Hello! This is yukibuns/yukihomu/storybuns. These rules apply to anyone purchasing my products or services.

(083021) Some small edits, also an added payment method. Notes on commercial streaming goods!

If caught flouting these terms you will be warned and unable to purchase from me for a period of time (determined by the offense). Bans may be permanent.

I have a private blacklist and list of warned users if anyone is wary before transactions. Names may be made public at any time.

YUKIBUNS TERMS OF SERVICE

ADOPTABLE PAYMENT + PLANS

• Payment is taken in USD. This will be through paypal invoice or stripe via credit card.
• Please check with me before end time if needing a payment plan.
• Payment should be within 24 hours, but it can be negotiated. I am comfortable if communication is clear.
• I can negotiate payment plans over $350 with $150 down. This must be cleared with me before purchase is confirmed. Timeframe of payment plans should be 4 weeks maximum.
• If you have outstanding payments with me you cannot make any further purchases until it is cleared.
• You will not receive the full files until the full balance is paid.

OWNING A DESIGN

• When you have purchased a character from me, they belong to you. You may use them for whatever you wish, such as for RP purposes.
• There is no set gender, history or personality, and you do not have to use my canons for specific closed species. It is a personal preference that if a character is gendered female by me, it is presented that way in trades/reselling.
• Trading and gifting are both permitted.
• If you would like to hide the amount you paid for the adoptable in my deviation comments, inform me and I can do so.
• I still retain the right to post and use art I have drawn (your ownership will be credited if necessary).
• No co-ownership is allowed.

**VOUCHERS

• I allow vouchers only for the ORIGINAL owner of the adopt (sale, not trade/giveaway). I take no responsibility for these transactions.
• Vouchering is permitted only if equal to or lesser value than the price the design was bought for.
• The cost of all additional media (self-made or commissioned) is not to be included in voucher price.
• Designs obtained through voucher cannot be resold.

RESELLING - MONETARY TRANSACTION

• Reselling is permitted only if it's logged on THIS JOURNAL. Resales must be recorded on this journal from January 6th 2017 onwards.
• You must have owned the design for at least 4 weeks/1 month before you can resell it.
• You are only eligible to resell the adoptable if you are the ORIGINAL OWNER, or paid for it via sale. The design must be fully paid for.
• You must have the un-edited, full file of the adopt in order to resell it.
• You cannot sell it for more than what you paid, but may add the cost of commissioned art. Please mention the base price of the design to buy it as-is without extras.
• You cannot resell an adoptable obtained via trade, gift or other means.
• If the design was obtained in an OTA it can only be sold for the monetary offer, and not the worth of any additional design/art it was obtained for.

MYO SLOTS

--- "Make Your Own", regarding any of my species stories

• After a design is approved, it cannot be returned to being a slot.
• A design is not an official MYO until approved by me.
• Unless otherwise stated, you may ask/commission another artist to design your slot for you.
• If you paid for the slot, the design can now be resold for the same price as the slot itself.
• You cannot trade standalone unfinished slots but you can trade approved designs.
• I will not allow MYOs to look too similar to existing designs if possible, and will give warnings if encountering plagiarism.

FIRST TIME OWNERS "FTO"

• Includes anyone who has never owned or purchased a design made by me.
• This excludes those who have traded for a design, and also excludes anyone who has obtained a design from me before but is not a current owner.
• Designs obtained from FTO sales have a hold time of 4 weeks before changing hands (through resell, trade or gifting unless it is to another first time owner)

If anyone is caught breaking the FTO rules above I will not do them again.

BIDDING/OTA "OFFER TO ADOPT"

• If you have outstanding owed work from an OTA please refrain from participating in further sales until finished.
• Do not participate in auctions if you have not "completed payment" of a monetary offer. However pending art/customs take a longer time period and will not exclude you.

EDITING

• Please do not edit my original art before asking for permission. Creating icons or banners is fine.
• You may change 20% of the original design for yourself with a redrawn design, but only 15% of the design of a closed species. It should still look like the basic original design.
• If the edit is very minor (eg. adding earrings), you may also add it to the original art. However please HOLD ONTO THE ORIGINAL FILE for future sales/trading.
• Note me if unsure about any edits you want to make.

Credit can be given to yukibuns, yulcinoa, you can transfer creator rights to yoofiebun @ TH.

CLOSED SPECIES

• You may not use one design to spawn off a sibling or parent design if it is a closed species. You can use a custom slot or you may need to discuss it with me!

COMMERCIAL WORK

OFFENSES THAT WILL RECEIVE A WARNING

• Claiming the art or design as your own, unless your design was a MYO
• Asking for a refund
• Withdrawing your bids, or hiding bids to withdraw them.
• Asking to hold adoptables, with some exceptions.
• Reposting my artwork without permission, or repost original art without watermarking
• Traded and gifted designs cannot be resold or vouchered. Attempting to loophole any terms of service will also be warned.

DISCLAIMER: If purchasing with someone else's money/paypal/card, I expect to be informed and shown proof that this transaction is approved by all parties.

If you buy a product from me, you will have read and agreed to these terms.

Please trade fairly. If you think you may be getting scammed or undercut, please check my gallery or approach me for clarification.

4/15 Please respect the rules and be decent. Disrespecting rules may lead to a permanent ban or blacklist.

Blacklisted users may lose the right to obtain and own my designs. In rare instances ownership of my designs may be revoked.

I'm happy when owners also share with me what they do with characters purchased from me (this is not a rule or requirement !
