This book is realised with the financial support of CUSMAT-Centro Universitario di Studi Marittim... more This book is realised with the financial support of CUSMAT-Centro Universitario di Studi Marittimi Adriatico-ionici e dei Trasporti trans-europei, University of Macerata (Italy). CUSMAT was created in 2015 to give focus to an existing interest in maritime law and transport law as these subjects had always been an important feature of law at Macerata. This Research Center aims to act as a promoter of interdisciplinary and comparative research and training activities through the interaction of policymakers, practitioners, academics, industry, and commerce and in partnership with other national and international bodies and institutions operating in its research area. It also aims to promote and organise scientific events, to participate in research projects at national and European level, and to provide legal advice on maritime affairs and transport to national and local institutions, non-governmental organizations and private entities.

as a scholar of the law of the sea. Through a careful analysis of State practice, he justified the exercise of State power at sea on the basis of a functional approach, whereby the extent of a coastal State’s powers was to be determined in accordance with the protection of specific interests related to a coastal community. When a spatial approach prevailed in the codification of the law of the sea, Conforti, while acknowledging the evolution that had taken place, reiterated the importance of the functional approach to explain the progressive extension of State powers at sea to new areas of interest.

Article 5(2) of the Agreement under the United Nations Convention on the Law of the Sea on the Co... more Article 5(2) of the Agreement under the United Nations Convention on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological Diversity of Areas Beyond National Jurisdiction (BBNJ Agreement) defines the interaction between this new Agreement and other existing conventional regimes. The above-mentioned clause is clearly intended not to undermine the functionality of "relevant legal instruments and frameworks and relevant global, regional, subregional and sectoral
bodies" with competence over marine areas beyond national jurisdiction in the interpretation and application of the new Convention, but its wording leaves some important interpretive doubts. The purpose of this article is to focus in particular on the area-based management instruments, including marine protected areas (MPAs), established by the other relevant conventional regimes mentioned, and to assess their compatibility with Part III of the BBNJ Agreement.

This paper analyses how the legal status of the disputed territories of Northern Cyprus and the G... more This paper analyses how the legal status of the disputed territories of Northern Cyprus and the Gaza Strip affects the legal regime of waters off their coasts. For both situations, the analysis focuses on the following fundamental issues: the legal regime of maritime disputed territories; the maritime delimitation disputes between each disputed territory and States with opposite or adjacent coasts; and the legal regime of natural resources of the waters off the coasts of a disputed territory. In particular, the legal opinions expressed by Turkish Republic of Northern Cyprus and the State of Palestine are scrutinized, offering an assessment in the light of the relevant rules of the law of the sea and other pertinent rules of international law.

as a scholar of the law of the sea. Through a careful analysis of State practice, he justified the exercise of State power at sea on the basis of a functional approach, whereby the extent of a coastal State’s powers was to be determined in accordance with the protection of specific interests related to a coastal community. Cette étude effectue une analyse du régime juridique de la « mer de Gaza » selon le droit interna... more Cette étude effectue une analyse du régime juridique de la « mer de Gaza » selon le droit international après l’adhésion de l’État de Palestine, le 2 janvier 2015, à la Convention des Nations unies sur le droit de la mer. À la suite de cette adhésion, le 24 septembre 2019, l’État de Palestine a notifié au Secrétariat général des Nations unies les coordonnées de ses frontières maritimes en spécifiant l’extension de la mer territoriale, de la zone contiguë, de la zone économique exclusive et du plateau continental. L’étude est axée sur trois questions fondamentales : le régime juridique des zones maritimes de la Palestine, les contentieux des délimitations maritimes entre la Palestine et les États adjacents ou qui se font face et le régime juridique des ressources biologiques et minières des eaux adjacentes à la Bande de Gaza. Toutefois, le statut juridique de la mer au large de la Palestine ne peut être évalué qu’à partir des circonstances particulières qui concernent le territoire palestinien en tant que territoire sous occupation militaire depuis 1967.

per rischio di dual use e violazione del diritto internazionale e umanitario Come accademiche e a... more per rischio di dual use e violazione del diritto internazionale e umanitario Come accademiche e accademici, ricercatrici e ricercatori, e personale tecnico-amministrativo, impegnate nei centri di ricerca e nelle università in Italia e all'estero, assistiamo con enorme sgomento alla brutalità degli eventi che, dall'ottobre 2023, interessano la Striscia di Gaza. In seguito agli attacchi di Hamas il 7 ottobre 2023, lo stato di Israele ha risposto con una violenza militare che ha oggi causato la morte di quasi 30.000 palestinesi, in larga parte minori, il trasferimento forzato di circa due milioni di palestinesi all'interno della Striscia, più di un milione dei quali vivono oggi in tende a Rafah senza sapere quale sarà il loro destino, e il pressoché totale annichilimento delle infrastrutture civili (dalle case agli ospedali e le scuole) necessarie alla sopravvivenza umana a Gaza. Nel nord della Striscia, centinaia di migliaia di palestinesi sono a rischio di morire di fame a causa del blocco agli aiuti imposto dall'esercito israeliano. Come il report compilato dalla London School of Hygiene and Tropical Medicine, il Health in Humanitarian Crises Centre e il John Hopkins Center for Humanitarian Health dimostra, nei prossimi sei mesi a Gaza potrebbero morire tra le 60.000 e le 75.000 persone a causa dell'assenza di cibo, acqua e di minime condizioni igieniche che impediscano la diffusione di malattie ed epidemie. 1 Ciò a cui stiamo assistendo è una catastrofe umanitaria e configura, come denunciato dalle agenzie delle Nazioni Unite e dalle principali organizzazioni internazionali per i diritti umani operanti nella zona, una grave violazione del diritto umanitario da parte di Israele. Lo scorso gennaio, la Corte Internazionale di Giustizia ha emesso un'ordinanza nella quale si riconosce che vi è un rischio plausibile che Israele stia commettendo il crimine di genocidio a Gaza, e ha indicato sei misure cautelari urgenti atte a impedire che questo avvenga. It was developed by a group of scholars in the fields of Holocaust history, Jewish studies, and Middle East studies to meet what has become a growing challenge: providing clear guidance to identify and fight antisemitism while protecting free expression. It has over 200 signatories.
