The Environmental Services Association (ESA) is working to transform waste and resource management in the UK. Our work with Governments and regulators helps enable our members to turn Britain’s waste into valuable resources whilst protecting the environment. We are helping to raise standards across the sector to ensure that the environment and the public are protected. We work with members to make the industry a safe, more efficient and environmentally friendly place to be, as well as helping to deliver a long-term zero-waste, zero-carbon future, ESA practises what it preaches: in the three decades since 1990, the sector’s greenhouse gas emissions have come down 85%, a record few other industries can match. Given the right policy platform, the industry is ready to invest £10 billion in new recycling and recovery infrastructure, create 50,000 jobs and deliver more than 40 million tonnes of CO2 savings by 2030.

Find out more about our range of powers from our National Environmental Crime Unit Deputy Director, Joanna Larmour: https://lnkd.in/eb45kZzy #WasteCrimeWednesday - Publication of the guidance for the offence of "Failure to prevent fraud in the Economic Crime and Corporate Transparency Act 2023" The UK Home Office has confirmed that the offence will come into effect on 01/09/2025. and has suggested that this will allow organisations to prepare their fraud prevention procedures before the offence is in force. The guidance is published here: https://lnkd.in/gFyJDy36Summary 💷 Under the offence, large organisations may be held #criminally liable where an employee, agent, subsidiary, or other “associated person”, commits a #fraud intending to benefit the organisation. 💷 Examples may include #dishonest sales practices, the #hiding of important information from consumers or investors, or dishonest practices in financial markets. 💷 In the event of #prosecution, an organisation would have to demonstrate to the court that it had reasonable #fraudprevention measures in place at the time that the fraud was committed. 💷 The offence is intended to encourage organisations to build an #antifraud culture, in the same way that failure to prevent bribery legislation has helped reshape corporate culture since its introduction in 2010. The guidance has been developed with input from the Crown Prosecution Service (CPS), Serious Fraud Office (UK), HM Treasury, HM Revenue & Customs, Ministry of Justice UK, Cabinet Office, Attorney General | Procureur général’s Office and Financial Conduct Authority (FCA).

It was #AntiSlaveryWeek earlier this month which reminds us that reports of modern slavery in the UK continue to rise, with over 17,000 potential victims referred to the Home Office in 2023. The waste and recycling sector has some characteristics, such as use of temporary labour or agency workers, which can sadly be exploited by criminal activity of this kind. It is therefore essential that waste operators take steps to address modern slavery by educating staff on how to spot the signs, having awareness of risks in their supply chains, and clear processes in place for reporting potential victims.
