Pappas (*) | jeudi 27 mai 2010 Le principe aristotélicien d'« inégalité des non-égaux » s'applique aussi de cette manière : plus une entreprise est importante, plus elle a de responsabilités et doit rendre des comptes. C'est d'autant plus vrai dans le cas de Google qui a gagné, si ce n'est la confiance, du moins la préférence des utilisateurs en détenant 95 % des marchés européens majeurs, et générant un chiffre d'affaires annuel de 28 milliards de dollars. En dépit de cela, les autorités de régulation à travers l'Europe ont ouvert des enquêtes sur l'interception secrète par Google de données provenant de réseaux Wifi privés, sur les fins et moyens de la collecte de données par les véhicules du service « Google Street View », et sur l'usage de ces données. Les autorités allemandes sont même allées jusqu'à ouvrir une enquête criminelle. C'est à présent à l'UE de sauvegarder l'intérêt des citoyens européens, comme elle le fait dans le cadre des accords sur le contre-terrorisme avec les Etats-Unis.

The latter is being invoked as if it were a generic term likewise in the Anglo-Saxon legal system. However, in this duo, democracy is the ideology and rule of law is the means for its safeguard. Putting the emphasis on the rule of law reverses the order and dissociates it from its objective, i.e. to serve democracy. Rule of law is just a technic. The fundamental value from which it derives is democracy. Taking distance from democracy by referring to subsequent and dependent from it notions might distort the very foundations of the democratic regime.

The Commission faced unprecedented criticism during 2002 with the successive annulments by the Co... more The Commission faced unprecedented criticism during 2002 with the successive annulments by the Court of First Instance of the European Communities (CFI) of three of its decisions concerning major mergers. Although the CFI had always formally been the review body for all Commission decisions regarding mergers, this review had seldom been exercised with such severity and rigor. Rather than drawing conclusions on the changes that these judgements are likely to bring to the doctrine and methodology of merger control by the Commission, this paper seeks to analyse whether these judgements will remain seen as “accidents” or will continue to symbolise a major change. If so, in what sense ? The succession of three judgements seems to imply that there is more behind these cases than particular mistakes regarding specific situations.
