ABSTRACT À travers plusieurs rapports, la Commission européenne a imposé l’idée que les professio... more ABSTRACT À travers plusieurs rapports, la Commission européenne a imposé l’idée que les professions libérales se protégeraient indûment contre la concurrence : c’est ainsi que la suppression des règles traditionnelles de la profession d’avocats, permettrait une baisse du prix de leurs prestations, en créant un « marché des services juridiques », aux lieu et place d’un Ordre professionnel. Cette idée ne résiste pas – même du point de vue de la théorie économique standard - à la prise en compte du fait évident que l’effet-prix de la concurrence ne doit jamais être séparé de l’effet-qualité. La mise en mouvement du droit par les avocats pose des problèmes de coordination en qualité, insolubles dans la logique du marché, mais à la portée de celle d’un ordre professionnel Through several reports, the European Commission stressed the view that the constitutive rules of liberal professions might be illegimate protections against competition : therefore, as an example, alleviating the traditional rules organizing the profession of lawyers within a professional order would create a « market for legal services » and induce lower prices for consumers. The philosopher David Lewis is credited by many social scientists, including mainstream economist... more The philosopher David Lewis is credited by many social scientists, including mainstream economists, with having founded the modern (game-theoretical) approach to conventions, viewed as solutions to recurrent coordination problems. Yet it is generally ignored that he revised his approach, soon after the publication of his well-known book. I suggest that this revision has deep implications (probably not perceived by Lewis himself) on the analytical links between coordination, uncertainty and rationality. Thinking anew about these issues leads me to map out an alternative social scientific research programme. The traditional ontological equipment of methodological individualism should be reinforced in order to admit the existence of an “intersubjective” world beside the two familiar worlds: the “objective” world of observable things, and the “subjective” world of expectations and individual beliefs. In particular, language becomes necessary to understand coordination via conventions, rather than the other way round. That has led a group of institutionalist economists and pragmatist sociologists to develop an enlarged model of rationality, no longer isolated from questions of coordination and values. This model is the basis for the “Economics of Conventions”.

Résumé Dix conceptions de l'organisation sont passées en revue, et opposées à la vision traditionnelle du marché comme mode unique d'allocation de ressources. Les deux conceptions les plus novatrices rattachent organisation et marché à une notion commune : des arrangements contractuels inter-individuels, dans un cas, des dispositifs cognitifs collectifs, dans l'autre. Abstract Ten conceptions of organizations are reviewed and confronted with the traditional view of markets, as the only means of allocating ressources. The two most suggestive conceptions analyze organizations and markets through a common notion : interindividual contractual relationships in one case, cognitive collective devices in the other. Organizations can be studied as a means of allocating resources -an alternative to markets -apply... more Organizations can be studied as a means of allocating resources -an alternative to markets -applying the standard hypothesis of « Substantive Rationality ». In this analysis, organizational rules are reduced to a series of contracts. However, contracts are generally incomplete, and rules can be more appropriately viewed as « Collective Cognitive Devices » on the basis of the non-standard hypothesis of « Procedural Rationality ». In this frame-work, Organizations can be analyzed as « Internal Labor Markets », which protect their members from outside competition, thereby allowing « Organizational Learning » to take place. This concept allows differences between markets to emerge and could lead to new concepts of macroeconomic coordination.
