Based on the author's personal experience , he proposes consideration of the theoretical choi... more Based on the author's personal experience , he proposes consideration of the theoretical choices offered Montreal criminologists over the past 25 years . At first, the sole object of criminology was the etiology and social treatment of crime . At the end of the 60' s and for the following ten years or so, there were many expressions of doubt both at the socio-political level as well as concerning the social sciences and criminology as such . The movements for the defence of minority rights and new theoretical orientations led the author to question the production of norms and attribution of the «quatity» of deviant rather than the factors of delinquency. He explains here how from a criminology of acting out he eventually arrived at a criminology of social control . More in-depth analyses of punishment and penal justice led the author to question the very existence of the entire criminal justice system and, like L. Hulsman, to take an abolitionist position. He then describes how he conceives the role of the clinician in this perspective .

Om te antwoorden op de vraag "kan de graad van recidive een criterium zijn van de doelmatigheid van de rechtelijke strafmaatregelen ? " heeft de auteur onderzocht in welke mate de recidive nuttige inlichtingen kan verschaffen m.b.t. de verwezenlijking van de doeleinden, die traditioneel werden toegekend aan de strafmaatregelen. Wet verstaat men in de empirische onderzoeken onder recidive en vooral wat meet men door de graad van recidive ? Deze benadering, maar ook een analyse van de onderliggende postulaten van de officiële theoriëen over de strafrechtelijke inbreuk, over het proces van selectie van de misdadige bevolking en over de aard van deze bevolking leiden tot het besluit : 1. Sat de "graad van recidive" niet kan beschouwd worden als een criterium van doelmatigheid van de strafmaatregelen. 2. Sat men slechts tot een meer rechtvaardige ne meer menselijke sociale politiek kan komen zo men "de obsessie van de récidive" verlaat en de activiteiten van de strafrechtsbedeling zowel vermindert als controleert.

This article giue.t an account ofthe compensatory work programme in the province of Quibec, Canad... more This article giue.t an account ofthe compensatory work programme in the province of Quibec, Canada, which is a success in the sense that, to a certain extent, it checked admissions f o r non-payment offines (the flow), and improved the quality of justice administration, hut it has had no perceptible impact on the prison stock. It also discusses the danger of the political discourse and that of agencies that have an immediate interest in painting a glowing picture of the savings that would be realised hy such programmes in reducing the prison population.

He explains here how from a criminology of acting out he eventually arrived at a criminology of social control. He then describes how he conceives the role of the clinician in this perspective.

Conditional sentencing, introduced in Canada in 1996 to reduce the practice of incarceration for ... more Conditional sentencing, introduced in Canada in 1996 to reduce the practice of incarceration for sentences of less than two years, allows a convicted offender to serve his or her prison sentence in the community. This article presents the descriptive and analytical findings from unpublished, empirical research on conditional sentencing in the province of Quebec. We elaborate on the changes to probation with respect to the Proulx judgment, pronounced in 2000 by the Supreme Court of Canada, and to the management framework for this measure, implemented throughout Quebec in 2001. An analysis of the findings leads to considerable data on the evolution of conditional sentencing with respect to the clientele, the sentences and, most of all, the court-imposed conditions for conditional sentences, particularly house arrest and curfew. The breach of conditions and re-offending by convicted offenders, and the management of these relapses, complete this portrait of the use, the successes, and the failures of conditional sentencing in Quebec. These results enable us to highlight the fact that the Proulx judgment has had an important impact, in Quebec, on the judicial and administrative practices involved in conditional sentencing.

Cet article tente de sensibiliser à l'analyse des effets différentiels du système pénal sur l... more Cet article tente de sensibiliser à l'analyse des effets différentiels du système pénal sur la vie et la trajectoire sociale des membres des différentes (fractions de) classe et de suggérer une nouvelle façon d'articuler une telle problématique. Pour ce faire les auteurs ébauchent, très succintement, certaines dimensions de trois cas types. En guise de conclusion, on présente quelques réflexions sur deux questions : a) La cible réelle de l'intervention pénale : Ne serait-ce pas la famille plutôt que les individus... ? b) La visibilité différentielle des effets du système pénal : La croyance ou l'illusion que les membres de certaines couches du prolétariat n'ont rien à perdre avec l'expérience pénale ou qu'ils sont moins pénalisés que les ressortissants de la bourgeoisie...

In this article the author exposes the situation of prison overcrowding in facilities in the prov... more In this article the author exposes the situation of prison overcrowding in facilities in the province of Québec. He brings forth the fact that leave of absences have been used to respond to this situation and states that these programs are acceptable means of managing carcéral populations. He bases his statements on the spacial comparison of the rates of leave of absences and the rates of overcrowding between 1989 and 1992, and this by various administrative regions of Québec.
