For the last fifteen or so years, there has been growing economic and political optimism regardin... more For the last fifteen or so years, there has been growing economic and political optimism regarding Latin America. However, this is also the continent with the highest homicide rate as well as endemic political corruption – increasingly tied to criminal activity and members of State security institutions. The " normalization " of the State's repressive behaviour in the name of democracy, while also reinforcing certain of its authoritarian trends, is a standard practice in Latin American countries. To what extent is this paradox intrinsic to the democratization process these countries are going through? To bring some elements of a response, the " grey zones " concept will be developed here through the example of the phenomenon of " militias " in the western area of Rio de Janeiro.

During the past decade we observe a growing optimism on the Latin American continent. However, it... more During the past decade we observe a growing optimism on the Latin American continent. However, it is also the continent where we see the highest rate of homicides and a political corruption increasingly embedded in "organized crime" from the state and in particular, from the members of its security institutions. We refer to new "mafiosi phenomena" who question the belief that Latin America "organized crime" is always linked to "drug traffickers". These new "mafiosi phenomena" are formed in the heart of the state through an "authoritarian culture" firmly rooted in the political and security institutions in Latin America. The evolution of this "authoritarian culture" has followed a common denominator powered by a dual mechanism: individuals require more security against a rising crime, while the state responds advantage repression. We find in the history of the Latin American countries 'standardization' of the repressive behavior of the state in the name of democracy, while strengthening its authoritarian tendencies. Nowadays the emergence of a kind of "police mafiosi" that imposes tax and the "illegal protection" to the poor and relies on the cooperation of politicians eager to vote is nothing other than the perverse result of this process. This "snowball" is it due to the structural weakness of the Latin-American counties? To what extent this paradox is it intrinsic to the process of democratization of Latin American institutions in a transnational context? To what degree this "authoritarian culture" was the springboard for the consolidation of the phenomena of more and more complex within the state apparatus? To address this issue we will do, at first, a comparative study, observing how the phenomenon of "police mafiosi" has established itself in Brazil through the case of "Milicias" in Rio de Janeiro, then Argentina, through the example of the "Policia Maldita" in Buenos Aires.

Cette etude se propose de repondre dans quelle mesure le processus de democratisation des institu... more Cette etude se propose de repondre dans quelle mesure le processus de democratisation des institutions de securite en Argentine et au Bresil a ete suivi de pres par un processus « mafieux » de leurs polices, en s’appuyant sur les cas de la police de la province de Buenos Aires et celle de la ville de Rio de Janeiro. Nous avons choisi de travailler a partir de ces deux corps policiers puisqu' ils sont historiquement connus pour leurs affaires de corruption et leurs pratiques arbitraires vis-a-vis des habitants des quartiers defavorises. Le contexte post-dictatures dans ces deux pays a entraine des reconfigurations dans le « modus operandi » des forces policieres et de nouvelles dynamiques « mafieuses » se sont renforcees conjointement au renforcement d’un paradigme securitaire qui emerge au cœur meme de ces jeunes democraties. O presente artigo tem como objetivo reunir argumentos que possibilitem afirmar a memoria como um direito humano. Para tanto, busca responder as seguintes questoes: Que significado tem a memoria? Por que e como e possivel reconhecer a memoria a condicao de direito humano? De que forma o Direito pode tutelar o direito a memoria?

As diversas parabolas trazidas por Kafka sao analisadas como paradigmas da nossa sociedade contemporânea e, igualmente, como hipoteses de retorno aos tempos pre-juridicos. Assim, seus escritos permitem a reflexao de um sistema juridico cada vez mais desumano, onde as vitimas se tornam meras estatisticas na historia de violacoe s aos direitos humanos.

Cependant, il s'agit egalement du continent ou nous constatons le taux le plus eleve d'homicides ainsi qu'une corruption politique de plus en plus liee au crime issu de l'Etat et notamment, des membres de ses institutions securitaires. Cette relation n'est pas nouvelle, cependant depuis les annees 2000 elle est devenue plus complexe, organisee et enracinee dans certains territoires marginalises. Nous faisons ici reference a de nouveaux phenomenes mafieux de groupes composes de policiers (appeles " milices ") qui se sont developpes et consolides dans ce climat d'optimisme economique.
