What is a "Dedication" in the specialization of Midstream Oil & Gas Procedure?; Wha... more What is a "Dedication" in the specialization of Midstream Oil & Gas Procedure?; What is a "Covenant Running with the Land?"; What is required to create a covenant running with the land?; Are the Rights granted under an Oil and Gas Lease sufficient to allow a producer to create a Covenant Running with the Land, in favour of a Midstream Company?; Can a Dedication be structured as a covenant running with the land? If so, how? The modern concepts in the Oil & Gas Midstream Procedure needs the above questions answered satisfactorily. This work attempts to answer these questions, using the legal positions on Dedication, on Covenants that Run with the Land. This work uses the legal positions in Oklahoma and Texas jurisdictions as examples. Other persuasive jurisdictions have also been used here in comparison.

The question this work attempts to answer is, whether a single, Unified and Coordinated National ... more The question this work attempts to answer is, whether a single, Unified and Coordinated National Energy Policy would serve a better purpose or, having every state in the United States regulating its own regional energy policy, is the best economic and environmental way to regulate energy? The North Carolina Energy Policy Act created the Energy Policy Council, within Their Department of Commerce, to advise and make recommendations on Energy Policy to the State Governor and the North Carolina General Assembly and to serve as the state's central energy policy planning body. Here we see that the State of North Carolina regulating its own. Many states in the country are doing the same. This is not unusual as this work will show. Cases have been made for, and against a single, unified, nationally coordinated energy policy, as this work will show. What are the challenges we face in this quest for a nationally unified energy policy? What is the place for renewable energy sources? Does the United States give fossil fuel energy sources and industry preferential treatment, as we have seen here during the George W. Bush Administration, at the expense of the renewable energy sources? This work attempts to answer the above questions. This work can be of interest to Energy Lawyers, Oil & Gas Lawyers, Renewable energy industry management and personnel, Energy Law and Management students, Energy Law Professors, and Energy Law Students alike.

The United States is still searching for a nationally unifying energy policy regime. Whether this... more The United States is still searching for a nationally unifying energy policy regime. Whether this can be contemplated at a national federal level is yet to be seen. The Obama administration ushered in an attempt at liberating the United States' dependence on foreign energy resources. But Obama inherited responsibilities from an administration that was in, waist-deep, in giving the fossil energy industry the upper hand at the preference of the renewable energy industry. This favoritism on fossil fuel sources, from the previous administration, also drove the country into dependence on foreign fossil resources. Can the present administration untangle the country from this wrangle? In the competition between the fossil energy sources and renewables, how long can we wait before renewables gain the competing edge? This work dives head long into this energy debate.

Wind Law is a relatively new subject area specialization here in the United States, and around th... more Wind Law is a relatively new subject area specialization here in the United States, and around the world. The State of Oklahoma, is the second windiest place in the United States, after Texas. This essay brings into light how the wind business regulated in Oklahoma, by attempts to look at the short comings of the newly amended "Oklahoma Wind Energy Development Act." We attempts here to delve into questions the Act has no answers for. This essay also looks at causes of actions, defenses, and remedies that may arise in the use of Wind Turbine business, from both the plaintiffs' and defendants' views; we deal with the questions on "setbacks," the distances set between the wind turbine and other human habitable facilities like homes, schools, airports, and hospitals. The wind turbine interference of airports' equipment (radars) and what the next generation of radars and wind turbines will do, have been explained here. While this essay may be of interest to those studying Wind Law, wind developers and researchers, town and zoning planners, renewable energy enthusiasts, will equally be of interest in this discussion.

Whether it succeeds to bring all its energy sources under a uniform regulated national regime, it remains to be seen. But can we even debate this question in an environment where fossil resource dependence had created a preferential treatment over renewables? The Bush administration ushered in this upper hand preference on the fossil industry, over renewables. The Bush era officials, many of them petroleum enthusiasts themselves can be thought to be responsible for the less growth, and the inability to promote renewables. But the Obama administration came to break the country from this foreign oil dependence.
But how long will it take before renewables can contribute and compete, while it finds itself in the infancy it is still in?
This debate dives deep into this discussion.

Given that the Wind Turbine business is a new business activity here in the United States, and indeed the world, the way Wind Energy is regulated in Oklahoma, and the United States has had no answers to many legal questions that may arise, relying heavily on the literature in Oil & Gas Law. in Criticizing the newly amended "Oklahoma Wind Energy Development Act", this work tries to point out some of those loopholes the act does not cover, as well as potential causes of action that may arise, as well as suggest and explains defenses and remedies that plaintiffs' and defendants my have available.
