Las organizaciones internacionales surgen a inicios del siglo XIX como una herramienta para satis... more Las organizaciones internacionales surgen a inicios del siglo XIX como una herramienta para satisfacer, a traves de la cooperacion internacional, los intereses comunes de las naciones en temas diversos. Tales sujetos han ocupado un rol significativo en la evolucion, humanizacion y democratizacion del Derecho Internacional contemporaneo en virtud de haber logrado, entre otros resultados, institucionalizar los metodos de produccion de marcos normativos como convenciones internacionales y sus mecanismos de seguimiento; brindar el foro para las negociaciones y busquedas de consenso en temas de alcance universal o hemisferico; promover en las iniciativas que se ejecutan en su foro el respeto a los derechos humanos y libertades fundamentes, y servir como canal para la adopcion de medidas colectivas ante la ruptura de compromisos internacionales, fungiendo asi como el principal vehiculo para garantizar la coexistencia pacifica de los Estados. Given the numerous lacunae in the area of nullity of international arbitration awards, this stud... more Given the numerous lacunae in the area of nullity of international arbitration awards, this study seeks to examine in depth the reasons why a State suffering the consequences of an unfair arbitration procedure might eventually file with the International Court of Justice a motion to vacate an arbitration award. It discusses the advisability of a losing State supporting its claim based on an inexcusable defect, recognized in different domestic legislation that allows greater evidentiary flexibility: procedural fraud upon the court. While procedural fraud has not been defined at the international level, it is proposed that the International Court refer to comparative law and the rules thereof pertaining to the nullity of judgments in deciding the feasibility of challenging an arbitration award on the grounds of procedural fraud.

Given the numerous lacunae in the area of nullity of international arbitration awards, this study... more Given the numerous lacunae in the area of nullity of international arbitration awards, this study seeks to examine in depth the reasons why a State suffering the consequences of an unfair arbitration procedure might eventually file with the International Court of Justice a motion to vacate an arbitration award.

It discusses the advisability of a losing State supporting its claim based on an inexcusable defect, recognized in different domestic legislation that allows greater evidentiary flexibility: procedural fraud upon the court. While procedural fraud has not been defined at the international level, it is proposed that the International Court refer to comparative law and the rules thereof pertaining to the nullity of judgments in deciding the feasibility of challenging an arbitration award on the grounds of procedural fraud.

Said approach has been developed to find an alternative solution to a dispute that dates from the time of colonialism and whose solution has not been possible due to significant deficiencies in the arbitration system: the Anglo-Venezuelan boundary dispute over the territory of Guayana Esequiba.
