The article sketches out questions that constitutional adjudication represents for democratic the... more The article sketches out questions that constitutional adjudication represents for democratic theory. After taking into account some of the reasons for the early emergence of judicial review in the United States, it considers different modalities of constitutional control in European countries (notably, France and Italy). Attention is drawn to the different mechanisms of referral, leading, for instance, to the political monopoly in France and to the (quasi) monopoly of the judiciary in Italy. Denying any sovereign power to the organs exercising constitutional control, the article puts forward the thesis that constitutional adjudication guarantees ultimately the control of political super-majorities over legislative majorities.

Teorias da escolha racional de vários tipos tiveram um impacto enorme na forma como a Ciência Pol... more Teorias da escolha racional de vários tipos tiveram um impacto enorme na forma como a Ciência Política foi desenvolvida, ao menos nos Estados Unidos. Até o momento, entretanto, esse impacto tem se limitado, em grande medida, às partes mais empiricamente orientadas da disciplina, principalmente os estudos de política americana, relações internacionais e política comparada. Normalmente, teorias da escolha racional são definidas como positivas, em oposição a teorias normativas. O principal objetivo das primeiras é desenvolver teorias preditivas bem-sucedidas em Ciência Política.

Até o momento, entretanto, esse impacto tem se limitado, em grande medida, às partes mais empiricamente orientadas da disciplina, principalmente os estudos de política americana, relações internacionais e política comparada. Normalmente, teorias da escolha racional são definidas como positivas, em oposição a teorias normativas. O principal objetivo das primeiras é desenvolver teorias preditivas bem-sucedidas em Ciência Política.

This text offers the draft of the third section of a book devoted mostly to the Constitutional Co... more This text offers the draft of the third section of a book devoted mostly to the Constitutional Courts in three European countries: Germany, France and Italy. After a section on the new separation of powers and the legislative role of the judiciary, I present a theory of the legitimacy of the constitutional adjudication by agencies, which are non-electorally accountable and have the explicit function of corrective of the majoritarian democracy, based on the principle that " there is no right without remedy " .

This chapter/text has its origin in conversations I started more than 25 years ago with Istvan in Cambridge about Hobbes and Sieyes, the modern state, representative government, and contemporary democracy. It discusses, at least in part, parallel issues with the object of Chapter 7 of his Jealousy of Trade. My greatest regret is that it is now too late to talk about my ideas with him.
