The European vision of a digital ecosystem of trust rests on innovation, powerful technological s... more The European vision of a digital ecosystem of trust rests on innovation, powerful technological solutions, a comprehensive regulatory framework and respect for the core values and principles of ethics. Innovation in the digital domain strongly relies on data, as has become obvious during the current pandemic. Successful data science, especially where health data are concerned, necessitates establishing a framework where data subjects can feel safe to share their data. In this paper, methods for facilitating data sharing, privacy-preserving technologies, decentralization, data altruism, as well as the interplay between the Data Governance Act and the GDPR, are presented and discussed by reference to use cases from the largest pan-European social science data research project, SoBigData++. A differentiation of research-based data protection regimes is proposed in light of the distincti... more A differentiation of research-based data protection regimes is proposed in light of the distinction between merely for profit and public interest-oriented research. This would support a differentiated level of data subjects’ control prerogatives and data controllers’ mobilization ease. The article demonstrates how the existence of differential data protection regimes in EU data protection law has a corresponding differentiated impact enabling data sharing practices of personal data and in particular of special categories of data. Differentiated data protection regimes impact differently on contractual freedom to share and aggregate personal data, which is the primary pillar of the creation of “common data spaces” under the latest European strategy for data and under the Data Governance Act.

La responsabilidad civil ha recibido un tratamiento exhaustivo desde el punto legal y jurispruden... more La responsabilidad civil ha recibido un tratamiento exhaustivo desde el punto legal y jurisprudencial respecto a las diversas categorías que la integran, bien sean estas de carácter precontractual, contractual, post-contractual o extracontractual, y en relación con la responsabilidad civil extracontractual, respecto a la voluntariedad que le asiste al autor del daño, es posible identificar lo que tradicionalmente se conoce como responsabilidad subjetiva, derivada de la culpa, de cuyo contenido se ocupa el artículo 2341 del Código Civil colombiano y por otra parte, el de la responsabilidad objetiva, que proviene del despliegue de actividades peligrosas, en los términos del artículo 2356, no obstante que, en este último evento, persiste la idea de darle un alcance diferencial, lo que genera cierto grado de perplejidad por la ausencia de unanimidad en torno a la adecuada categorización del presupuesto sobre el cual se funda la responsabilidad allí prevista, puesto que ésta ha oscilado entre la denominada presunción de responsabilidad, la presunción de culpabilidad y más recientemente, en la denominada responsabilidad objetiva; posturas que muy a pesar de contar con una argumentación diferencial en su contenido, a la postre pareciera ser que llevan al mismo resultado y que se traduce 52 PRIVADO 18 La modernización de las instituciones del derecho civil en eximir de la carga de la prueba a quien padeció el daño irrogado con motivo del despliegue de la actividad, para que sea el que la ejecuta, el llamado a acreditar el motivo de exculpación, y para comprenderlo, se hará una aproximación jurisprudencial a dicho tratamiento. So much and rightly has been written in these days about strategic errors of the past, and authoritarian and social control risks exploiting the fear of contagion to further compress individual freedoms. A lot has been said about the futility of privacy as well. But is there a democratic way that respects fundamental rights in an emergency? Is there a model that can turn respect for democratic freedoms into a tool for effective common struggle in an emergency?

Questi spazi si pongono al croceviatra innovazione aperta ed economia collaborativa, potendo contribuire significativamente allo sviluppo cittadino e delle comunita locali. L’interrogativo principale consiste nel comprendere come la crescita di queste realta possa conciliarsi con il rispetto della vigente disciplina nazionale e sovranazionale della proprieta intellettuale, messa alla prova dall’avvento della stampa 3d.
