Since 2013, Venezuela has been enduring one the worst socioeconomic depressions in its region. In... more Since 2013, Venezuela has been enduring one the worst socioeconomic depressions in its region. Instability has arisen and led approximately 4.6 million citizens of that State to emigrate, more prominently to nearby countries. Considering that displaced Venezuelans tend to fall outside the scope of the 1951 Refugee Convention, the UNHCR has recommended that States should use the 1984 Cartagena Declaration criteria for refugee status determination (RSD) procedures. Despite incorporating that instrument's 'expanded' refugee definition in its domestic legislation, initially, Brazil opted to welcome displaced Venezuelans solely via temporary residence visas. However, since 2019, the country has started to recognize Venezuelans as refugees. This research will investigate which factors, actors, and conditions could have influenced the recent change in RSD practice in Brazil. Throughout the centuries, national governments were consolidated as the 'gatekeepers' of their territories, having the prerogative to determinate who and in which circumstances foreigners shall have access to their sovereign spaces. In recent decades, migration has emerged as a relevant subject in states' agendas. Despite the enactment of stricter entry policies in countries around the world, some states have aligned their prerogatives towards migration control with wider objectives, looking to attract high-skilled individuals to fill labor shortages or contribute with the development of strategic sectors and innovations. While Canada is known for welcoming migrants and highlighting the positive impacts newcomers have to its economy, China, known as a country of emigration, has also recently introduced policies for 'talented migrants'. The Cartagena Declaration (1984) was created to address the forced migration crisis of <b>U... more The Cartagena Declaration (1984) was created to address the forced migration crisis of <b>U </b>people fleeing non-democratic and dictatorial regimes in the Americas. While being innovative and having a humanitarian "spirit", the Declaration includes the existence of a massive violation of human rights between the motives for recognition of refugee status, which goes beyond the classic motives of persecution presented on the 1951 Convention. Thus, the Declaration created a shared refugee definition in the region and influenced changes in the way countries acted towards migratory flows. Therefore, in order to contribute to the current debate on migratory movements, this paper conducts a comparative study and analyses refugee legislation and policies in Brazil and Ecuador from the standpoint of the guidelines brought by the regional instrument. <br>

Os Direitos Humanos são princípios que orientam ou devem orientar as ações dos Estados, sociedade... more Os Direitos Humanos são princípios que orientam ou devem orientar as ações dos Estados, sociedades e indivíduos, porém, estes não possuem necessariamente o poder de configurar obrigações jurídicas. Bucci (2001) argumenta que para transformá-los de princípios em instrumentos com poder de regra, é necessário estabelecer políticas públicas para direitos humanos. Assim, este trabalho busca verificar a hipótese da autora através de um estudo de caso sobre o sistema de refúgio no Canadá a fim de observar os efeitos causados pela construção de uma política pública apropriada para abordar o problema em questão.
