Government of Bangladesh has almost completed a Strategic Environmental Assessment (SEA) of the S... more Government of Bangladesh has almost completed a Strategic Environmental Assessment (SEA) of the Sundarbans region to satisfy the UNESCO World Heritage Committee (WHC) requirement. We have contacted the SEA Team and offered our free legal services for the Project. The SEA Team rejected it on technical grounds stating, interalia, that "SEA has no legal standing and therefore does not require a legal review as such". We proceeded to review the documents nonetheless and found that the SEA does not consider the Constitutional mandate of "(P)rotection and improvement of environment and biodiversity" at Article 18A of The Constitution of the People's Republic of Bangladesh (Act No. of 1972), and many other legislation and national policies that regulate forest resources management in Bangladesh. In addition to the above, in our evaluation of the SEA documents, we have found that the SEA process is a violation of the Terms of Reference (ToR) of the SEA Project between the SEA Team and the Government of Bangladesh because although the Government engaged the Team in order to conduct as SEA, the Team turned that assessment into a 'development assessment'.

As of today over one million Rohingya people are living in exile in Bangladesh, among other count... more As of today over one million Rohingya people are living in exile in Bangladesh, among other countries. Their own country Myanmar does not recognise them as citizens and conducting a defacto, covert operation to cleanse their country of these Rohingyas. The State mechanism and the Bhuddist extremist organizations in Myanmar are driving them out of their country since the 1970s with expulsions becoming very large scale in this decade. The Rohingyas have been termed 'the most persecuted people on earth'. The argument against the Rohingyas is that they are not natural inhabitants of Myanmar and are migrants from the neighbouring Bangladesh and for that reason they must return to their 'homeland'. The Rohingyas do not accept this argument. They say that they are the natural inhabitants of Myanmar and living there for hundreds of years. The discourse of the Rohingyas pivoted on this question: whether or not the Rohingyas are natural inhabitants of Myanmar. If they are, Myanmar must accept them as citizens. Unfortunately, the history of the Rohingyas is not well documented and the policy makers are not taking the claim of the Rohingyas seriously for that reason. In this work we attempt to ascertain the evidence-based history of the Rohingyas and see if they are indeed natural inhabitants of the country now known as Myanmar.

This work endeavors to understand the historical and legal dimensions of the plight of the Rohingya people which is the worst atrocities against a people in modern times.

The history of the Bengali language is shrouded in obscurity. It is generally understood that the... more The history of the Bengali language is shrouded in obscurity. It is generally understood that the language is a corrupted version of the Sanskrit language. Charjyapod is claimed to be the earliest written example of the language. However, the Uria language of Indian state of Urishya also claims it to be the older version of Uria language. In fact except for the Charjyapod there is no written example of the Bengali language before the second millennium, perhaps 11th 12th century C.E. We understand that the state of the language as it were in the 7th to 11th century C.E. was not a corrupted version of the Sanskrit but was a separate, fully grown, independent language of the people of the land now known as the land of the Bangali people which absorbed elements of various neighboring cultures and languages into their own. We also understand that the history of the Bengali people and the culture was so far written, analyzed and commented upon by the Brahman intelligentsia of the bengali people who hail from the Aryan Sanskrit speaking invaders from the north. This history therefore, quite understandably, never showed any respect for any local culture and attempted to describe all local culture as derivatives of their own culture which they have always tried to impose upon the local people often by the use of brute force in order to perpetuate their hostile conquest of this gangetic lands.

In 2017 we have conducted a study of the surface water resources of the St. Martin's Island in th... more In 2017 we have conducted a study of the surface water resources of the St. Martin's Island in the Cox's Bazar district of SouthEastern Bangladesh. This small island is one of the most popular tourist destinations in Bangladesh, popular because of its pristine blue waters and the fact that it is the only coral island in the country. Hundreds of thousands of tourists visit the island every year during the winter season. Many hotels and other commercial tourist accommodation houses have been built. Water for Drinking and household use is drawn from the underground water storage through hand and motorised tube wells. There are a number of small ponds in the island but we have fund that they are mostly covered with water hyacinth (Eichornia crassipes) plants. People only use the ponds for washing their hands and feet for religious prayers. It is obvious to any observer that the ground water available in this very small island of only 3 km 2 area cannot support the hundreds of thousands of tourists visiting every year. The surface water needs to be utilised, the rain water need to be harvested and the pressure upon the groundwater reduced. In order to understand the situation of the water resources and the habits of the inhabitants of the island regarding their use of water, we have acquired video and still photographic images of the ponds and other surface waterbodies and interviewed inhabitants.

Evaluation of the Legal Regime of the Ecologically Critical Area Saint Martin's island, Bangladesh A Literature Review, 2017

This study attempts to understand the legal regime that was employed by the Government of Banglad... more This study attempts to understand the legal regime that was employed by the Government of Bangladesh in order to protect the small solitary coral island of Bangladesh located in it's south-east corner bordering Myanmar. I have visited the island in 2011, 2014 January and December, 2017 and in 2019 and recorded photographic evidence, video interviews of the residents and notes from my observations. The tiny island is one of the most visited tourist attractions in the country, with hundreds of thousands Bangladeshi visiting it each year. But there are new hotels and resorts being built every year. The island has few small ponds which are not utilized. Instead everybody extracts ground water for all uses which has severely deteriorated the ground water table of the island. Besides, human waste is contaminating the ground water. We propose to evaluate the existing legal regime for the governance of the ECA to assess their effectiveness in attaining the goals of Article 18A of the Constitution of the People's Republic of Bangladesh and Section 5 of the Environmental Conservation Act, 1995 (Act I of 1995) by utilizing field visits, literature reviews, and interviews.

The country they came in denies them. This is a story of the Rohingya refugees living in Kutupalong Refugee Camp in Cox's bazar District, Bangladesh. I have visited the Camp on 8th January 2017 and taken photos and videos of the situation there. This feature contains a harrowing tale of the miseries the Rohingya people going through even inside Bangladesh. Nobody knows how many of them are in Bangladesh, because nobody went to register or count them. Nobody knows how they are doing, because nobody went there to ask them. This is my personal attempt to tell the stories of this most unfortunate people of our time. Their own country rejects them. The country they came in denies them.

In this study we therefore shall attempt to see through our study of the laws regulating the workers employment and industrial relations whether the guarantee states in the State Policy and the fundamental right provision to provide right to association to the toiling mass of workers has been reflected in the legislations enacted by the State.

Water Management Organization (WMO) is an elusive matter in Bangladesh’s water governance regime,... more Water Management Organization (WMO) is an elusive matter in Bangladesh’s water governance regime, for it was born without a legislation bringing it out to this world. An anomaly in that legal device such as any organization or an authority is created by the authority provided in a Legislation. But in this case, we hear the Government states that it will provide the legal framework needed for the WMOs, which are already in place. How and when it came into being? Who authorized its creation? Did the Parliament, the Constitutional body empowered to enact legislation and create such legal organizations and authorities, authorize it? There is no information available anywhere and the guideline itself speaks nothing regarding that. Most reputed practitioners of water management in Bangladesh may not ever have heard of the WMO; no legislation ever spoke of it . The complete body of this elusive legal being was first time disclosed in this equally confusing document, called the Guideline for Participatory Water Management. Called only a Guideline, not a legislation, neither a policy - but the authorities put on it the entire responsibility of “the Government’s commitment to ensure participatory water management in Bangladesh” within the “framework of the National Water Policy” . In this examination, we shall evaluate the legal status, objectives and legitimacy of this Guideline that created the WMOs in Bangladesh.

As of today over one million Rohingya people are living in exile in Bangladesh, among other count... more As of today over one million Rohingya people are living in exile in Bangladesh, among other countries. Their own country Myanmar does not recognise them as citizens and conducting a defacto, covert operation to cleanse their country of these Rohingyas. The State mechanism and the Bhuddist extremist organizations in Myanmar are driving them out of their country since the 1970s with expulsions becoming very large scale in this decade. The Rohingyas have been termed 'the most persecuted people on earth'. The argument against the Rohingyas is that they are not natural inhabitants of Myanmar and are migrants from the neighbouring Bangladesh and for that reason they must return to their 'homeland'. The Rohingyas do not accept this argument. They say that they are the natural inhabitants of Myanmar and living there for hundreds of years. The discourse of the Rohingyas pivoted on this question: whether or not the Rohingyas are natural inhabitants of Myanmar. If they are, Myanmar must accept them as citizens. Unfortunately, the history of the Rohingyas is not well documented and the policy makers are not taking the claim of the Rohingyas seriously for that reason. In this work we attempt to ascertain the evidence-based history of the Rohingyas and see if they are indeed natural inhabitants of the country now known as Myanmar.

The history of the Bengali language is shrouded in obscurity. It is generally understood that the... more The history of the Bengali language is shrouded in obscurity. It is generally understood that the language is a corrupted version of the Sanskrit language. Charjyapod is claimed to be the earliest written example of the language. However, the Uria language of Indian state of Urishya also claims it to be the older version of Uria language. In fact except for the Charjyapod there is no written example of the Bengali language before the second millennium, perhaps 11th 12th century C.E. We understand that the state of the language as it were in the 7th to 11th century C.E. was not a corrupted version of the Sanskrit but was a separate, fully grown, independent language of the people of the land now known as the land of the Bangali people which absorbed elements of various neighboring cultures and languages into their own. We also understand that the history of the Bengali people and the culture was so far written, analyzed and commented upon by the Brahman intelligentsia of the bengali people who hail from the Aryan Sanskrit speaking invaders from the north. This history therefore, quite understandably, never showed any respect for any local culture and attempted to describe all local culture as derivatives of their own culture which they have always tried to impose upon the local people often by the use of brute force in order to perpetuate their hostile conquest of this gangetic lands.

In 2017 we have conducted a study of the surface water resources of the St. Martin's Island in th... more In 2017 we have conducted a study of the surface water resources of the St. Martin's Island in the Cox's Bazar district of SouthEastern Bangladesh. This small island is one of the most popular tourist destinations in Bangladesh, popular because of its pristine blue waters and the fact that it is the only coral island in the country. Hundreds of thousands of tourists visit the island every year during the winter season. Many hotels and other commercial tourist accommodation houses have been built. Water for Drinking and household use is drawn from the underground water storage through hand and motorised tube wells. There are a number of small ponds in the island but we have fund that they are mostly covered with water hyacinth (Eichornia crassipes) plants. People only use the ponds for washing their hands and feet for religious prayers. It is obvious to any observer that the ground water available in this very small island of only 3 km 2 area cannot support the hundreds of thousands of tourists visiting every year. The surface water needs to be utilised, the rain water need to be harvested and the pressure upon the groundwater reduced. In order to understand the situation of the water resources and the habits of the inhabitants of the island regarding their use of water, we have acquired video and still photographic images of the ponds and other surface waterbodies and interviewed inhabitants.

This study attempts to understand the legal regime that was employed by the Government of Banglad... more This study attempts to understand the legal regime that was employed by the Government of Bangladesh in order to protect the small solitary coral island of Bangladesh located in it's south-east corner bordering Myanmar. I have visited the island in 2011, 2014 January and December, 2017 and in 2019 and recorded photographic evidence, video interviews of the residents and notes from my observations. The tiny island is one of the most visited tourist attractions in the country, with hundreds of thousands Bangladeshi visiting it each year. But there are new hotels and resorts being built every year. The island has few small ponds which are not utilized. Instead everybody extracts ground water for all uses which has severely deteriorated the ground water table of the island. Besides, human waste is contaminating the ground water. We propose to evaluate the existing legal regime for the governance of the ECA to assess their effectiveness in attaining the goals of Article 18A of the Constitution of the People's Republic of Bangladesh and Section 5 of the Environmental Conservation Act, 1995 (Act I of 1995) by utilizing field visits, literature reviews, and interviews.

I have visited the Camp on 8th January 2017 and taken photos and videos of the situation there. This feature contains a harrowing tale of the miseries the Rohingya people going through even inside Bangladesh. Nobody knows how many of them are in Bangladesh, because nobody went to register or count them. Nobody knows how they are doing, because nobody went there to ask them. This is my personal attempt to tell the stories of this most unfortunate people of our time. Their own country rejects them. The country they came in denies them.

Water Management Organization (WMO) is an elusive matter in Bangladesh’s water governance regime,... more Water Management Organization (WMO) is an elusive matter in Bangladesh’s water governance regime, for it was born without a legislation bringing it out to this world. An anomaly in that legal device such as any organization or an authority is created by the authority provided in a Legislation. But in this case, we hear the Government states that it will provide the legal framework needed for the WMOs, which are already in place. How and when it came into being? Who authorized its creation? Did the Parliament, the Constitutional body empowered to enact legislation and create such legal organizations and authorities, authorize it? There is no information available anywhere and the guideline itself speaks nothing regarding that. Most reputed practitioners of water management in Bangladesh may not ever have heard of the WMO; no legislation ever spoke of it . The complete body of this elusive legal being was first time disclosed in this equally confusing document, called the Guideline for Participatory Water Management. Called only a Guideline, not a legislation, neither a policy - but the authorities put on it the entire responsibility of “the Government’s commitment to ensure participatory water management in Bangladesh” within the “framework of the National Water Policy” . In this examination, we shall evaluate the legal status, objectives and legitimacy of this Guideline that created the WMOs in Bangladesh.

Government of Bangladesh has almost completed a Strategic Environmental Assessment (SEA) of the S... more Government of Bangladesh has almost completed a Strategic Environmental Assessment (SEA) of the Sundarbans region to satisfy the UNESCO World Heritage Committee (WHC) requirement. We have contacted the SEA Team and offered our free legal services for the Project. The SEA Team rejected it on technical grounds stating, interalia, that "SEA has no legal standing and therefore does not require a legal review as such". We proceeded to review the documents nonetheless and found that the SEA does not consider the Constitutional mandate of "(P)rotection and improvement of environment and biodiversity" at Article 18A of The Constitution of the People's Republic of Bangladesh (Act No. of 1972), and many other legislation and national policies that regulate forest resources management in Bangladesh. In addition to the above, in our evaluation of the SEA documents, we have found that the SEA process is a violation of the Terms of Reference (ToR) of the SEA Project between the SEA Team and the Government of Bangladesh because although the Government engaged the Team in order to conduct as SEA, the Team turned that assessment into a 'development assessment'.

Hadith are the practices performed and ordained by the Prophet (SA) that a Muslim must follow in fulfilment of his religious obligations. In the corpus of Muslim laws, the hadith stands right after the Quran Majid - the words of Allah Rabbul Alamin, as the second most important source of Islamic laws. However, there are significant differences of opinion among the Muslim regarding the authenticity of a great number of hadith. There are perhaps even more differences regarding the application of these hadith in today’s world after fourteen hundred years of their pronouncement. As a result a Muslim is unsure and often embattled on what he should practice as his religious duty. This has caused significant rifts among the Muslim society throughout the world. It is therefore necessary to precisely determine the scope, breadth and methods of the Hadith in order to enable the Muslim to determine the role of the Hadith and its application in today’s world. As the first part the project we are here preparing a bibliography of the works in English Language.

The 14th Century Arab traveller Ibn Battuta took a very long detour from his journey to China, to... more The 14th Century Arab traveller Ibn Battuta took a very long detour from his journey to China, to meet a Sufi Dervish in Kamrup, Bengal, the present day Sylhet in Bangladesh, named “Shaikh Jalal-ud-din of Tabriz”. But the Dervish at the dargah in Sylhet today is locally known simply as Hazrat Shah Jalal (RA), while a Dervish named Shah Jalal Tabrizi (RA), the location of whose tomb remain uncertain to this date, has his Khanaka in Pandua, West Bengal. The only two inscriptions from the 16th century that mentions the Dervish refer the dervish at Sylhet as ‘Kanyee’ or ‘Kunyayi’ and ‘Mujarrad’; not Tabriji. In addition to the above there were three Sufis in Bengal with the name ‘Jalal’ loosely in that period of the history of Bengal. Could it be that the dargah at Sylhet is indeed of Shah Jalal Tabrizi (RA) as Ibn Battuta reported, could it also be that he is a second Dervish Shah Jalal (RA) in Bengal originating in Tabriz, or could it be that there is only one Shah Jalal Tabrizi (RA), the one of Pandua, and he is the one who is buried at the dargah at Sylhet as many scholars hypothesised, compelled only by Ibn Battuta’s irrefutable remark, or could he be a different dervish Shah Jalal (RA) who is not Tabriji, and rather either from Konya, Turkestan or Yemen as some suggest? In this work, if Allah Subhanahu Tayala wishes, we wish to examine the evidence available and discover the true account of the Dervish at Sylhet Dargah. We want to know who this Dervish really is.

Under these circumstances, we have examined the Bangladesh forest policy framework focusing on three broad aspects: the manner of adopting the policy; the manner of its notification after adoption; and the content of the policy.

According to a news report (BBC.com, 1 January 2002) only the inhabitants of the Dhaka city disca... more According to a news report (BBC.com, 1 January 2002) only the inhabitants of the Dhaka city discarded 1 crore or 10 million polythene shopping bags. During the 1998 great flood the City of Dhaka suffered from water logging for two continuous months. The polythene bags were blamed for clogging the drains of the city and causing these water logging. In 2002 the Government finally prohibited the use of certain types of polythene bags. However, the usefulness of the polythene bags in shopping activities of fish, vegetable and other wet products and the absence of any other equally effective alternative meant that the people were still willing to use that when the shopkeepers were secretly using them. This resulted in a general violation of the law all over the country. Despite the occasional Government attempts to capture the producers and sellers of polythene bags, shoppers all over the country were using these bags in slightly smaller sizes. This paper identifies these factual realities and the reasons for the failure of the law and also suggests measures for the improvement of the situation.
