The methodology applied in this paper is Documentary Review thus analysis of legislation, Textbooks and Articles. The study recommends several amendments to some laws which poses challenges to Mode of Finance in Islamic Banking and suggest for establishment of Central shariah advisory Board.

first part introduces and lays a foundation for understanding Tanzanian criminal law. It
focuses on the meaning of crime and criminal law vis-à-vis civil wrong and civil law, sources
of the Tanzanian criminal law, the origin of criminal law and related justice systems as legal
transplants of the colonial State, the criminal law in the post-independence era, and a
snapshot view of the Tanzanian criminal procedure. The second part discusses the general
principles of criminal law. It revolves around key aspects such as unlawful conduct,
criminal capacity, fault, degrees of participation in crime, and incomplete crimes. The third
part classifies crimes into five groups and analyses them. These include crimes against
human life, the person and the family, property crimes, crimes against the community,
crimes against the State and administration of justice, and organised and commercial
crimes. The last part is a snapshot of international criminal law from the Tanzanian
perspective.

Procedure 1-where defendant elects not to call evidence The Plaintiff or advocate makes an opening speech referred to sometimes as an opening statement. After that the plaintiff witnesses are called, examined cross examined and reexamined. After that the plaintiff or his advocate sums up the case by making a closing speech. After that the Defendant states their case and makes a closing speech. Procedure 2-Defense elects to call evidence Advocates for the plaintiff makes an opening statement, the plaintiff witnesses are called, examined, cross-examined and reexamined. After that the defendant's counsel makes an opening statement. After that the defendant's witnesses are called, examined, cross examined and reexamined. After the Plaintiff or his advocate sums up the case by making the closing speech. Thereafter the defendant sums up the case and makes a closing speech also. The Defendant can reply to the plaintiff's closing. The reply only covers new ground. In cases where there are many defendants and many plaintiffs the same procedure will apply but if the defendants are represented separately, then the counsels will separately make their submissions separately by order of appearance. Cross examination of witness will also follow the order in which they proceed. Co-plaintiffs will normally be represented by the same counsel.

The aim of this study was to examine whether the Law of Marriage Act is equitable in claim of dam... more The aim of this study was to examine whether the Law of Marriage Act is equitable in claim of damages resulting from breach of promise to marry in Tanzania, with a view of examining the proper application of the section 71 of LMA and the challenges there upon. The Study was crucial since there is no marriage in Tanzania passes direct without pre marriage contract. In line with that, the Law of Marriage Act provides that where the breach of promise occurs the innocent party has right to bring the claim before the Court for claiming the gifts and other actual loss he suffered during the subsisting of pre-marriage contract. The challenge which is imposed to this Act (LMA) is the damages are only limited to actual loss and to specific damages.
Through most of the respondents wanted the provision relating to promise to marry to be amended to meet the current standard of the current situation of life. The analysis of this research reveal that the provision of section 69, 70 and 71 need to be amended as they poses number of lacunae starting from what amount to promise to marry and the psychological or emotional affection since many people suffer emotional as due to the love being the emotional thing. Therefore the study recommend that, possible amendment of the LMA is to be issued in order to come with strong provision to curb the issue of emotional affection as the study draws a lesson from different countries like Kenya and India and lastly, education concerning matrimonial issues should be given regular in order the community members to gain much knowledge on their matter.

Ufafanuzi huu umejikita kuelezea dhana ya Plea Bargaining (Makubaliano ya Kukiri Kosa). Sababu ya ufafanuzi huu ni kuelimisha umma kuhusu dhana hii mpya katika mfumo wa utoaji haki nchini Tanzania.
