Following many years of structural adjustment programmes, the last decades of the 20 century saw ... more Following many years of structural adjustment programmes, the last decades of the 20 century saw drastic reductions in the public health resources of developing countries. The failures of the liberal policies then promoted, alongside the emergence of the AIDS pandemic, gave rise to new public health practices and instruments under the “Global Health Initiative”. Among these, Product Development Partnerships (PDPs) dedicated for developing and delivering new health technologies for neglected diseases, emerged in association with the Millennium Development Goals adopted by the United Nations in 2000 to meet the needs of the world’s poorest populations. Along with these practices came novel conceptualisations. L’objet de cet article est, a partir d’une reflexion sur le cas de l’entreprise Nutri’zaza, de s’... more L’objet de cet article est, a partir d’une reflexion sur le cas de l’entreprise Nutri’zaza, de s’interroger si et dans quelle mesure, certaines innovations institutionnelles en matiere de contrat de societe – et donc du statut de l’entreprise – peuvent se montrer appropriees a la satisfaction du bien commun. Apres avoir rappele le contexte et les origines du projet, l’entreprise Nutri’zaza et ce qu’elle signifie sont analyses. La conclusion est consacree aux enseignements qui peuvent etre tires du cas presente et s’efforce de repondre a la question posee de la relation entre le vehicule que constitue Nutri’zaza et la poursuite du bien commun.

This article critically examines the concepts of the commons and the public domain as developed i... more This article critically examines the concepts of the commons and the public domain as developed in the literature on law and economics, and in the legal literature on intellectual property. It aims to accomplish two things: reviewing the literature laying out diverse meanings associated with these terms and reintroducing them into radical political economy. The study of the commons and the public domain have long been neglected in the area of radical political economy, and the way these concepts have been developed in the literature reviewed is only marginally relevant to problems and methods of political economy. This article argues for a reassessment and redefinition of the commons and the public domain from the standpoint of radical political economy, and proposes a research agenda for the commons.

artículo dE invEstigación Utilidad del calcio coronario en la evaluación previa a cirugía cardiac... more artículo dE invEstigación Utilidad del calcio coronario en la evaluación previa a cirugía cardiaca valvular RESUMEN Antecedentes: aunque el calcio coronario tiene valor pronóstico en la población general, en los pacientes que serán operados por enfermedad cardiaca valvular no se conoce su verdadera utilidad. Objetivo: determinar la utilidad del calcio coronario en la evaluación previa a la cirugía cardiaca valvular. Material y métodos: estudio de cohorte dinámica que incluyó pacientes mayores de 35 años de edad, de género indistinto, con enfermedad valvular quirúrgica evaluados entre marzo de 2010 y julio de 2013 en el Instituto Nacional de Cardiología Ignacio Chávez. Se les practicaron medición de calcio y angiotomografía coronaria como parte de su evaluación previa a la cirugía. A los pacientes con lesiones coronarias obstructivas (estenosis ≥ 50%) se les efectuó coronariografía invasiva. Resultados: se incluyeron, prospectivamente, 115 pacientes con edad promedio de 54.5 ± 11.4 años. Se observó baja prevalencia de factores de riesgo cardiovascular y predominio de etiología aórtica. El calcio coronario fue menor de 100 unidades Agatston (UA), riesgo cardiovascular bajo, en 90% de la población, lo mismo que la prevalencia de lesiones coronarias obstructivas (10%). El punto de corte de 120 UA mostró ABC = 0.95 para predecir lesiones coronarias significativas. La necesidad de coronariografía invasiva y revascularización fue mayor en el grupo con calcio coronario ≥ 120 UA (p < 0.001). Conclusión: en la evaluación previa a la cirugía cardiaca valvular un puntaje de calcio coronario ≥ 120 UA se asocia con mayor probabilidad de requerir coronariografía invasiva o revascularización; es, por lo tanto, un parámetro útil para decidir continuar con la angiotomografía o referir al paciente directamente a coronariografía. Esto podría significar menores costos y menos exposición a radiación ionizante y a medios de contraste.

La thèse centrale défendue est qu'à travers les privatisations et l'installation des nouvelles et multiples régulations et règlementations qui ont permis l'installation du pouvoir de la finance, l'économie française a perdu son mode central de coordination des agents. Celui-ci qui traditionnellement se faisait à partir d'un large parc industriel et financier public servant de support à une politique industrielle centrée sur les le lancement régulier de « grands projets », a aujourd'hui perdu ses conditions de possibilité.

The production-innovation system of medical inputs to the health system has been increasing its c... more The production-innovation system of medical inputs to the health system has been increasing its capacity of technological innovation during the last decades, especially in developed countries. However, the use of those technologies by the health system is not always carried out in an efficient and effective way. The biggest problem is that they raise costs, but not the population access to the health system. The aim of this paper is to describe the Brazilian regulatory regime of technology incorporation and to analyze its problems and inequities due to its asymmetries in the production-innovation system. A setting of supply and demand existing in the health system and the production-innovation of medical inputs will also be drawn. The case will be focused on the drug supply and incorporation to the Brazilian STD/Aids Program. The results show that the methods of incorporation of technologies as inputs to the health system vary among countries. In Brazil, the problems related to technology incorporation are even more serious because the regulatory regime to the diffusion of technology is not well designed.

Tal análise busca identificar as relações entre estas competências e capacitações e as várias formas de conhecimento incorporado nas organizações. Em segundo lugar, o artigo compara a visão da firma centrada sobre as capacitações (visão baseada em recursos) com outras abordagens – que incluem a abordagem tradicional da teoria do agente principal e a economia dos custos de transação. Finalmente, são apresentadas algumas implicações de política.

The purpose of the paper is twofold i) describe the dramatic changes that have occurred in the Un... more The purpose of the paper is twofold i) describe the dramatic changes that have occurred in the United States, in the system of IPR's since the 1980's, ii) to question its meaning and its long- term sustainability. The paper first presents the continued extension of the domain of patentability to living entities, computer programs and business models. He insists on the concomitant changes which affected jurisprudence on the relaxation of the criteria patentability and on the hardening of penalties pronouncements against the imitators. On this basis the main features of the new regime which settled down in the USA are presented. Finally, in light of recent evolutions, the paper wonders on the long-term sustainability of such a regime.

During the Covid 19 Pandemic, there have been countless calls for the creation of “global public ... more During the Covid 19 Pandemic, there have been countless calls for the creation of “global public goods” or “global commons” issued by a variety of actors with sometimes diametrically opposed views, as if the two notions had the same meaning.

And indeed, even today these notions are still often used as synonyms and interchangeable, leading to an amalgamation of concepts. The meaning and implications of using one notion or other notion (global public good, global commons) is never examined.

We believe that, contrary to the dominant view, it is urgent to put an end to this confusion which is not only of a semantic order and has huge economic and social implications.

In this article, we start by recalling what constitutes the notion of “Global Public Good” and by extension the content of what can be called the GPG approach (section 1). Then, by difference we present the notion of common good and the commons based approach (section 2). Finally, in a concluding section, we present some of the most significant initiatives taken during the covid-19 pandemic, designed and deployed to producing and distributing health products as common goods (section 3). Our overall ambition being to highlight that the deployment of the commons based approach that we are calling for, is not a utopia, as it is already moving on.
