Exploring the Qur’an, 2017
The teachings, style and impact of the Qur’an have always been matters of controversy, among both... more The teachings, style and impact of the Qur’an have always been matters of controversy, among both Muslims and non-Muslims. But in a modern context of intercultural sensitivity, what the Qur’an says and means are perhaps more urgent questions than ever before. This major new book by one of the world’s finest Islamic scholars responds to that urgency. Building on his earlier groundbreaking work, the author challenges misinterpretations of particular Qur’anic verses from whatever quarter. He addresses the infamous ‘sword’ verse, frequently cited as a justification for jihad. He also questions the ‘tribute’ verse, associated with the Muslim state subjugating Jews and Christians; and the idea of Paradise in the Qur’an, often viewed by the West as emphasising merely physical pleasures, or used by Islamic fighters as their just reward for holy war. The author argues that wrenching the verses out of the context of the whole has led to dangerous ideologies being built on isolated phrases which have then assumed afterlives of their own. This paper presents a prelude, an overview that sheds light on the theoretical underpinnings and ... more This paper presents a prelude, an overview that sheds light on the theoretical underpinnings and historical development of the concept of maqāṣid al-Sharīʽah in the context of Islamic legal theory (ʽilm uṣūl al-fiqh) which touches on methodological and epistemological issues. The bulk of this essay then undertakes a relatively detailed analysis and explication of the substance, content and dimensions of maqāṣid al-Sharīʽah with the clear intention to highlight the relationship of the idea of maqāṣid to the issue of human nature and its bearing on the question of values. It reflects on the general import and ramifications of maqāṣid al-Sharīʽah with regard human life and development in their complex and multifaceted nature

Language scholars agree that there is mutual influence among languages,thus each language borrowi... more Language scholars agree that there is mutual influence among languages,thus each language borrowing what it needs from other languages and supplying them with what they need in terms of words and vocabulary. Like other nations, the Arabs had specific experience in linguistic exchange through their intercourse with other nations both by virtue of neighbourhood and due to their regular winter and summer trade journeys to regions far away from the Arabian Peninsula. This resulted in the reception by the Arabic language of vocabulary and words from other languages,conventionally known as loanwords and Arabized vocabulary. This fact, notwithstanding, scholars have differed on the occurrence of such borrowed and Arabized words in the Qur’an. The present article addresses this issue through applying a descriptive and analytical method in examining the different opinions held by classical Islamic scholars and Qur’an commentators in light of modern linguistic studies. This science is of a recent birth and the history of its emergence does not go farther back than the early nineties or late eighties of the twentieth century. Its birth was necessitated by the social problems, pandemic diseases and environmental catastrophes that human societies underwent throughout the second half of the twentieth century. This called for the necessity of thinking not only about the ways and means of dealing with those problems, pandemics and catastrophes by controlling their effects and alleviating the severity of their impact, but it also required looking into the means of avoiding them by intervening to prevent their occurrence through the control of their cause...

Writings on al-Shāṭibī have focused on his views on maṣlaḥah (utility) and Maqāṣid al-Sharīʿah (o... more Writings on al-Shāṭibī have focused on his views on maṣlaḥah (utility) and Maqāṣid al-Sharīʿah (objectives of the Sharīʿah). His approach to the interpretation of the Qurʾān (the main source of the Sharīʿah) and the implications of such an approach have only rarely been heeded. This study addresses this aspect of al-Shāṭibī’s work. It essentially asserts that in restructuring Islamic legal theory (uṣūl al-fiqh) around the idea of Maqāṣid al-Sharīʿah, al-Shāṭibī brought jurists and Qurʾān commentators closer to one another. It further argues that his contribution went beyond the interest of jurists centred on legal reasoning by holding a comprehensive hermeneutical view of the Qurʾān informed by belief in the thematic unity of its sūrahs and verses. Taking such unity as the cornerstone of a sound understanding of the Qurʾān capable of grasping its eternal values and universal principles, he developed a methodology that has inspired a few eminent contemporary Muslim scholars who have ...

Difference, diversity and variation among human beings, both as individuals and groups, and hence... more Difference, diversity and variation among human beings, both as individuals and groups, and hence, the presence of the different Other together with the Self have always been one of the main expressions and ramifications of the original identity and essential unity of the human species. Unity in diversity, or vice versa, is one of the wonders of the creation exemplified in the creature that has been given pre-eminence and glory in the cosmos as God’s trustee and vicegerent on earth. Whatever the manifestations of difference and forms of diversity and plurality obtaining in and among human societies might be, they in no way obliterate human original identity and essential unity emanating from a God-fashioned original nature or fitrah.

The Berbers at that time had all credit for spreading Islam in Sub-Saharan Africa, including Senegal. This paper accounts for a brief historical background and how Maliki jurisprudence is disseminated all over the Republic of Senegal. Senegal is situated in West Africa, where more than eighty scholarly circles, based on the teaching of Maliki jurisprudence, are spread out along the flanks of the Fulani on the banks of the Senegalese river from the heights of Fouta Djallon. The present article attempts to examine the concept of takyif fiqhi in a comprehensive manner in terms of its meaning, authority, types, importance, and governing criteria as can be gleaned from the works of Shari'ah scholars. This is then followed by an exploration of its application to modern contracts, taking as a case study the Central Provident Fund Nomination in Singapore. The present article attempts to examine the concept of takyif fiqhi in a comprehensive manner in terms of its meaning, authority, types, importance, and governing criteria as can be gleaned from the works of Shari'ah scholars. This is then followed by an exploration of its application to modern contracts, taking as a case study the Central Provident Fund Nomination in Singapore.
