In 2011, the EC proposed Directive 2011/83/EU to harmonize consumer rights on unfair terms, dista... more In 2011, the EC proposed Directive 2011/83/EU to harmonize consumer rights on unfair terms, distance contracts and consumer sales. This paper discusses the remedies the Directive proposes to consumers who purchase things which appear not to be in conformity with the contract. It does so both from a historical and a comparative perspective.
Jacques Cujas and Hugues Doneau are reputed to be the standard-bearers of humanist jurisprudence,... more Jacques Cujas and Hugues Doneau are reputed to be the standard-bearers of humanist jurisprudence, an approach to law which gained ground in the fifteenth and sixteenth centuries. A school averse to medieval legal science, Cujas and Doneau are likely to share its bashing attitude. Yet, in recent literature it is argued that both scholars adopted a more balanced view on medieval legal writings. This paper aims to shed light on what this view entailed, first, by investigating Cujas' and Doneau's own writings on methodology and, secondly, by examining how these jurists put their methodology to practice in their efforts to solve difficult points of law in Justinian's Codex iuris civilis. The findings allow the author to speculate on Cujas' and Doneau's position vis-à-vis medieval legal heritage on the basis of a thorough analysis of their legal reasoning.

This book proves a treasure trove for every scholar who ventures on a journey over the tricky pat... more This book proves a treasure trove for every scholar who ventures on a journey over the tricky path of legal humanism. Though the analysis of the practical character of Cujas' work leaves room for critical comments, the book nonetheless offers valuable reference material accompanied by thorough analyses. The work done on Cujas' biography is impressive. The author delved deep into the archives to correct flaws in older biographies about Cujas' life. Similarly, the overview of the various existing editions of Cujas' works renders this book a valuable work of reference which no future scholar seriously writing about Cujas can dispense with. Finally, the in-depth discussion of Cujas' treatment of the law of succession and of feudal law give the reader a rare insight into a humanist legal mind. It can only be wished for that more humanist scholars will receive similar attention, as there still remains much to explore in the intriguing world of legal humanism.

Der Beitrag erforscht die Rolle des Wissens des Verkäufers im frühneuzeitlichen kastilischen Recht. Die Fragestellung wird im ersten Abschnitt erläutert. Der zweite Abschnitt behandelt die frühneuzeitliche kastilische Moraltheologie, die für das Verständnis der Entwicklungen im gemeinen Recht unumgänglich ist, und die derzeitige kastilische zivile Rechtslehre zur Sachmängelhaftung. Am Ende dieses Beitrags wird dann die Theorie anhand der Ergebnisse einer Recherche nach Prozessstücken und Vollstreckungstiteln im Archiv der königlichen Kanzlei zu Valladolid mit der Rechtspraxis der Zeit verbunden.
This book examined legal recourse for recipients of things exchanged for money, if the thing exch... more This book examined legal recourse for recipients of things exchanged for money, if the thing exchanged turned out to be defective. It explored how continental Western European legal doctrine and practice of the early modern period (1500-1800) formulated the recipient's remedies against the background of Justinianic Roman law, which in the High Middle Ages had become part of the ius commune. Since early modern legal debate about remedies for defects in things exchanged for money mainly evolved around sales and lease of objects, this study focused on the Roman law remedies in their ius commune-clothing available under those types of contracts.
