The purpose of this research is to know about how to manage and develop land waqf in Cokromenggal... more The purpose of this research is to know about how to manage and develop land waqf in Cokromenggalan Ponorogo Village, and about the potential for developing waqf productivity in Cokromenggalan Ponorogo Village. The research method used in this study is a qualitative method using an inductive approach, the data collection techniques used are observation, interview and documentations. The results of this study are the management and development of waqf in Cokromenggalan Village managed by nadzir with the assistance of the local mosque administrator (ta'mir). In the distribution of waqf assets, the majority are in the form of mosques, prayer rooms, and educational institutions. As for the potential development of waqf productivity, it is still not maximized, due to limited human resources, costs, and public awareness to manage waqf is still lacking.

If there is a balance from the payment, it will be returned in the form of money, but in practice in the community there are refunds (especially in small amounts) in the form of goods such as candy and also in the form of infaq or alms. This study aims to determine the mashlahah review of the return of the remaining purchases with goods and the return of the remaining purchases as infaq. This research is a field research with a qualitative type of case study at Surya Ponorogo supermarket with data collection techniques through observation of transaction activities, interviews regarding the practice of returning the remaining purchases that cannot be cashed. Then drawing conclusions using the inductive method, which begins with revealing phenomena that are specific in nature and drawing conclusions using general or general theories of Islamic law. Based on the results of the study, the practice of returning the remaining purchases that could not be cashed in in a condition where the spare change was completely depleted. When viewed from the side of mashlahah, it does not conflict with Islamic sharia. Because this policy is part of muamalah activities that are made to eliminate difficulties for the sake of getting benefit. The policy of returning the remaining purchases by the Surya Ponorogo supermarket has considered the concept of mashlahah and does not conflict with existing texts.

This study aims to outline how it should go back to the era when the charity in terms of its hist... more This study aims to outline how it should go back to the era when the charity in terms of its historical context by tracing regulations since the pre-colonial, Kolonia, the old order, a new order and until the era of reform. This study suggests that the zakat law positifikasi believed by many good scholars, Muslim scholars, and charity watchdog, as the best solution for the realization of the optimization of the collection and management of zaka, as one obligation for Muslims. Then the Law no. 38 of 1999 on Zakah Management is aimed at optimizing the distribution of zakat economic equality and development, but it needs to be supported by a business entity Zakah is a modern and professional. Zakah funds should be directed to small businesses run by the majority of the ummah, in this case agriculture, and the livelihoods of the majority of Muslims and people of Indonesia. Thus the charity will be able to influence the economic development of society.

The MUI's symbolic power over halal certification in Indonesia constructed by the habitus of Musl... more The MUI's symbolic power over halal certification in Indonesia constructed by the habitus of Muslim consumers who are becoming aware of halal lifestyles. beside it, the symbolic capital of the MUI and the political and social religious fields. When people expect the government to provide a solution to the issue of the distribution of consumer products containing material that is forbidden Islam, the government slowly respond to their aspirations, and even tend to do political engineering. then present the MUI with symbolic power instrument discourse the importance of established halal institutions in Indonesia. Through the old negotiations, finally there are some regulations that legitimize MUI and LPPOM as halal certification authority. in the Bourdieu study, halal certification LPPM MUI is a symbol system. The function of this symbol system is divided into three parts, the symbolic system as a structured structure, and Symbolic system as an instrument of domination. As a result, a structured group is created, a group that agrees with the authority of LPPOM MUI continues to campaign on the importance of halal certification of LPPOM MUI. and groups that do not agree to criticism, and sue the existence and authority of LPPOM MUI as the owner of halal certification authority in Indonesia.

This study aims to unravel the understanding of Investment law in Islam, especially conventional ... more This study aims to unravel the understanding of Investment law in Islam, especially conventional investment. So far, the Islamic investment model in Indonesia is still ranked under conventional investment in terms of both quality and quantity of capital and market. Thus, if a conventional investment is contaminated by Islamic law as a forbidden investment then its future impact will cloud the conventional investment market image. Thus the maqashid syariah approach needs to be used to reexamine how investment law in Islam. The results of the study in this study state that investments that promise big profits with light business are considered as a common investment and may be done because it is common in the community. However, when viewed from the side of goodness financially very disturbing financial stability both for investors and investors for the condition of the stability of the value of a currency (volatility). Although the investment business was initially based on real and lawful if they sold based on the method of sale in the derivative market will be full of usury, speculation, and vagueness that in some syariah prohibition is prohibited because it does not make good in investing as taught by Islam.

This article focuses on the study of inheritance law reform in Somalia. By using a legal political approach, this article examines several important issues, i.e.,: the model of inheritance law reform in Somalia, the reasons that led to the revolutionary change from the concept of Islamic inheritance in general, and and the factors that influence these changes. In general, this study shows that in the reform of family law in Somalia, there are several rules that are not much different from the concept of the imam of the school of thought, but there are also several legal rules that are quite far from the conceot of conventional, especially the legal rules related to inheritance

Peningkatan mekanisme modern pemotongan hewan, penyamakan modern, pembinaan tenaga profesional melalui pelatihan vokasional dan pengembangan program studi kriya kulit pada Sekolah Menengah Kejuruan. Pengembangan model kemitraan dengan pelibatanfour helix of innovation didasarkan pada kesadaran bersama dan ko-operasi (cooperation). Pengembangan kemitraan industri kreatif dibangun berdasar pada isu dan problem yang berkembang di Ponorogo. This article examines Jasser Auda's maqaṣid approach to studying hadith and its implications ... more This article examines Jasser Auda's maqaṣid approach to studying hadith and its implications for the renewal of Islamic law. Generally speaking, one way to gain a closer understanding of the purpose of the hadīth is through contextualizing the Prophetic narrations (hadīth), primarily when the scripture cannot be understood textually. Using a descriptive-analytic and critical approach, this study showed that the conception of Auda’s maqāṣid could solve the problem. First, Auda, in this terms, offers a way of reading the scripture based on the intent in applying Islamic law and how its implications when maqāṣid are a primary consideration in reading and applying the law. Along with the development of technology and online lending issues that are troubling the public, sharia fintech lending grows and develops. However, the challenges of online lending make this industry little known to the public, so its development tends to be slow. In quantitative terms, this industry is not as much as conventional fintech. Therefore the government (OJK) initiated regulations for this industry supported by the DSN MUI Fatwa. However, after it was implemented, it turned out that there were many obstacles that hindered the growth of sharia fintech lending. Based on the research findings, OJK needs to review this regulation to make it more flexible and support the development of Islamic banking fintech more rapidly

This research concludes that jihad is one of the teachings of Islam. In fact, its position in religion ranks third after the practice of praying and serving one's parents. This shows how important every Muslim is in carrying out jihad. So the jihad that must be carried out in this contemporary era is more aimed at maintaining life (socio-economic sector), such as eradicating poverty and underdevelopment. For this reason, the meaning of jihad must always be contextualized according to the times. Because Islam is a religion that has the nature of shalih li kulli zaman wa makan.

Generally speaking, one way to gain a closer understanding of the purpose of the hadīth is through contextualizing the Prophetic narrations (hadīth), primarily when the scripture cannot be understood textually. Using a descriptive-analytic and critical approach, this study showed that the conception of Auda’s maqāṣid could solve the problem. First, Auda, in this terms, offers a way of reading the scripture based on the intent in applying Islamic law and how its implications when maqāṣid are a primary consideration in reading and applying the law. So far, the Islamic investment model in Indonesia is still ranked under conventional investment in terms of both quality and quantity of capital and market. Thus, if a conventional investment is contaminated by Islamic law as a forbidden investment then its future impact will cloud the conventional investment market image. Thus the maqashid syariah approach needs to be used to reexamine how investment law in Islam. The results of the study in this study state that investments that promise big profits with light business are considered as a common investment and may be done because it is common in the community. However, when viewed from the side of goodness financially very disturbing financial stability both for investors and investors for the condition of the stability of the value of a currency (volatility). Although the investment business was initially based on real and lawful if they sold based on the method of sale in the derivative market will be full of usury, speculation, and vagueness that in some syariah prohibition is prohibited because it does not make good in investing as taught by Islam.

Along with the development of technology and online lending issues that are troubling the public, sharia fintech lending grows and develops. However, the challenges of online lending make this industry little known to the public, so its development tends to be slow. In quantitative terms, this industry is not as much as conventional fintech. Therefore the government (OJK) initiated regulations for this industry supported by the DSN MUI Fatwa. However, after it was implemented, it turned out that there were many obstacles that hindered the growth of sharia fintech lending. Based on the research findings, OJK needs to review this regulation to make it more flexible and support the development of Islamic banking fintech more rapidly

Penelitian ini pada intinya ingin menganalisis kebijakan fintech lending Syariah di Indonesia set... more Penelitian ini pada intinya ingin menganalisis kebijakan fintech lending Syariah di Indonesia setelah melihat beberapa indikasi. Diantaranya bahwa hadirnya teknologi fintech ini selalu tumbuh lebih dewasa daripada regulasi yang mengaturnya. Kedua, regulator terkesan lepas tangan terhadap hambatan yang dihadapi oleh fintech setelah dimplementasikannya kebijakan ini. Ketiga, banyaknya kendala dalam proses perizinan usaha yang salah satunya disebabkan oleh pasal-pasal di dalam fatwa DSN MUI no 117/ 2018 yang lebih banyak mengatur skema akad. Sedangkan landasan Syariah untuk proses perizinan usaha membutuhkan penjelasan yang lebih kompleks dari sekedar membahas skema akad tersebut. Keempat, otoritas yang berwenang tidak memberikan pilihan sumber hukum Syariah apa saja yang relevan terhadap kebutuhan perizinan, akan tetapi diserahkan sepenuhnya pada entitas usaha. Oleh karena itu melalui beberapa indikasi tersebut diduga adanya problem yang muncul terhadap implementasi kebijakan fintech lending Syariah terutama untuk mencapai tujuan Maslahah. Sehingga penting menurut peneliti untuk meninjau kembali bagaimana implementasi kebijakan ini, berikut dampaknya, dan perubahan bagi entitas fintech lending Syariah dan masyarakat secara luas. Penelitian ini juga menilai sejauh mana efektivitas implementasi kebijakan ini dalam mencapai tujuan kebijakan yang selaras dengan maqasid as-syariah.
Hasil riset ini menunjukkan bahwa melalui analisis terhadap kinerja indikator kebijakan berdasarkan teori Merilee S Grindle yang dikolaborasikan dengan maqashid Syariah abu ishaq as-syathibi menggunakan metode simple additive wighting disimpulan bahwa implementasi kebijakan fintech lending Syariah belum dapat bekerja secara optimal. Demikian ini karena proporsi bobot indikator dalam mencapai maslahah yang lebih unggul pada aspek pelaksana program, sumber daya, serta karakteristik penguasa. Sementara indikator yang lain seperti kepentingan, manfaat, serta perubahan yang ingin dicapai dari implementasi kebijakan ini dinilai belum optimal untuk mencapai kemaslahatan.
Belum optimalnya implementasi kebijakan fintech lending Syariah berdampak pada efektivitas implementasi kebijakan yang hanya mencapai nilai 70,4% (cukup efektif). Penilaian didiasarkan pada analisis N Gain Score yang dieksplorasi berdasarkan hasil survey terhadap 11 praktisi fintech lending Syariah.
Kemudian, implementasi kebijakan fintech lending Syariah yang belum efektif ini membawa perubahan dalam beberapa hal, perubahan di bidang ekonomi dalam jangka pendek meningkatkan jumlah industri fintech lending Syariah yang terdaftar dan berizin di OJK serta meningkatkan asset industri ini. Namun dalam jangka panjang harapan untuk meningkatkan jumlah entitas yang terdaftar dan pencapaian asset usaha secara konsisten belum tercapai. Kedua, perubahan di bidang sosial berdampak pada mapannya infrastruktur layanan keuangan bagi masyarakat dan semakin terbukanya masyarakat terhadap layanan fintech. Akan tetapi upaya edukasi yang diberikan oleh regulator belum menunjukkan pemahaman yang baik kepada masyarakat untuk lebih bijak memilih fintech yang aman. Hal ini dibuktikan dengan masih tingginya kasus jerat pinjaman online. Ketiga, perubahan dalam bidang hukum. Setiap persoalan yang muncul dari kasus pinjaman online lebih banyak dilakukan melalui mediasi yang difasilitasi LAPS. Namun langkah penyelesaian ini cenderung lebih memperhatikan posisi fintech daripada nasabah. Misalnya jika terjadi kasus penyalahgunaan data nasabah, belum ada upaya dari OJK untuk menyelesaikannya pada ranah litigasi karena landasan hukum yang belum relevan.
Oleh karena itu, berdasarkan analisis regulatory impact assessment dengan mempertimbangkan permasalahan yang muncul setelah diimplementasikannya kebijakan ini, lalu mengidentifikasi tujuan dan alternative penyelesaian masalah, serta melakukan analisis biaya manfaat, dan dikuatkan dengan komunikasi kepada para stakeholder, kontribusi penelitian ini menghasilkan sebuah kesimpulan bahwa perlu adanya peninjauan kembali terhadap POJK 77 tahun 2016 dan Fatwa DSN MUI nomor 117 tahun 2018. Hal ini sesuai dengan pernyataan as-syatibi bahwa apabila produk hukum hanya memiliki sebagian kriteria yang sesuai dengan tujuan maslahah maka salah satu kemungkinan yang dilakukan adalah melakukan perbaikan supaya memberikan dampak maslahah yang lebih optimal.
