Drawing from the work of Nils Christie and Louk Hulsmann especially, the article looks at Hulsman/s Evaluation of the Vertical System: Language, values and perceptions. In the last part, the paper turns to Mediation - how does it function? An example: Germany - Legal Considerations. The paper describes the legal base for the growth of mediation in Germany. It deals then with a concrete mediation program the author directed for several years. It looks at "Advantages for Offenders, Victims and Society" - these advantages are theoretically delineated in detail.
