Recognition of status is becoming a more and more important topic in private international law. N... more Recognition of status is becoming a more and more important topic in private international law. New methods develop as case law of the CJEU and ECtHR strengthens the recognizability of a status acquired abroad. This development is also seen in Croatian legislation and is elaborated in the Croatian legal theory, notwithstanding the fact that the Croatian legal system was so far not in the focus of the CLEU's or ECtHR's case law. This report demonstrates the current state of play and recent developments concerning status recognition in Croatia.

Uobičajeno boravište ostavitelja ključan je pojam Uredbe o nasljeđivanju i za određivanje nadležn... more Uobičajeno boravište ostavitelja ključan je pojam Uredbe o nasljeđivanju i za određivanje nadležnog suda i za određivanje mjerodavnog prava. Taj pojam nije definiran odredbama Uredbe, već su u njezinoj preambuli dane smjernice nadležnim tijelima za utvrđivanje uobičajenog boravišta. Nedostatak definicije te poveznice omogućuje njezinu fleksibilnost te ostvaruje važno načelo međunarodnog privatnog prava-načelo najuže veze. Istovremeno taj se nedostatak može očitovati u nepredvidljivosti te manipulaciji poveznicom s ciljem ostvarenja primjene povoljnijeg prava. U fokusu razmatranja ovoga rada jest određivanje uobičajenog boravišta ostavitelja za potrebe Uredbe o nasljeđivanju. Ključna razmatranja odnose se na pitanje koliko praksa Suda EU-a razvijena u drugim područjima međunarodnog privatnog prava može biti primijenjena u kontekstu Uredbe o nasljeđivanju, kako je Sud EU-a odredio uobičajeno boravište u svojoj praksi koja se odnosi na Uredbu o nasljeđivanju te kako hrvatski sudovi određuju tu poveznicu.

This paper analyses the issue of recognition of canon marriage (matrimonium) that has been conclu... more This paper analyses the issue of recognition of canon marriage (matrimonium) that has been concluded in the Vatican City State and also the effects of decisions of church courts on marriage in the Republic of Croatia. Firstly, the authors elaborate the issue of the status of the state and legal order of the Vatican City State, including its regulation of marriage. After the initial findings the question of recognition of marriage concluded in the Vatican City State in the Republic of Croatia is analysed. The conclusion in this aspect is that such a marriage is recognised in Croatia and its registration in the personal status record should be facilitated. In the following chapters the authors first analyse all the potentially relevant church courts’ decisions that concern canon marriage in the Vatican City State. Thereafter, they elaborate whether such decisions may be recognized in Croatia given the fact that church, and not state, courts decide on the issue. Given the specificities...
