The Routledge Handbook on the International Dimension of Brexit
De juridische verankering van de rechten, vrijheden en beginselen in het Handvest van de grondrec... more De juridische verankering van de rechten, vrijheden en beginselen in het Handvest van de grondrechten is het sluitstuk van een lange evolutie naar een eigen grondrechtencatalogus voor de Europese Unie (EU). De opname van burgerlijke, politieke, sociale en economische rechten in een juridisch bindend Handvest doet de vraag rijzen naar de implicaties hiervan voor de burger, de advocaat en de nationale rechter. In deze bijdrage wordt getracht hierop een antwoord te bieden door achtereenvolgens het toepassingsgebied, de verhouding met het Europees Verdrag voor de Rechten van de Mens (EVRM) en de gevolgen voor de nationale rechtspraktijk na te gaan. Op basis van recente rechtspraak van het Hof van Justitie wordt aangetoond dat het Handvest een belangrijk referentiepunt kan zijn in nationale (privaatrechtelijke) procedures. Specifieke aandacht wordt besteed aan de samenloop van Europese en nationale grondrechten en de doorwerking van het Handvest in de Belgische rechtsorde.

It maps out different types of association agreements concluded on the legal basis of Article 217 TFEU and identifies the key features characterising the nature of association under EU law.

This chapter deals with the legal dimension of the revised European Neighbourhood Policy (ENP). I... more This chapter deals with the legal dimension of the revised European Neighbourhood Policy (ENP). It analyses the revision of the bilateral legal relations focusing on the new generation of Association Agreements with the Eastern Partnership countries prior to, and in the context of, the revised ENP of 2011. In addition, different sectoral agreements are explored dealing with mobility, energy and aviation. It is argued that the evolving legal framework under the revised ENP is essentially based upon past experiences, reflecting the well-known phenomenon of path dependency, in combination with spill-over effects from other EU policies. Nevertheless, a number of legal innovations, mirroring change and tailored to the specific ENP objectives, can be detected.

This paper analyses different steps in the development of EU-Belarus relations. The dilemmas Bela... more This paper analyses different steps in the development of EU-Belarus relations. The dilemmas Belarus presents to the EU in terms of conditionality and constructive engagement are discussed in order to draw certain conclusions about the EU's leverage to spark democratic reform in an authoritarian regime. It is argued that domestic evolutions in Belarus essentially depend on regional factors rather than on the effectiveness of the EU's political conditionality. Recent initiatives of constructive engagement can, therefore, only be successful when embedded in a comprehensive strategy for the entire region.

The withdrawal of the United Kingdom (UK) from the European Union (EU), commonly known as Brexit,... more The withdrawal of the United Kingdom (UK) from the European Union (EU), commonly known as Brexit, resulted in the establishment of a new bilateral legal framework for the future development of EU-UK relations. The new framework is based on a Trade and Co-operation Agreement (TCA) in combination with more specific supplementing agreements concerning the exchange of classified information and the peaceful use of nuclear energy. Without entering into a detailed substantive analysis of these agreements, several innovative elements can be highlighted from the perspective of EU external relations law. This includes, in particular, the governance structure of the new legal framework, the use of art. 217 TFEU (on association) as a legal basis, the “EU-only” nature of the TCA and the provisional application without prior involvement of the European Parliament. the challenge for the EU to deliver independent humanitarian aid while simultaneously
seeking to establish more coherence between its external policies.The article examines
how the EU tries to reconcile these potentially conflicting policy goals, both de jure and
in practice. Empirically, it explores the interaction between EU humanitarian aid and
development cooperation, the Common Foreign and Security Policy, and trade policy.
While the independence of the humanitarian aid delivery is, for the most part, not being
undermined, it remains difficult to establish positive synergies with other external poli-cies because of institutional hurdles and legal constraints, as well as political obstacles and
operational incompatibilities.
