La sociologie du droit, celle des professions et la sociologie politique n'ont que rarement d... more La sociologie du droit, celle des professions et la sociologie politique n'ont que rarement des vues identiques sur les processus de modification des normes legales. Cet article suggere de prendre en consideration non seulement la notion de propriete mais aussi celle de domaine legal de competence (jurisdictional rights), pour assurer l'articulation de ces differentes perspectives et fournir une meilleure interpretation du changement juridique dans les matieres ou la redistribution de la propriete est en jeu. A partir d'une presentation des reformes de 1986 en Grande-Bretagne (Insolvency Act) et de 1978 aux Etats-Unis (Bankruptcy Code), les auteurs degagent quatre types d'evolution : renforcement du role des juges (aux Etats-Unis) ou de celui des specialistes de la faillite (en Grande-Bretagne), pour ce qui concerne les affaires de grande ampleur ; prise en charge de la gestion des faillites par l'administration (aux Etats-Unis) ou au contraire privatisation (en Grande-Bretagne), s'agissant des affaires de moindre importance. ; Selon les auteurs : (1) les transformations du droit generent des luttes de competence entre les professions et ces luttes ont un impact en retour sur le changement tant juridique qu'administratif ; (2) dans les politiques contemporaines, un conflit-cle porte frequemment sur la repartition des competences a la frontiere du prive et du public, les luttes entre corps professionnels ayant moins pour objet le partage d'un marche existant que le developpement ou encore la contraction du marche lui-meme ; (3) sur le fond, les reformes du droit sont la resultante des forces politiques en presence, comprenant aussi bien la politique des partis proprement dits et celle des professions que des circonstances politiques fortuites, avec des resultats qui n'ont pas grand-chose a voir avec les merites intrinseques des textes legaux eux-memes.

The experience of the Republic of Korea with insolvency reforms provides a lens through which we may discern wider reform efforts in Asia. This article reflects on factors which influence the success of law reforms and on their implications for continuing reform efforts.

Corporate bankruptcy is a defining characteristic of the market economy. It encapsulates the fund... more Corporate bankruptcy is a defining characteristic of the market economy. It encapsulates the fundamental conflicts between capital and labour, owners and managers, debtors and creditors, the state and the market. Yet, with one or two notable exceptions, the political and social dynamics of bankruptcy law and practice have been overlooked by serious socio-legal scholars. This book remedies that neglect. Adopting an approach that compares English and American law, the authors identify the underlying political forces that established corporate bankruptcy law on both sides of the Atlantic. The book demonstrates how, by a recursive loop of professional self-interest, corporate insovency regulation is the creation of the lawyers who interpret and administer it. This book will be welcomed as an important sociological study and advances our understanding of how substantive law results from conflicts among the professionals who help to create it.
