This paper reviews the food safety regulatory apparatus in place today, especially the activities... more This paper reviews the food safety regulatory apparatus in place today, especially the activities of the two lead agencies in assuring food safety — the Food and Drug Administration within the Department of Health and Human Services and the Food Safety and Inspection Service within the Department of Agriculture. It examines the system\u27s strengths and vulnerabilities, particularly in light of the post–September 11 environment that includes the heightened threat of terrorism. The paper also touches upon legislative and budgetary proposals aimed at improving food security, including the growing but debated interest in a single food safety agency

The ABCs of PBMs As Congress continues to consider adding an outpatient prescription drug benefit for Medicare beneficiaries in this presidential election year, the number of administrative and legislative proposals goes on climbing. While the nature and scope of these proposals vary widely, they all contain a common element, the use of PBMs-pharmacy benefit managers. By acting as intermediaries between pharmaceutical manufacturers and third-party payers (that is, employers, managed care organizations, labor unions, and state-funded pharmaceutical assistance programs for the elderly), PBMs administer prescription drug benefits. A major policy and, indeed, practical consideration, will be the degree of latitude provided a PBM in managing a Medicare outpatient drug benefit. This paper summarizes liability and compensation concerns surrounding the smallpox vaccination pr... more This paper summarizes liability and compensation concerns surrounding the smallpox vaccination program announced by President Bush on December 13, 2002. The paper examines the nature of adverse health events that are likely to occur in connection with the smallpox vaccine, assesses the liability protections that have been established for organizations and individuals participating in the vaccination program, and discusses the compensation mechanisms being considered to address the damages incurred by volunteers who may suffer from adverse vaccine reactions. Specifically, the implications of the Federal Tort Claims Act, workers' compensation programs, and the creation of a new no-fault compensation fund are explored.

Overview-This paper describes the Medicare coverage process for emerging technologies and the ways it has changed over time. Issues addressed include both the national coverage process and local medical review policies, which account for 90 percent of the coverage determinations. The paper also includes a discussion of the relationship between the coverage process and technology assessment, payment systems and the ongoing debate over coverage criteria and levels of evidence.
