המשנה, שנחתמה בראשית המאה השלישית לספירה על ידי רבי יהודה הנשיא, הייתה ראשיתה של מהפכה פרשנית ונורמטיבית חסרת תקדים. לראשונה בתולדות המסורת היהודית, שהעבירה את חוקיה מדור לדור, נוצרה מערכת חוקים מקיפה העומדת לעצמה, במנותק מן המקרא. ספרי החומש זכו באותה עת גם לפרשנות נועזת ומתוחכמת, בספרות המדרש, שהוציאה את התורה מפשוטה והתאימה את מסריה למציאות זמנם של החכמים.
כיצד קרה שהחכמים יצרו מערכת חוקים חדשה ושונה מזו שהתקיימה מאות שנים? האם המדרש אכן נולד למטרות פרשנות או אולי מונחות בבסיסו מוטיבציות אחרות? המחבר בוחן לעומק שאלות יסוד אלה ומציע להן תשובות מפתיעות.

The first three chapters of Mishna Sotah describe the biblical ritual meant to examine a husband'... more The first three chapters of Mishna Sotah describe the biblical ritual meant to examine a husband's suspicions regarding his wife’s fidelity, in great detail. Diverging significantly from its origins, in the book of Numbers (cap. 5), The Mishnaic ritual was traditionally read by scholars as an "ancient Mishna", narrating an actual ritual practiced in the second temple. The book claims, in contrast to this generally accepted view, that while Sotah does contain some traditions which are possibly rooted in the Temple era, its overall composition has a clear ideological and academic form. Furthermore, comparisons with parallel Tannaitic sources reveal the ideological redaction of the Mishna, which carefully selected only those opinions which support its re-writing of the ritual as a public punitive ritual, while rejecting all reservations and opposition to its specific punitive character – even ignoring the possibility of innocence of the suspected adulteress. This led the author to the groundbreaking conclusion that, regardless of the form the real ritual did or did not take at the temple, the specific Mishnaic ritual was (re)invented by the rabbis in the second century C.E. Its existence, therefore, from its very inception, was purely textual, reflecting rabbinic imagination rather then memory. After establishing this thesis the author moves to examine its wider implications on three larger spheres of rabbinic studies: the place of the temple in Tannaitic literature, the role of Mishna as a composition, and, lastly, sexual ethics in rabbinic literature.

They form the building blocks of the derashot and can thus be used to uncover their inner logic. The structure discussed in this paper is a question marking a difficulty in the verse followed by a homily, which is preceded by the word "ella" (‘rather’). I will argue that this structure has unique characteristics, and that a systematic examination of all its hundred occurrences challenges our understanding of the method of midrash and its relation to allegory.

In addition to localized comparisons, several broad syntheses have been offered by scholars regarding Roman law and rabbinic halakhic thinking. In his article in this issue, “The Rabbinic Movement from Pharisees to Provincial Jurists,” Yair Furstenberg offers to explain the rise of the field of civil law in later tannaitic literature as part of the rise of the local jurist in the eastern provinces. I seize the opportunity of Furstenberg’s novel thesis to rethink recent trends of comparing Tannaitic halakhah and Roman law and their limitations.

Chapters 10-15 in Tosefta Soṭah contain the longest, most elaborated aggadic unit in the Tosefta.... more Chapters 10-15 in Tosefta Soṭah contain the longest, most elaborated aggadic unit in the Tosefta. It comprises various units that seem to be connected only loosely: the biblical righteous figures who brought abundance to the world (chs. 10-12); various revelations and appearances of the holy spirit and divine echo (ch. 13); and the effects of the destruction and the calamities of the present (chs. 14-15). In this article I argue that it forms in fact a coherent unit. It combines apocalyptic, priestly, and wisdom themes in a manner that is unprecedented in rabbinic literature, but is similar to several Second Temple texts. It tells a tale of perpetual decline from the biblical golden age to the rabbis' own age of destruction, together with its eschatological remedy. It combines priestly and apocalyptic themes to form an alternative to the standard rabbinic meta-narrative of the transfer from prophecy to Torah. The first section of the article discusses chapters 10-13 and reconstructs their meticulous similarity with, and influence by, Ben Sira; the second section compares the complete composite unit (chs. 10-15) to the parallel Mishnah; and the third section examines the apocalyptic themes found in our text. I end with the need to reevaluate the relationship between rabbinic literature and apocalypticism.

טקס שילוח השעיר לעזאזל למדבר והשלכתו מן הצוק, במשנה יומא פרק ו, מבוסס על פסוקי ויקרא פרק טז, אך ר... more טקס שילוח השעיר לעזאזל למדבר והשלכתו מן הצוק, במשנה יומא פרק ו, מבוסס על פסוקי ויקרא פרק טז, אך רחב ומפורט מהם הרבה יותר, ומכיל חומרים לא מקראיים רבים. חוקרים עסקו בגלגולי מוטיב השעיר לעזאזל בספרות הבתר מקראית, בקשר שבין עזאזל (או עזזאל) המקראי והאפוקליפטי ובמסורות הקשורות לו בספרות הבית השני. אך בדיונים אלה נגרע חלקה של המשנה. זו שמשה את החוקרים רק כעדות לשימורן של פרקטיקות ומסורות (בייחוד מתוך השוואה למסורות דומות בספרות הנוצרית בת הזמן). התיאור שבמסכת יומא לא נותח כמעט לגופו, ולא נלמד בהקשר למשנת יומא כולה ולטקסי מקדש במשנה בכלל. ממילא גם לא הבחינו אלו חלקים מתוך הטקס המשנאי לקוחים ממסורת ספרותית קדומה, אלו מקורם בריאליה מקדשית ואלו הם תוצאת יצירה מקורית של בית המדרש. אף לא שאלו כיצד חדרו חומרים אפוקליפטיים למשנה.
במאמר זה אני מבקש למלא לאקונה זו. ראשית אני סוקר את המקורות השונים של הטקס המשנאי מלבד המקרא. אחר כך אני בוחן את פרטי הטקס המשנאי ומבחין בין מקורותיהם השונים: מסורות מן המזרח הקדום מחד ומן הספרות האפוקליפטית מאידך. ביחס למקור השני אני מראה כי החכמים מודעים לשורשים האפוקליפטיים של המסורות שבידם ומעמידים אותם לצד הטקס המקראי מבלי להתיך אותם לתוכו. לפיכך יש במשנה שתי חתימות שונות לטקס: האחת, המקראית, שמסתיימת בהגעה למדבר, והשניה, האפוקליפטית, המסתיימת בהשלכה מן הצוק. לבסוף אציע כי זהו למקרה מבחן מובהק לדרכי הפנמתם וביותם של מסורות לא מקראיות במשנה.

The halakhic practice does more than regulating the inner world; it takes part in forming it, gen... more The halakhic practice does more than regulating the inner world; it takes part in forming it, generating a unique legal subject. But is there a unique halakhic Self? This article examines this question in the context of Tannaitic halakha, both Mishnaic and Midrashic. More specifically I ask whether one can speak of subjectivity in Tannaitic halakha. I study the relationship between anonymous halakhic rulings and specific positions presented in the name of individual sages or argued with the force of personal commitment. Through analyzing the "I" language in Tannaitic literature, in comparison with the rhetoric of prerabbinic halakha, I wish to advance the ongoing search for the rabbinic Self.

מאמר זה שופך אור על האיכויות הפרפורמטיביות שבתלמוד הבבלי דרך ניתוח סוגיה אחת ממסכת יומא. סוגיית "... more מאמר זה שופך אור על האיכויות הפרפורמטיביות שבתלמוד הבבלי דרך ניתוח סוגיה אחת ממסכת יומא. סוגיית "קרות הגבר" (דף כ ע"ב-כא ע"א) מציבה במרכזה ויכוח בין רב לר' שילא על פירוש המילה "גבר" במשנה (יומא א,ח). דרך חשיפת הקול כמוטיב השוזר את הסוגיה כולה אנו מצביעים על האופי המטא-פרפורמטיבי של הסוגיה, דהיינו על האופנים שבהם היא מסבה את תשומת הלב לביצוע שלה עצמה. הדיון בקול (החייתי, האנושי, והקוסמי) משמש על מנת לפרש את ביצוע הריטואל הבית-מקדשי, אך גם כמפתח לביצוע הריטואל הבית-מדרשי, הלימוד עצמו.
מתוך ניתוח מדוקדק של הסוגיה, מקורותיה הארץ ישראליים ועיבודה הבבלי, אנו מבקשים לצאת לטענה רחבה יותר על אופיו של התלמוד הבבלי כטקסט פרפורמטיבי. הסוגיה התלמודית מתארת ביצועים קודמים (בית-מקדשיים ובית-מדרשיים) ובה בעת מכוונת לביצועים העתידיים של לימודה. בכך, היא מפעילה מעגלים שונים של פרפורמנס שהתנועה ביניהם היא מהיסודות המכוננים של לימוד התלמוד.

Rabbinic literature contains various discussions of reliability and suspicion in social relations... more Rabbinic literature contains various discussions of reliability and suspicion in social relations as part of a sustained legal attempt at regulating these relations. In this paper I analyze the concepts of "suspicion" and "trust" as they appear in the Mishnah, the earliest legal code of rabbinic Judaism. Through a minute reading of several units from tractate Demai – which discusses the status of produce from which tithes may or may not have been taken – we will see that the Mihsnaic conceptualization is not a matter of interpersonal, subjective relationship, as we are used to think about trust, but rather of social policy, and is therefore subject to generalized rules.
