This research project aims to analyse what in doctrine has been called the Achilles heel of ICSID... more This research project aims to analyse what in doctrine has been called the Achilles heel of ICSID arbitrations, i.e. the obstacle posed by the theory of State immunity to the enforcement of arbitration awards rendered against sovereign States by arbitral tribunals constituted under the provisions of the Washington Convention of 1965, establishing, under the auspices of the World Bank, the International Centre for the Settlement of Investment Disputes (ICSID). This research project aims to analyse the various solutions that have been proposed by the doctrine and practice to the problem of enforcement of ICSID awards and to propose a solution that will be a balance between the prerogatives of the State and the investor's rights. In the discussion several cases, even non ICSID ones, will be examined as their analysis is essential in order to illustrate common issues and draw common solutions. Nella prima parte valuteremo la portata della pronuncia sotto il profilo più strettamente internazionalistico, occupandoci delle sue ripercussioni sull'applicazione e lo sviluppo progressivo del diritto internazionale consuetudinario. Nella seconda parte, invece, analizzeremo in maggior dettaglio il dispositivo della sentenza, considerandone sia gli aspetti sostanziali -nella specie il ricorso alla teoria dei contro-limiti -sia gli aspetti processualistici.

Premessa.-Tra i diversi temi affrontati dalla Assemblea Generale e dalla VI Commissione nel corso della sessione in rassegna ci si occuperà in modo più approfondito di quelli che presentano maggiore interesse sotto il profilo giuridico o che hanno dato luogo a sviluppi significativi. Saranno trattati in maniera estremamente sintetica gli argomenti che non rispondano a detti parametri. Va rilevato, infatti, che in relazione a questi ultimi la VI Commissione produce risultati fondamentalmente ripetitivi rispetto a quelli degli anni precedenti.

The present article deals with the issue of the power of reconsideration of ICSID tribunals. In 2... more The present article deals with the issue of the power of reconsideration of ICSID tribunals. In 2014, the majority in ConocoPhillips v. Venezuela rejected Respondent's Request for Reconsideration, ruling that an interim decision had res judicata effect. However, in a powerful dissent in that case, Professor Abi-Saab argued that the tribunal in fact possessed an inherent power of reconsideration. The following year, the ICSID tribunal in Perenco v. Ecuador unanimously endorsed the reasoning of the majority in ConocoPhillips. While judicial economy is potentially undermined if interim decisions can later be revisited, the question is how to strike the proper balance between judicial efficiency and fundamental fairness. As this article shows, the most sensible position, recently taken by the ICSID tribunal in SCB HK v. TANESCO – and one that still promotes judicial economy – is to recognize a limited power of reconsideration during the period until a final judgment has been rendered. Each party shall abide by and comply with the terms of the judgement unless the execution of the above judgement is suspended because of the arrangements provided for in this Convention.
