long-awaited change in the legislation in the field of building regulations is expected to shorten the permitting processes and improve the functioning of building authorities. Publikace se zaměřuje na aktualni problemy ochrany půdy. Je rozdělena do ctyř komplexnich a vzaje... more Publikace se zaměřuje na aktualni problemy ochrany půdy. Je rozdělena do ctyř komplexnich a vzajemně souvisejicich casti. Prvni cast publikace se zaměřuje na otazku důležitosti ustavni, respektive mezinarodni a evropske legislativy pro ochranu půdy. Take se věnuje problematice sběru, registraci a aktualizaci informaci o půdě, ktere jsou nebo by měly být k dispozici statu a vlastnikům a uživatelům pozemků, pro efektivni a informovane rozhodovani. Problematika efektivniho a udržitelneho využivani uzemi statu týkajici se rozmanitosti soukromých a veřejných zajmů, jejichž propojeni v zemi je nepochybne, je předmětem nasledujici casti publikace. Autoři postupně nastoluji řadu nasledujicich otazek o tom, jak je zajistěno udržitelne využivani uzemi statu, tematech o zajistěni budovani uzemi podle planu a uvažovani o konecne, i když nedostatecně zjevne, množstvi „žive“ půdy. The article presents and explains current trends, policies and legislation in this area in the Slovak Republic with emphasis on introducing the new piece of legislation-Act No. 329/2018 Coll. on fees for the waste landfilling.

The significant amendment of the Slovak constitution deals with the protection of the land which ... more The significant amendment of the Slovak constitution deals with the protection of the land which it newly characterises as a non-renewable natural resource and provides additional legal protection of it. The article analyses the importance of this amendment from multiple perspectives with emphasis on legislative changes it has brought. The main topics of the article are the need for more effective legislation in the area of land protection and also the long-standing need to carry out land consolidations in the Slovak Republic.
