This study concerns on the Draft Act on Family Foundations. This draft law is still in the course... more This study concerns on the Draft Act on Family Foundations. This draft law is still in the course of legislative works, but it constitutes the basis for a lively discussion in Poland on its final structure. This paper presents the general concept of regulating family foundations in Poland with the most important aspects of the private-legal structure. The model relating to tax solutions remains beyond the scope of this text. The Bill on Family Foundations has a symbolic dimension, because if the legislator intends to implement it, it means that the development of economic relations in Poland has reached an appropriate high level.

Summary The study discusses new legislative anti – crisis solutions adopted in Poland in connecti... more Summary The study discusses new legislative anti – crisis solutions adopted in Poland in connection with the COVID – 19 pandemic. The Polish legislator decided to introduce the so-called simplified restructuring procedure. This happened in the face of the expectations of both the jurisprudence of law and practice. On the one hand, the simplified restructuring procedure (the fifth independent type of restructuring procedure for an entrepreneur in Poland) allows for a quick, cheap and simplified conclusion of an arrangement with creditors outside the court, then approved by the court. On the other hand, the opening of such proceedings gives the debtor protection against enforcement at the creditor‘s request and against bankruptcy at the creditor‘s request. This procedure can be a testing ground for the concept of informalisation and acceleration of restructuring procedures.
Rapid diagnosis of the risk of an entrepreneur’s insolvency is of great importance for the socio-... more Rapid diagnosis of the risk of an entrepreneur’s insolvency is of great importance for the socio-economic environment. This issue is of particular importance in the context of the financial crisis caused by the COVID-19 pandemic. The insolvency resulting in the announced bankruptcy brings a lot of harm to the debtors themselves (their shareholders), creditors and the entire economy. A much better solution is the restructuring of the debtor. For the purposes of predicting insolvency can be used Artificial Intelligence although traditional methods are also in use. For these reasons, in European Union law, the Restructuring Directive focuses on the anticipation of debtor’s insolvency. The text refers to possible directions for the implementation of the directive in national laws. The aim of the study is to analyze the available methods of early warning against insolvency. As a result of the research, the ways of implementing the Directive were proposed.

This study concerns the issues of league regulations related to the legal problem of insolvency o... more This study concerns the issues of league regulations related to the legal problem of insolvency of football clubs in the context of licenses to participate in competitions. The study presents a brief description of modern European football, including the phenomenon of financial oligarchization of sport, and uneven redistribution of the benefits of sport. The following section presents the relation between lex sportiva and state law; the legal position and importance of UEFA; licensing system rules for participating in games. Particular attention was paid to regulating the impact of participation in proceedings giving protection against creditors on obtaining and maintaining a license. Attributes of proceedings in case of threat of insolvency and insolvency are presented as well. Finally, there is presented an example of national regulation which is in force in Poland (a Member State of the European Union).The final conclusion is a recommendation for a strategic change in the licensi...

This study has been devoted to selected issues of assistance in causing damage and morespecifical... more This study has been devoted to selected issues of assistance in causing damage and morespecifically to the issue of the premises of liability for damages of a helper under Polish civil law.There is an important dispute in the Polish doctrine of law and in judicial practice as well, whether itis possible to accept liability for damages of the helper in the absence of his intentional fault. Thework was prepared using a formal and dogmatic method. Under Polish tort law responsibility foraiding and abetting a damage requires the helper’s intentional fault. The paper could be useful foracademics and researchers dealing with the comparative tort law. The study raises arguments for thethesis that the sine qua non premise of a helper’s civil responsibility is intentional fault. The studypresents a critical analysis of the views of doctrine and case law.
